On 09-16-14 I Officer Johnson 7450 was blocking off the Braker off ramp and
N IH 35 Svrd. I had been redirecting traffic back onto the proper due to an
accident that was blocking the road further down. I observed a 2003 Silver
Infinity 4D TXLP: DBL9505 drive past Officer Nguyen who was blocking off
the Yager and N IH 35 Svrd Sb. I stopped the driver, Titman, and asked why
he drove past Officer Nguyen. I observed slurred speech and Titman admitted
to having a drink earlier.

Titman said that he thought Officer Nguyen was only blocking off one of the
lanes. I asked Titman to step out of his vehicle and I attempted to check
for HGN but my emergency lights were activated. I did observe that while
checking HGN Titman swayed back about 2 inches. Titman's eyes were dilated
even with my light shining in his eyes. I gave Titman instruction to get
back into his vehicle and follow around the island and back onto the
highway. Titman responded by asking if he could travel over the island. his
speech was still slurred so I took a second look at his eyes. I went to
explain to him that his eyes were dilated but he blurted out that they were
dilated before I could say anything (0157:30). I asked him why his eyes
would be dilated and he said because he has his glasses off at night. After

that answer I was convinced that it would be necessary to continue with my

DWI investigation.
A Frisk for weapons was conducted on Titman because I would be in close

proximity to him during the DWI investigation. No weapons were found on his
person during the frisk.
I attempted to set my vehicle up to begin my investigation, but several

vehicles almost went through the road block. I had Titman wait and
initially was going to just have him do the PBT and release him due to not
having time to test. I was informed that the road would be cleared soon so
I decided to wait and complete my investigation.
I observed that Titman was wearing sandals. There was very little wind. I
moved my patrol unit to set up for test in a well lit area and there was a
line present.
I had Titman walk over towards my vehicle
These questions were asked in no particular order.

Observations- I asked Titman some of these questions prior to moving to the

parking lot for testing and his answers were more direct than when he
initially answered
I explained each test to Titman. Prior to Titman starting each test I

asked him if he understood the test. Each time prior to starting Titman
said he understood. The results are as follows:
I Officer Johnson 7450 am certified in Standardized Field Sobriety

Test(SFST) including Horizontal Gaze Nystagmus(HGN).
1. Horizontal Gaze Nystagmus ( HGN )

I observed that the driver had equal pupils and equal tracking.
I observed the following clues:

1- Lack of smooth pursuit both eyes

2- Distinct and sustained nystagmus at maximum deviation both eyes

3- Onset of nystagmus prior to 45 degrees both eye
I observed 6 clues out of a possible 6 clues.
Vertical gaze nystagmus was not observed.
Observation- Titman was told several times not to move his head. Titman
swayed back to front throughout. Titman had o be asked to continue to
follow the light and not look away.
2. Walk and Turn
I observed the following clues
1. Lost balance during the instructions

2. Failed to touch heel to toe
3. Used arms for Balance (airplane)
4. Stepped off line
5. Improper turn (pivot)
For a total of 5 clues out of possible 8 clues.
Observation- Titman tried to use being bow legged as an excuse, even though
he had said he was only a little bow legged.
3. One Leg Stand
I observed the following clues:
1. Swayed to the right/left.

2. Used arms for balance.
3. Put foot down.
For a total of 3 clues out of a possible 4 clues.
4. Romberg
1. Estimated 30 seconds as 18.6.

2. Demonstrated front to back sway approx 2"
Demonstrated side to side sway approx ____"

Observation- Had to be showed how to tilt his head back. Did not follow
instructions on how to end the test.
PBT Life LOC- @ 0230 BAC of 0.000
At this time formed the opinion that due to the introduction of a substance
other than alcohol into Titman's system he had lost the normal use of his
mental and physical faculties. I then placed Titman under arrest for DWI.
A search incidental to arrest was conducted on his person. Nothing was

found on his person. I placed Titman in handcuffs and placed him in the
rear of my unit. Titman immediately asked for a blood test.
Southside was called for the vehicle who also took possession of the keys.
I played Titman the DIC 24 and asked him for a sample of his blood. Titman
agreed.
I transported Titman to central booking without incident. At central

booking I gave Titman copies of the DIC 24. I did not confiscate Titman's
DL.
L. Moran obtained the blood specimen at 0338 in tubes D982.
Officer Conner a DRE was called to the jail and performed her
investigation. Titman was booked for DWI, a class B misdemeanor.
The blood was turned in as evidence at the ESUB.

