On 09-16-14 I Officer Johnson 7450 was blocking off the Braker off ramp and
N IH 35 Svrd. I had been redirecting traffic back onto the proper due to an
accident that was blocking the road further down. I observed a 2003 Silver
Infinity 4D TXLP: DBL9505 drive past Officer Nguyen who was blocking off
the Yager and N IH 35 Svrd Sb. I stopped the driver, Titman, and asked why
he drove past Officer Nguyen. I observed slurred speech and Titman admitted
to having a drink earlier.

Titman said that he thought Officer Nguyen was only blocking off one of the
lanes. I asked Titman to step out of his vehicle and I attempted to check
for HGN but my emergency lights were activated. I did observe that while
checking HGN Titman swayed back about 2 inches. Titman's eyes were dilated
even with my light shining in his eyes. I gave Titman instruction to get
back into his vehicle and follow around the island and back onto the
highway. Titman responded by asking if he could travel over the island. his
speech was still slurred so I took a second look at his eyes. I went to
explain to him that his eyes were dilated but he blurted out that they were
dilated before I could say anything (0157:30). I asked him why his eyes
would be dilated and he said because he has his glasses off at night. After

I observed that Titman was wearing sandals. There was very little wind. I
moved my patrol unit to set up for test in a well lit area and there was a
line present.

Observation- Titman was told several times not to move his head. Titman
swayed back to front throughout. Titman had o be asked to continue to
follow the light and not look away.
Observation- Titman tried to use being bow legged as an excuse, even though
he had said he was only a little bow legged.
4. Romberg
Observation- Had to be showed how to tilt his head back. Did not follow
instructions on how to end the test.
At this time formed the opinion that due to the introduction of a substance
other than alcohol into Titman's system he had lost the normal use of his
mental and physical faculties. I then placed Titman under arrest for DWI.
A search incidental to arrest was conducted on his person. Nothing was

found on his person. I placed Titman in handcuffs and placed him in the
rear of my unit. Titman immediately asked for a blood test.
Southside was called for the vehicle who also took possession of the keys.
I played Titman the DIC 24 and asked him for a sample of his blood. Titman
agreed.
Officer Conner a DRE was called to the jail and performed her
investigation. Titman was booked for DWI, a class B misdemeanor.

DRE EVALUATION:
1. Location: The DRE exam of Trevor was conducted at The TCSO Jail in the
DWI room on 9/16/2014 at approximately 4:15am.
3. Breath Alcohol Test: Trevor consented to a PBT on scene and the result
were 0.00 BAC.

sick, and is not diabetic or epileptic. He advised me he was not currently
taking any medications and does not see a doctor or dentist on a regular
basis. He then advised me he was Bow legged and stated it hurt for him to
put his feet all the way together. Trevor stated his dad was also bow
legged and needed special shoes for it, I asked Trevor if he needed special
shoes or anything else for this issue and he said no.
Walk and Turn: Trevor lost balance during instruction and had to grab the
shelves in the dwi room to keep his balance. Trevor missed heel to toe
between steps 4 and 5 while taking 9 steps forward. He then turned using a
2 foot pivot and took 9 steps back using his arms on step 8.
One Leg Stand: While standing on his left leg, raising his right, Trevor
swayed, used arms for balance, and put his foot down on one thousand and
twenty eight, counting up to this number as well. While standing on his
right leg, raising his left, Trevor swayed, used arms for balance, and put
his foot down on one thousand and eleven, while counting up to one thousand
and twenty three.
Finger to nose: On attempt 1 Trevor touched the tip of his nose. On attempt
2 trevor missed the tip of his nose and touched just below his left
nostril. On attempts 3,4, and 5, Trevor touched the tip of his nose,
however on attempt 6 he touched the right side of his nose with the tip of
his finger. Throughout this test Trevor had very jerky movements.
Vital signs:
Trevor's pulse was extremely hard to find. The first pulse was above the
DRE average range at 108 bpm, his other two pulses were within the DRE
range at 74bpm, and 60bpm. His blood pressure was above the DRE average
range at 150/108 mmHg, and his temperature was within the DRE average range
at 99.3 degrees Fahrenheit. Trevor's muscle tone was rigid.
