RULE142

Cost

Section1.Costordinarilyfollowresultsofsuit.Unlessotherwiseprovidedintheserules,costshallbeallowedtotheprevailing
partyasamatterofcourse,butthecourtshallhavepower,forspecialreasons,toadjudgethateitherpartyshallpaythecostsofan
action,orthatthesamebedivided,asmaybeequitable.NocostsshallbeallowedagainsttheRepublicofthePhilippinesunless
otherwiseprovidedbylaw.

Section2.Whenactionorappealdismissed.Ifanactionorappealisdismissedforwantofjurisdictionorotherwise,thecourt
neverthelessshallhavethepowertorenderjudgmentforcost,asjusticemayrequire.

Section3.Costwhenappealfrivolous.Whereanactionorappealisfoundtobefrivolous,doubleortreblecostmaybeimposed
ontheplaintifforappellant,whichshallbepaidbyhisattorney,ifsoorderedbythecourt.

Section 4. False allegations. An averment in a pleading made without reasonable cause and found untrue shall subject the
offendingpartytothepaymentofsuchreasonableexpensesasmayhavebeennecessarilyincurredbytheotherpartybyreasonof
suchuntruepleading.Theamountofexpensessopayableshallbefixedbythejudgeinthetrial,andtaxedascosts.

Section5.Nocostforirrelevantmatters.Whentherecordcontainsanyunnecessary,irrelevant,orimmaterialmatter,thepartyas
whoseinstancethesamewasinsertedoratwhoseinstancethesamewasprinted,shallnotbeallowedascostsanydisbursement
forpreparing,certifying,orprintingsuchmatter.

Section6.Attorney'sfeesascost.Noattorney'sfeesshallbetaxedascostsagainsttheadverseparty,exceptasprovidedbythe
rulesofcivillaw.Butthissectionshallhavenorelationtothefeestobechargedbyanattorneyasagainsthisclient.

Section7.Restrictionofcost.Iftheplaintiffinanyactionshallrecoverasumnotexceedingtenpesosasdebtordamages,he
shallrecovernomorecostthandebtordamages,unlessthecourtshallcertifythattheactioninvolvedasubstantialandimportant
righttotheplaintiffinwhichcasefullcostmaybeallowed.

Section8.Costs, how to taxed. In inferior courts, the costs shall be taxed by the justice of the peace or municipal judge and
includedthejudgment.Insuperiorcourts,costsshallbetaxedbytheclerkofthecorrespondingcourtonfivedays'writtennotice
givingbytheprevailingpartytotheadverseparty.Withthisnoticeshallbeservedastatementoftheitemsofthecostclaimedbythe
prevailingparty,verifiedbyhisoathorthatofhisattorney.Objectionstothetaxationshallbemadeinwriting,specifyingtheitems
objectedto.Eitherpartymayappealtothecourtfromtheclerk'staxation.Thecostsshallbeinsertedinthejudgmentiftaxedbefore
itsentry,andpaymentthereofshallbeenforcedbyexecution.

Section9.Costinjusticeofthepeaceormunicipalcourts.Inanactionorproceedingpendingbeforeajusticeofthepeaceor
municipaljudge,theprevailingpartymayrecoverthefollowingcost,andnoother:

(a)Forthecomplaintoranswer,twopesos

(b)Fortheattendanceofhimself,orhiscounsel,orboth,onthedayoftrial,fivepesos

(c)Foreachadditionalday'sattendancerequiredintheactualtrialofthecase,onepeso

(d)Foreachwitnessproducedbyhim,foreachday'snecessaryattendanceatthetrial,onepeso,andhislawfultraveling
fees

(e)Foreachdepositionlawfullytakenbyhimandproducedinevidence,fivepesos

(f)Fororiginaldocuments,deeds,orpapersofanykindproducedbyhimnothing

(g)Forofficialcopiesofsuchdocuments,deeds,orpapers,thelawfulfeesnecessarilypaidforobtainingsuchcopies

(h)Thelawfulfeespaidbyhimforserviceofthesummonsandotherprocessintheaction

(i)Thelawfulfeeschargedagainsthimbythejudgeofthecourtinenteringanddocketingandtryingtheactionorproceeding.