On 9/16/2014 at approximately 3 am, I, Officer Conner #7055, The on call

DRE responded to the TCSO jail to assist officer Johnson #7450 in a DRE on
the following arrested subject:
Titman, Trevor W/M 1/17/1987
DRE EVALUATION:
1. Location: The DRE exam of Trevor was conducted at The TCSO Jail in the
DWI room on 9/16/2014 at approximately 4:15am.
2. Witnesses: I, Officer Conner #7055 conducted the dre, and Officer

Gilbert #5346 scribed.
3. Breath Alcohol Test: Trevor consented to a PBT on scene and the result
were 0.00 BAC.
4. Notification & Interview of Arresting Officer: On 9/16/2014 at

approximately 3:00 am, I, Officer Conner #7055, was contacted by Officer
Johnson who was in need of a DRE evaluation on a subject he had arrested
for DWI. Officer Johnson advised me he observed the subject drive around a
barricade once he made contact with the subject he observed signs of
impairment. He advised me he observed all 6 clues on HGN, observed 5 out of
8 clues on the walk and turn, and 3 out of 4 clues on the one leg stand. On
Romberg, Officer Johnson stated Trevor estimated the passage of 30 seconds
in 18 seconds. Officer Johnson also advised me he noticed Trevors eyes were
very dilated.
5. Initial Observations of the Suspect: I first observed Trevor he was very

talkative and relaxed. I also observed he had noticably Dilated pupils. He
had very rapid and slurred speech and kept rambling about all of the
construction going on around the city. He seemed to have a hard time
remembering wheather he was coming from IH 35 or Mopac when he went around
the barricades. Trevor advised he woke up at 1pm and had slept for
approximately 8 to 9 hours. Trevor advised me he had a Tuna steak on this
day around 8:30pm, and drank 1 bottle of wood chuck cider between 12am and
1:20am.
6. Medical Problems & Treatments: Trevor stated he was not injured or

sick, and is not diabetic or epileptic. He advised me he was not currently
taking any medications and does not see a doctor or dentist on a regular
basis. He then advised me he was Bow legged and stated it hurt for him to
put his feet all the way together. Trevor stated his dad was also bow
legged and needed special shoes for it, I asked Trevor if he needed special
shoes or anything else for this issue and he said no.
7. Psychophysical Indicators of impairment:

Modified Romberg Balance: Trevor displayed a 1-2 inch sway front to back
and estimated the passage of 30 seconds in a time span of 19 seconds.
Walk and Turn: Trevor lost balance during instruction and had to grab the
shelves in the dwi room to keep his balance. Trevor missed heel to toe
between steps 4 and 5 while taking 9 steps forward. He then turned using a
2 foot pivot and took 9 steps back using his arms on step 8.
One Leg Stand: While standing on his left leg, raising his right, Trevor
swayed, used arms for balance, and put his foot down on one thousand and
twenty eight, counting up to this number as well. While standing on his
right leg, raising his left, Trevor swayed, used arms for balance, and put
his foot down on one thousand and eleven, while counting up to one thousand
and twenty three.
Finger to nose: On attempt 1 Trevor touched the tip of his nose. On attempt
2 trevor missed the tip of his nose and touched just below his left
nostril. On attempts 3,4, and 5, Trevor touched the tip of his nose,
however on attempt 6 he touched the right side of his nose with the tip of
his finger. Throughout this test Trevor had very jerky movements.
8. Clinical Indicators of Impairment:

Eyes:
Trevor had reddening of the conjunctiva and had HGN present in both eyes on
lack of smooth pursuit, distinct and sustained nystagmus at maximum
deviation, with an initial angle of onset estimated at 45 degrees. Trevor
also display lack of convergence. Both of Trevor's eyes began to converge
but stopped shortly after starting moving only slightly towards his nose.
Trevor's pupil size were all above the DRE average range at 7.5 mm in room
light, 9.0 mm in near to total darkness, and 5.5 mm to 6.5 mm in Direct
Light with rebound dilation. Trevor's reaction to light was slow, and he
exhibited ptosis (droopy eyes). Trevor exhibited eye lid tremors during the
Romberg balance, and the Finger to nose test.
Vital signs:
Trevor's pulse was extremely hard to find. The first pulse was above the
DRE average range at 108 bpm, his other two pulses were within the DRE
range at 74bpm, and 60bpm. His blood pressure was above the DRE average
range at 150/108 mmHg, and his temperature was within the DRE average range
at 99.3 degrees Fahrenheit. Trevor's muscle tone was rigid.
9. Signs of Ingestion: Trevor had a green tint on his tounge, and "vapor

trails" on his face that were seen when observed under a black light.
10. Subject's Statements: Trevor denied using anything recently stating he

only had the 1 wood chuck cider. When I directly asked him the last time he
used cocaine he went into a story about visiting bogatah Colombia and how
he had coca leaf tea to help with the altitude. He then advised the last
time he used marijuana was about 5 years prior when he had a brownie.
Trevor went into another long story about having PDP in his vehicle but
wasn't very clear on this. Throughout the test Trevor made multiple
statements saying, the blood test is going to show "virtually" nothing.
11. DRE's Opinion: It is my opinion as a Drug recognition expert, that

Trevor was impaired under the influence of a CNS Depressant, a CNS
Stimulant, Marijuana, and therefore was unable to operate a vehicle safely.
12. Toxicological Sample: Trevor consented to a blood sample, results

pending.
