*THE JUDGE GOES TO THE BENCH AND TAKES A SEAT*

Judge: - OPENS A FOLDER - Expedited Procedure, Oral Judgment No. 15 bar


2003. We open session to case 5310: Homicide of Eva Smith at the hands of
the Birling family LOOKING AT PAPERS - Lawyers proceed to give their plea,
begin lawyer Thomson in defense of the deceased Eva Smith. You may have
a seat.

Lawyer E .: *STANDS UP * Your honor, I come to defend the deceased Eva


Smith, who I state was influenced by the Birling family and Mr. Gerald Croft
to commit suicide. Of course this statement is supported by evidence: a
dismissal letter given to her by Mr. Arthur Birling, a second dismissal caused
by Miss Sheila Birling, the autopsy of the deceased which shows the alleged
pregnancy between her and Eric Birling and the form in which my client had
asked to be helped by the charity organized by Mrs. Sybil Birling, which was
unjustifiably rejected.

Judge: Take a seat lawyer. Attorney come forward in defense of the Birling
family.

Lawyer B .: *STANDS UP* Ladies and gentlemen of the jury I would like to tell
you which is the foundation of my defense for this family, because although
the case is a homicide, no one forced the deceased Eva Smith to cause her
own death. All this is simply a series of unfortunate events. The family had
no knowledge that the acts could somehow be connected with the same
person, which is justified because Miss Smith always presented herself with
different names, which prevented my clients to know if she was the same
person.

Jugde: Arthur Birling, to the stand please.


*MR BIRLING GOES TO THE STAND*
E Lawyer (Eva Smith): Did you know Eva Smith?
Mr. Birling: *DOUBTING* Smith? Yes, it rings a bell
E Lawyer: Are you aware that she worked at your Factory?
Mr. Birling: Im not sure, I have lots of employees and I dont remember all of
them very well.
E Lawyer: In fact, she was your employee and you fired her. Do you
remember that? If so, why did you do that?
Mr. Birling: I dont remember her specific case, I probably fired her because
we were cutting down costs.
E Lawyer: Are you sure you didnt fire her because she went on strike
against you claiming for a higher salary?
Mr. Birling: Apart from that, she wasnt a good employee and when we had
to do the budget cuts I didnt doubt to fire her.
E Lawyer: So, you DID know her?
Mr. Birling: No, no I mean, yes, but
E Lawyer: No further questions.
Jugde: Thank you. Sybil Birling to the stand, please. *MRS. BIRLING GGOES
TO THE STAND*
E Lawyer: Would you mind explaining the process your charity follows to
provide help or accept people?
Mrs. Birling: First, we tell the person who comes to our charity to fill a payroll
with all of the personal information necessary. Then, all the members of the
charity discuss about the case, we check their background, family, if they
have someone they can ask for help or if they are alone, etc. If everything is
ok, we accept the person in our charity.
E Lawyer: So why didnt you accept Eva Smith?
Mrs. Birling: She came saying that the money the father of the child had
given her was stolen, so she couldnt accept that. I agree with that, but that
means the father of the child was present and actually could find legal
money to help her and the child. We didnt help her because we thought she
could find it somewhere else.
E Lawyer: Are you sure it wasnt because she called herself Eva Birling?
Mrs. Birling: No no, I couldnt refuse to help someone only for their
surname
E Lawyer: And were you aware that she was pregnant with your grandchild?
*MURMURS OF SURPRISE*
Mrs. Birling: I refuse to answer that.
E Lawyer: No further questions.

Judge: Thank you. Well, lets move to the following. Has anyone got any
witness?
Eva Smiths lawyer: Yes, I have one.
Judge: And who is it?
Lawyer: Claire, Eva Smiths closest friend
Judge: Alright, lets go ahead.
*CLAIRE GOES TO THE STAND FOLLOWED BY A POLICEMAN WHO CARRIES A
COPY OF THE AMERICAN CONSTITUTION*
Policeman: Do you swear and promise to tell the truth, the whole truth and
nothing but the truth?

C: Yes, I do.

