FACTS:

Mr A was a notorious big time drug pusher in Aquino drive Baliwasan.

This was reported by a civilian informant to a PDA agent. In the morning of
January 10, 2017 after receiving the report, the PDEA agent concerned,
informed the regional director of the activities of Mr A.
The regional director called for a briefing to prepare for an entrapment
operation against Mr A. Since Mr A only sells shabu for bulk sale only
amounting to 200k. They do not have that amount of money for the
operation, thats why they prepare a bogus money by cutting bond papers to
a size of money bills and then place a 1k pesos bill on top of each bundle.
The civilian informant contracted Mr A and set an appointment to buy shabu
worth 200k pesos. At three o'clock in the afternoon on the same day (not
yet).
During the briefing, agent X was assigned to act as poseur-buyer and
will be accompanied by the civilian agent who knows Mr A. They were able to
set an appointment at 3 o'clock in the afternoon the next day at the corner of
baliwasan grande in front of BCC building . So before 3 o'clock, the agents of
PDEA (NOT YET) also agreed that once the transaction is consummated,
meaning the shabu is already in the hands of agent X, then agent X will
remove his bull cap to signal the other members of the team to help arrest
the suspect.
The one assigned to arrest the suspect is agent Y, while the other
members of the team consisting of 8 more PDEA agent also assigned to
provide security. So at 15mins before 3 o'clock, they left the office of PDEA
and proceeded to the corner of baliwasan grande at the old shell gasoline
station they park their vehicles consisting of one motorcycle where agent X
with the civilian informant boarded and a Revo where the other members of
the entrapment team are boarded.
They proceeded on foot to the target area where the civilian informant
immediately sighted Mr A. Mister A acknowledge the arrival of the civilian
informant by nodding his head. When the civilian informant and agent X was
already with MR A, the civilian informant will introduce agent X to Mr A as his
buyer as a friend from Labuan.
Mr A ask agent X where is the money, then Agent X gave MR A a white
envelope containing the bogus money with a 1k pesos on top of the window
envelope. So the 1k peso can be seen thru the window. After receiving the
envelope, Mr A called somebody using his cellphone and then a motorcycle
arrived and the driver gave him a small pouch from a small bag. When he
got the pouch from the small bag the driver left immediately. When Mr A got
the pouch he gave it to agent A who opened it right away and found that it
contains a sachet of medium pack containing white crystalline substance
that he believe to be shabu. He then removed his bull cap. Thereafter, agent
Y, the back-up rush up and arrested Mr A and all the members of the team
also followed. Agent Y, recover the money inside the envelope inside the
pocket of the jacket of Mr A. Then agent X, marked the shabu and agent Y
marked the bogus money. They conducted the inventory right there and
then proceeded to their office. When the content of the pouch was submitted
for examination, it gave positive result for methamphetamine hydrochloride
or shabu weighing 50 grams.
