Legal
Trespass Law - Trespass is defined by the act of knowingly entering another person's
property without permission. Such action is held to infringe upon a property owner's
legal right to enjoy the benefits of ownership.
Application: This applies to my magazine cover because I must either take the images
in a public place or have permission for a private location. The only issue with my
photoshoot is for cover 3 at Ramp 1 where I must pay to enter.
Intellectual Property - These are the rights given to people over the ideas of their
minds. This will give the creator a right over the use for their idea for a certain period
of time.
Application: This applies to my magazine covers because all of the content will be my
ideas.
Copyright - The current act is the Copyright, Designs and Patents Act 1988. The law
gives the creators of literary, dramatic, musical, artistic works, sound recordings,
broadcasts, films and typographical arrangement of published editions, rights to
control the ways in which their material may be used.
Application: For example, all the images and text used in the magazine will be my
own and not from any foreign sources. Copyright infringement can lead to serious
penalties, payment of damages and even halt the distribution of the magazine and its
future issues.
Obscenity - Obscenity is a legal term that applies to anything offensive to morals and
is often equated with the term pornography. Pornography, however, is a more limited
term, which refers to the erotic content of books, magazines, films, and recordings.
Obscenity includes pornography and Nudity.
Application: This applies to my magazine because I must not use content which will be
deemed obscene, e.g. I will not include any nudity.
Ethical
Libel This refers to the language and text used on the cover, this must not offend the
audience.
Gender The ethical issue refrains people from being sexist and defaming against a
gender. This applies to the magazine covers because they must not offend anyone by
using libellous comments against their genre.
Race This applies to my magazine covers because I must not offend anyone by
defaming or discriminating against anyones race.
Disability This applies to the magazine covers because including defaming
comments about peoples ability/ disability may offend the audience.
Sexuality Using libellous comments about peoples sexuality may offend the
audience, so I will refrain from this.
