Charge Description: That on or about 3/11/2017, in Hennepin County, Minnesota, NICHOLAS MICHAEL
LOWERS did by means of a motor vehicle, flee or attempt to flee from a peace officer acting in the lawful
discharge of an official duty, who NICHOLAS MICHAEL LOWERS knew or reasonably should have
knownwasapeaceofficer.

 STATEMENTOFPROBABLECAUSE

Complainanthasinvestigatedthefactsandcircumstancesofthisoffenseandbelievesthefollowing
establishesprobablecause:

On03/11/2017,atapproximately2:21p.m.,aBloomingtonPoliceOfficerobservedasilverSaturnvehicle,
suspectvehicleherein,withamissingfrontlicenseplateatAmericanBoulevardEastand12thAvenue
SouthinBloomington,HennepinCounty,MN.ThelightwasredatAmericanBoulevardEastand12th
AvenueSouth,sothedriverofthesuspectvehiclepulledintoaparkinglotandthenexitedtheparkinglot
overaberm,drivingoverthesidewalkandbackontoAmericanBoulevardEast.Theofficeractivatedhis
squadsemergencylightsandattemptedtoconductatrafficstopofthesuspectvehicle.Thedriverofthe
suspectvehicledidnotstop,andinsteadacceleratedeastonAmericanBoulevardEastatahighrateof
speed.Theofficerhadthelightsandsirenactivatedonthesquadcarastheofficerpursuedthesuspect
vehicle.Thesuspectvehiclecontinuedthroughagreenlightattheintersectionof24thAvenueSouthand
acceleratedtospeedsexceeding90milesperhour.Thesuspectvehiclethencontinuedeastboundtothe
intersectionofAmericanBoulevardEastand34thAvenueSouth,wherethetrafficsignalclearlydisplayed
aredlightforeastboundtraffic.Itappearedthedriverofthesuspectvehicleattemptedtobrakeandlost
controlofthesuspectvehicle,continuingthroughtheredlightandcollidingwithanothervehicle,victim
vehicleherein,thatwastravelingsouthboundon34thAvenueSouth.Thesuspectvehiclethencrashedinto
atrafficlightpoleandcametorest.

Policemadecontactwiththetwooccupantsofthesuspectvehicle.Thedriverofthesuspectvehiclewas
identifiedasNICHOLASMICHAELLOWERS(DOB:09/10/1989),DEFENDANTherein.Thefront-seat
passengerwhowasidentifiedasS.K.H.(DOB:08/11/1992),VICTIM1herein.VICTIM1waslyingface
downwedgedbetweenthetwofrontseats,withherlegsinthefrontpassengerseatandhertorsointhe
backseat.VICTIM1wasinitiallyyellingaboutbeinghurtandthatshewasstuck.Policenoticedalarge
amountofbloodpoolinginthebackseatwhereherfacewas.VICTIM1suddenlystoppedyellingand
appearedtogolimp.PolicethenobservedthatVICTIM1wasnotbreathingandVICTIM1appearedto
havesufferedsignificantbluntforcetraumatothetop/frontofherhead.OfficersattemptedCPRonVICTIM
1.VICTIM1wastransportedtoHennepinCountyMedicalcenterandwaspronounceddeceasedat
approximately3:09p.m.

Policealsomadecontactwiththedriverofthevictimvehicle,whowasidentifiedasM.M.C.,VICTIM2
herein.VICTIM2reportedthatshehitherheadasaresultofthecrashandwasevaluatedbyparamedics.
VICTIM2reportedthatshehadagreenlightwhensheenteredtheintersectionofAmericanBoulevard
Eastand34thAvenueSouth.Policealsospokewithtwoidentifiedwitnesseswhoweretravelling
southboundon34thAvenueSouthdirectlybehindthevictimvehiclewhenthecrashoccurred.Thesetwo
witnessesalsoreportedthatsouthboundtraffichadagreenlightatthetimeoftheaccident.

BloomingtonPoliceconductedaninspectionofDEFENDANTsvehicle.Theinspectorconcludedthatthe
crashoccurredduetothehighspeedsofthedriver.

PolicealsolearnedthatthesuspectvehicledrivenbyDEFENDANT(MN/Lic:890-NXD)wasreported
stolenoutofBloomingtonon02/15/2017.
