My client would be advised to simply register the airplane in the
Civil Aviation Authority of the Philippines as stated in Republic Act 9497. The Chattel Mortgage Law or Act 1508 states that a chattel mortgage shall not be valid against any person except the mortgagor, his executors or administrators, unless the possession of the property is delivered to and retained by the mortgage or unless the mortgage is recorded in the office of the register of deeds of the province in which the mortgagor resides at the time of making the same, or, if he resides without the Philippine Islands, in the province in which the property is situated. Considering that the law was enacted in 1906, a new law, known as Republic Act of 9497 has been formed in 2007 that repeals or modifies accordingly all laws, decrees, executive orders, rules and regulations, or parts thereof inconsistent with the provisions of this Act. This Act shall diminish the powers and functions of the Manila International Airport Authority created by virtue of Executive Order No. 903, series of 1983, Subic Bay Metropolitan Authority created by virtue of Republic Act 7227, and among others. In Statutory Construction, it is stated that repealing clause announces the prior statures or specific provisions, which have been revoked by reason of the enactment of the new law. Therefore, it is only just and proper that my client should register his airplane as stated in Republic Act 9497.
