Trustee Is Entrusted With High Amount of Duties
Are these
duties mentioned under Trust Act 1882 is justifiable?
Chapter 3 of the Trust Act, 1882, deals with the duties and liabilities of the trustees. A
trustee is vested with huge amount of duties and liabilities by the law and also from the
trust instrument. Upon acceptance as a trustee of a trust property, he himself comes
under the Trust Act and all his actions are binding by the law. Now, some important and
focused duties are given below which is compulsory for the trustee to perform:
There are several more duties of trustees mentioned in the Trust Act, 1882. Apart from
the Act if there is any special duty or any other duty mentioned in the trust document
trustee will also be entitled to be bound to follow those duties unless the beneficiarys
wish is otherwise who is competent to contract.
Trustees are entrusted with high amount of duties by the Trust Act, 1882. These duties
can be justified as a monitory and as a protection of the beneficiarys interest. Because
of these duties trustee actions can be separated that which is within jurisdiction and
which is without jurisdiction.
Due to these mentioned duties and liabilities in the Act we can determine what would be
the role of a trustee:
To act in good faith;
Not to place himself in a position where his duty and his interest may conflict;
Not to act for his own benefit or the benefit of a third person unless properly
authorised to do so;