Section10.CostinCourtofFirstInstance.InanactionorproceedingpendinginaCourtofFirstInstance,theprevailingpartymay
recoverthefollowingcosts,andnoother:

(a)Forthecomplaintoranswer,fifteenpesos

(b)Forhisownattendance,andthatofhisattorney,downtoandincludingfinaljudgment,twentypesos

(c) For each witness necessarily produced by him, for each day's necessary attendance of such witness at the trial, two
pesos,andhislawfultravelingfees

(d)Foreachdepositionlawfullytakenbyhim,andproducedinevidence,fivepesos

(e)Fororiginaldocuments,deeds,orpapersofanykindproducedbyhim,nothing

(f)Forofficialcopiesofsuchdocuments,deeds,orpapers,thelawfulfeesnecessarilypaidforobtainingsuchcopies

(g) The lawful fees paid by him in entering and docketing the action or recording the proceedings, for the service of any
processinaction,andalllawfulclerk'sfeespaidbyhim.

Section11.CostsinCourtofAppealsandinSupremeCourt.InanactionorproceedingpendingintheCourtofAppealsorinthe
SupremeCourt,theprevailingpartymayrecoverthefollowingcosts,andnoother:

(a)Forhisownattendance,andthatofhisattorney,downtoandincludingfinaljudgment,thirtypesosintheCourtofAppeals
andfiftypesosintheSupremeCourt

(b)Forofficialcopiesofrecordonappealandtheprintingthereof,andallothercopiesrequiredbytherulesofcourt,thesum
actuallypaidforthesame

(c)AlllawfulfeeschargedagainsthimbytheclerkoftheCourtofAppealsoroftheSupremeCourt,inenteringanddocketing
theactionandrecordingtheproceedingsandjudgmentthereinandfortheissuingofallprocess

(d)NoallowanceshallbemadetotheprevailingpartyintheSupremeCourtorCourtofAppealsforthebrieforwrittenor
printedargumentsofhisattorney,orcopiesthereof,asidefromthethirtyorfiftypesosabovestated

(e)IftestimonyisreceivedintheSupremeCourtorCourtofAppealsnottakeninanothercourtandtransmittedthereto,the
prevailingpartyshallbeallowedthesamecostforwitnessfees,depositors,andprocessandservicethereofashewould
havebeenallowedforsuchitemshadthetestimonybeenintroducedinaCourtofFirstInstance

(f)Thelawfulfeesofacommissionerinanactionmayalsobetaxedagainstthedefeatedparty,orapportionedasjustice
requires.

Section12.Costswhenwitnessfailstoappear.Ifawitnessfailstoappearatthetimeandplacespecifiedinthesubpoenaissued
byanyinferiorcourt,thecostofthewarrantofarrestandofthearrestofthewitnessshallbepaidbythewitnessifthecourtshall
determinethathisfailuretoanswerthesubpoenawaswilfulorwithoutjustexcuse.

Section13.Costswhenthepersoncitedforexaminationinprob ateproceedings.Whenapersoniscited,onmotionofanother,to
appearbeforethecourttobeexaminedinprobateproceedings,thecourtmay,initsdiscretiontaxcostsforthepersonsocitedand
issueexecutiontherefor,allowingthesamefeesasforwitnessesinCourtsofFirstInstance.

RULE143

ApplicabilityoftheRules

Theserulesshallnotapplytolandregistration,cadastralandelectioncases,naturalizationandinsolvencyproceedings,andother
casesnothereinprovidedfor,exceptbyanalogyorinasuppletorycharacterandwheneverpracticableandconvenient.

RULE144

Effectiveness

These rukes shall take effect on January 1, 1964. They shall govern all cases brought after they take effect, and also all
furtherproceedingsincasesthenpending.excepttotheextentthatintheopinionofthecourttheirapplicationwouldnotbefeasible
orwouldworkinjustice,inwhicheventtheformerprocedureshallapply.