E Lawyer: Hello Claire, so you were one of Evas best friends, werent you?
Claire: Yes, you are right. I had known her since high school.
E Lawyer: Was Eva a sad girl? Had she ever told you something about
committing suicide?
Claire: No, she wasnt a sad girl, until all the problems related to the Birling
started to happen. I think that getting pregnant and not having any help
were the 2 things that ended up destroying her.
E Lawyer: Do you think that if she had received help she would be with us
today?
Claire: Yes, I absolutely do.
E Lawyer: Thats all, your honor.
Judge: Thank you
*CLAIRE GOES BACK TO HER SEAT*
B Lawyer: I would like to call a witness in defense of the Birling family.
Judge: Who is it?
B Lawyer: Mr. Alex Parker, a charity partner from Sybil Birlings said charity.
Judge: Mr Alex Parker to the stand, please.
*ALEX WALKS TO THE STAND FOLLOWED BY A POLICEMAN WHO CARRIES
THE AMERICAN CONSTITUTION*
Policeman: Do you swear and promise to tell the truth, the whole truth and
nothing but the truth?

AP: Yes, I do.

B Lawyer: So, Alex, what is your relation to the Birling family?


AP: Im a charity partner to Sybil Birling. And I come to talk about how the
Birling family are innocent.
B Lawyer: How do you intend to do that?
AP: By presenting all these letters which are testimonies of how Sybil
Birlings charity helped them in hard times and are now living better thanks
to her. These letters come with their respective form of information.
B laywer: Anything else?
AP: Yes, I want to state that due to the great reputation of the Birling family,
they couldnt be capable of doing such things theyre accused of.
E lawyer: *STANDS UP* Objection! Thats a presumption!
Judge: Objection accepted. Anything else the witness would like to say?
B Lawyer: Thats all your honor.
Judge: Mr you may leave.
*ALEX GOES BACK TO HIS SEAT*
Lawyer E .: I call to the stand Miss Sheila Birling.

Judge: -SURPRISED - for what purpose?

Lawyer E .: To give testimony to the fact that happened in the


INTERRUPTED BY MR. BIRLING -

Mr. Birling: *STANDS UP* Objection! *HES FORCED TO SIT BACK DOWN*
Judge: Overuled HITTING HIS HAMMER AGAINST THE STAND - Proceed

*SHEILA WALKS TO THE STAND FOLLOWED BY A POLICEMAN*

Lawyer E .: Is it true that you dismissed Miss Eva Smith for alleged haughty
attitude?

Sheila: Yes, when I tried a dress that was not favorable to my figure, she
tried on the same dress, almost showing me how good she was at it, I
thought it was very vain.

Lawyer E .: And dont you think that was a bit exaggerated? All women have
different bodies which is not a reason to ask for the dismissal of Miss Smith.
Did the deceased make any malicious comment to you? It seems you just
couldnt accept that a dress didnt suit you! Your attitude can be compared
to a little girls one SHEILA BEGINS TO CRY - Don't you think it would have
been more mature to prove something else and just let it go?

Sheila: Yeah! - wiping her tears - and I regret very much, I did not mean to
be so immature and less take her to kill herself, but she looked very happy
with her miserable life and relationship with my brother *COVERS HER
MOUTH*

*MURMURS OF SURPRISE*

Judge: Silence in the room HITTING HIS HAMMER -

Lawyer E .: So you were aware of that relationship? In that case why didnt
you say anything?

B Lawyer: Attorney Objection! Dont you think my client has already had too
much?

Judge: Overuled, continue lawyer.

Sheila: Sorry Dad! CRIES LOUDER - I cannot keep lying DEEPS BREATH,
WIPES HER TEARS- Yes, I was aware of that relationship. One night I saw
through my window as they entered our house, and went to my brother's
room *KEEPS CRYING*

Lawyer E .: That's all your honor *LAWYER TAKES A SEAT*

Judge: Miss you may retire

Birling Mr.: We will talk about this Sheila!

Sheila: I'm sorry *TO ERIC* Eric i'm so sorry.

Eric: - TRIES TO LEAVE THE ROOM, IS FORCED TO SIT BACK DOWN BY


POLICEMAN
Judge: Silence! *HITS HIS HAMMER AND STANDS UP* The final verdict is that
each and every member of the Birling family as well as Mr. Gerald Croft are
GUILTY. They will be held in prison for 5 years for the induced suicide of miss
Eva Smith and will have to pay a penalty of $40.000. The debate is closed.
