AP STATE REORGANISATION ACT, 2014

Key points in examination point of view:

All the acts are published in the Government Gazette Ministry of Law and Justice
(Legislative Department) is responsible for the same
Received the assent of the President of India on March 1, 2014
Enacted by the Parliament in its 65th year of the Republic of India
Appointed day means the day notified in the gazette
Population ratio AP: Telengana. 58.32:41.68 (2011 census)
Successor states means both AP and TS from the appointed day
Transferred Territory means area transferred from AP to TS
New state is known as State of Telengana (from the appointed day)
From Bhurgumpadumandal of Khammam district few revenue villages were not ceased,
but continued to be a part of AP. (Bhurgumpadu, Seetharamanagaram and Kondreka)
TS now does not share border with Odisha
It shares borders with Maharashtra, Karnataka, Chattisgarh and AP.
After amendment was made to the AP Reorganization Act, 7 Mandals (327 revenue
villages) in Khammam (TS) were transferred to AP.
Chintoormandal (which was transferred to A.P.) forms a junction sharing border with
Telangana, Odisha and Chhattisgarh.
Hyderabad is the common capital for both the states for not exceeding 10 years
After 10 years Hyderabad will be the capital for TS and there will be a new capital for
AP
Common capital means existing area of GHMC
Union government (Union Home Ministry) must appoint an expert committee within 6
months for new capital

The Governor of AP is the governor for both the states. Till the President takes the
decision
On and from the appointed day, for the purposes of administration of the common capital
area, the Governor shall have special responsibility for the security of life, liberty and
property of all those who reside in such area.
In particular, the responsibility of the Governor shall extend to matters such as law and
order, internal security and security of vital installations, and management and allocation
of Government buildings in the common capital area.
Governor exercises his individual decisions after consulting the Council of Ministers of
TS (Governors discretion is final). Governor is assisted by the two advisors appointed
by the central government.
Former IAS officer A P V N Sarma and former IPS officer A K Mohanty have been
appointed as advisors.
Greyhound training centre in Hyderabad is administered by central government for 3
years. Later it becomes part of TS. It was set up in the year 1989 by an IPS officer K S
Vyas. He was killed in 1993
OCTOPUS (Organisation for Counter Terrorist Operations) is divided between the 2
states.It was established in the year 2007
Accordingly schedule one of the Constitution of India amended
4th schedule amended. 11 seats to AP and 7 seats to TS were allocated in Rajya Sabha
House of people (Lok Sabha): 25 seats to AP and 17 seats to TS have been allocated
The Election Commission would conduct elections to both the states.
Legislative Assembly seats for AP and TS is 175 and 119 respectively
Governor may nominate an Anglo-Indian community member to the assembly under
the provisions of article 333
AP and TS assemblies are deemed to be elected on the appointed day
Duration of assemblies 5 years
Existing Speaker of AP continues as the Speaker of AP assembly
Existing Deputy Speaker of AP would continue as the Deputy Speaker for TS and acts as
the Speaker till the speaker is elected
Both states continue to have Legislative Councils
AP Not more than 50 members
TS Not more than 40 members

Deputy Chairman of AP Legislative council continues as the Deputy Chairman of TS
All constituencies shall be single member constituencies
Reservation of SC and ST

High Court:

The High Court of Judicature at Hyderabad shall be the common High Court for the
State of Telangana and the State of Andhra Pradesh till a separate High Court for the
State of Andhra Pradesh is constituted under article 214 of the Constitution.
The expenditure in respect of salaries and allowances of the Judges of the common
High Court shall be allocated amongst the States of Andhra Pradesh and Telangana on
the basis of population ratio.
The High Court of Judicature at Hyderabad will be called High Court at Hyderabad
The President decides the seat of HC of AP
A new bar council for Telengana is constituted
CAG submits the report to the Governor of the concerned state
Revenue:

The award made by the 13th Finance Commission to the existing State of Andhra
Pradesh shall be apportioned between the successor States by the Central Government on
the basis of population ratio and other parameters.
Provided that on the appointed day, the President shall make a reference to the 14th
Finance Commission to take into account the resources available to the successor States
and make separate awards for each of the successor States.
The Central Government shall, while considering the special development package for
the Successor State of Andhra Pradesh, provide adequate incentives, in particular for
Rayalaseema and north coastal regions of that State.

Disputes in Revenue sharing:


Any dispute regarding the amount of financial assets and liabilities shall be settled
through mutual agreement, failing which by order by the Central Government on the
advice of the CAG.

Land and Goods:

All land and all stores, articles and other goods belonging to the existing State of Andhra
Pradesh shall
(a) if within the transferred territory, pass to the State of Telangana
or
(b) in any other case, remain the property of the State of Andhra Pradesh:
Stores relating to the Secretariat and offices of Heads of Departments having jurisdiction
over the whole of the existing State of Andhra Pradesh shall be divided between the
successor States on the basis of population ratio.
Treasury, Bank Balance and credit is divided on the basis of population
Tax arrears will be collected by the respective state
PF of employees would go to that state where he/she is permanently allocated
Liability as guarantor Respective state

AIS
The provisional strength, composition and allocation of officers to the State cadres shall
be such as the Central Government may, by order, determine on or after the appointed
day.
PSC:
The AP, PSC continues to be the APPSC
For Telengana under the Article 315 a separate PSC would be constituted. Till then the
functions are performed by UPSC with the approval of the President
Under Article 323 the respective PSC submits the report to the Governor and is placed
before the State legislature by the Governor.

Management and Development of Water Resources:


The Central Government shall, on and from the appointed day, constitute an Apex
Council for the supervision of the functioning of the Godavari River Management Board
and Krishna River Management Board.
The Apex Council shall consist of
a. Minister of Water Resources, Government of IndiaChairperson (AEE Prelims)
b. Chief Minister of State of Andhra PradeshMember
c. Chief Minister of State of TelanganaMember.
This council supervises the functions of these boards
The headquarters of Godavari River Management Board shall be located in the successor
State of Telangana and of the Krishna River Management Board shall be located in the
successor State of Andhra Pradesh (Vijayawada).

Article 371D:
The President may by order made with respect to the State of Andhra Pradesh or the State
of Telangana, provide, having regard to the requirement of each State, for equitable
opportunities and facilities for the people belonging to different parts of such State, in
the matter of public employment and in the matter of education, and different provisions
may be made for various parts of the States.
Equal opportunities under Article 371 D for providing quality education would continue
for 10 years

Article 168 amended accordingly:


Constitution of Legislatures in States
For every State there shall be a Legislature which shall consist of the Governor, and
in the States of Bihar, Madhya Pradesh, Maharashtra, Karnataka, AP, Telengana and
Uttar Pradesh, two houses:
in other States, one House
Where there are two Houses of the Legislature of a State, one shall be known as the
Legislative Council and the other as the Legislative Assembly, and where there is only
one House, it shall be known as the Legislative Assembly
The Rajya Sabha members were allocated to each state the Chairman of Council of
States by lots.
