Sub: Finalization of vacancy in the Grade of DOS & STA as on 27.09.2015-reg.

(1) Please refer to F. No. RTICG/GEN-286/2016-17 dated Nil replied by CPIO RTI
Cell (Gen), Mumbai Zone-I. RTI Cell (G) mentioned that

The merger of DOS and STA was done as per cadre restructuring on
01.08.2014 i.e. the Executive Assistant come into force from 01.08.2014. The
Sanctioned Strength of Executive Assistant allotted was 323 at that time.

(2) CBEC vide letter issued by Shri Rajpal Singh, Under Secretary to the GOI on
approval of Member (P&V) dated 17.09.2015 mentioned about filling of post of
Executive Assistant as given below:

Pt. (B) Filling up of the post of Executive Assistant

The post of Executive Assistant will come into existence only with effect from
the date of publication of the Recruitment Rules for the post. RRs of this post have
not yet been finalized. Hence, the erstwhile posts of Deputy Office Superintendent
(DOS) and Senior Tax Assistant (STA) continue to exist and the existing RRs for
these two posts will continue to be operative until or unless they are repealed.

(3) In another letter F.No.A.32011/03/2015-Ad.III.A issued by Shri Rajpal Singh,

Under Secy. to the GOI on approval of Chairman (CBEC) dated 02.08.2016
mentioned that the existing RRs for the relevant vacancy year will be applicable for
holding DPCs i. e. pre-cadre vacancies will be filled by old RRs only.
1. It is clear that the all vacant posts up-to 27.09.2015 of DOS and STA have to
be filled through old RRs.

2. For calculation of the Pre-Cadre vacancies (prior to publication of new RR of

Executive Assistant) the P&E Department have to conduct DPC for the post of DOS
and STA.

3. The Sanctioned Strength of DOS is 122 and Sanctioned Strength of STA is

223 in this department. Merger of both cadres on 01.08.2014 had resulted loss of 22
vacancies (122+223=345-323=22) which was available for promotion before
01.08.2014.

4. The department had conducted DPC of Executive Assistant on 13.05.2015

which is not final as department had mentioned the promotion order as Regular but
Provisional.

The following points are against the DPC of Executive Assistant.

No Seniority List issued in the grade of Executive Assistant

Executive Assistant post was come into force from 28.09.2015
Recruitment Rule of STA was applied for promotion.

5. The merger of DOS & STA should be done from the date of publication of new
RR of Executive Assistant i.e. 28.09.2015.

You are requested to take necessary action on above mentioned five points
immediately & oblige me.
