ThisconceptisoneofthemostimportantpartsoftheAmericanRepublic.UndertheAmerican
system,thereisalegislature,andexecutivebranch,andSupremeCourt.Eachbranchofgovernment
keepstheotherinchecktoensurethatnoonebranchbecomesmorepowerfulthananother.Withthe
eventsofrecentmonths,IRS,Dept.ofJustice,anddroneprogramscandals,theissueofthepowerof
branchesofgovernmenthasbecomeacentralissueathand,whetheritisspecicallystatedornot.

ThepoweroftheExecutiveBranchwasseverelycriticizedaftertheexposureoftheObama
administrationsdroneprogramtosystematicallykillAmericancitizenssuspectedofterrorism.The
IRShasallegedlyabuseditspowerasataxagencytointimidateConservativegroups,andpossibly
evenswayelectionresults.TheA orneyGeneralsocehasbeencaughtspyingonreporters,
threateningfreedomofthepress.Needlesstosay,theseparationofpowersbetweenbrancheshas
becomeverysliminthepastfewyears.

ThetermseparationofpowersoriginatestoBarondeMontesquieu,aFrenchEnlightenment
philosopher.HeusedthemodelsofancientRomeandtheBritishConstitutionalsystemtotheorize
theidealdistributionofgovernmentalpowersbetweenexecutive,legislativeandjudicialbranches.
Thepurposeofthisistoensurethatnoonepartyorbeliefcanhavemorecontroloverthe
governmentthananother.Historyshowsthatwhenonegroupwiththesameideologyisinpower,
tyrannyandmassslaughtersoonfollow.

Theseparationofpowerscreatesuniquerolesforeachbranchofgovernment.Herearesomeofthe

departmentattheapprovaloftheSenate.Thejudicialbranchdetermineswhichlawsapplyto

Thesearesupposedtobetherolesofeachbranch,butwhatdotherolesofeachbranchhavetodo
withourfreedom?Yes,theConstitutionisthelawoftheland.However,itonlycontinuestobesoif
electedocialschoosetoupholdratherthantearitdown.TheConstitutionprovidesamethodfor
change,astheFounderscreateditthisway,shouldsuchanincidencerequireitsmodication.

However,letssaythatthelegislativebranchhadthepowertocreateanylawitsodesired.Any
legislationcouldbepassed,andtherewouldnotbeawaytoopposeit.However,therearetwo
safeguards;iftheexecutivebranchdisagreedwiththelaw,itcouldbevetoed;or,ifalawsuitwas
broughtagainstthislaw,thejudicialbranchcoulddecideifthelawwasConstitutionalornot.Bothof
thetwootherbranchesensurethatthelegislativebranchcannotpassunconstitutionalorunethical
legislation.Anotherexampleofpreventingmaliciousordisagreedlegislation/appointeesisthe
libuster.InMarch,2013,SenatorRandPaullibusteredthevoteforCIAheadnomineeJohn
Brennan.ThiswasduetoSenatorsPaulsconcernoverBrennansinvolvementwiththeObama
administrationscontroversialdroneprogram.

Anotherexampleisiftheexecutivebranchappointedpeopletobejudgesanddepartmentheads,but
eitherthesepeoplewerenotqualied,orhadarecordofcorruption,theSenatecouldrejectthese
appointmentstoensuretheintegrityofthesystem.Anotherexampleofpreventingmaliciousor
disagreedlegislation/appointeesisthelibuster.InMarch,2013,SenatorRandPaullibusteredthe
voteforCIAheadnomineeJohnBrennan.ThiswasduetoSenatorsPaulsconcernoverBrennans
involvementwiththeObamaadministrationscontroversialdroneprogram.Thislibusterwasan
exampleofhowthelegislativebranchkeepstheexecutivebranchincheck.

Thissystemseemsawless,buttheproblemwiththissystem,asanysystemofgovernment,is
humannature.Historyshowsusthatwhenopportunityforpowershowsitselftoapersonorgroup,
itisseldomthatanyresist.Anexampleofhowthebalanceofpowerbecameendangeredwasinthe
20082010yearsofPresidentObamasrstterm.BothhousesofCongresswerecontrolledbythe
DemocraticParty,aswastheexecutivebranch.Whathappened,asweallknow,wasthe
controversialPatientProtectionandAordableCareActwascreatedandpassed,withli le
considerationfortheharmfuleectsthebillwouldcreate.

Therewasstilltheoptionofthejudicialbranchsayingthelawwasunconstitutional,but,ashuman
natureisnotconstant,atraditionallyConservativejudge,ChiefJusticeJohnRobertsvotedinfavorof
thebill,surprisingmany.Thepassingofthislawshowsthatevenourhighlysophisticatedseparation
ofpowers,andchecksandbalancesisnotperfect.Recently,theveryinammatoryIRSscandalbrings
upthequestionofiftheexecutivebranchusedtheIRStointimidatetheoppositepartyinthe2012
election.Iftheinvestigationprovesthatthe2012electionresultswereaectedbytheIRSscandal,a
majorinvasionofseparationofpowerswouldhavetakenplace.

Nowthatyouhavesomeperspectiveonhowthissystemissupposedtowork,doyouwonderwhy
theAmericanwayoflifehasbeensogreatsinceitsfounding?Upuntilrecentyears,electedocials
tooktheoathtoupholdanddefendtheConstitution,andtheydid;lawsthatwerepassedwere,
generally,forthebestinterestofthepeople.However,intodaysgovernment,aswealthhas
increasedinWashington,moreandmorepeoplearesimplyinterestinpowerandmoneyratherthan
Constitutionalservice.

AsAmericans,weneedtothoroughlyinvestigatethecandidateswevotefor.Dontjustvotefor
AsAmericans,weneedtothoroughlyinvestigatethecandidateswevotefor.Dontjustvotefor
someonebecausetheyareaRepublicanorDemocrat;voteforthembasedontheirservicerecord,
wantsanddesires,andideologicalaliation.Especiallywhichideologyoneadherestoisvery
important;onesideseekstoradiallytransformoursocietyintotheEuropeanmodel,theotherwants
tokeeptheAmericanwayoflifeandgovernment.

Rememberthatwhiletherearethreeocialbranches,thereisafourth,whichisthemostimportant.
Thatfourthbranchisyou,thecitizensoftheUnitedStates.Youhaveadutytovoteforthosewho
willupholdourSupremeLaw.WhenhistorylooksbackattheBabyBoomerandMillennial
generations,willtheyseethesetwoastheepitomeofAmerica,ortheoneswholostit?Thechoiceis
uptoyou.
