GUIDELINES

CONTRACTLABOURMANAGEMENT



A. PRECOMMENCEMENTFORMAITIES

Everycontractorshouldsubmitfollowingdocumentsbeforecommencementofhiswork.

i. CopyofWorkOrder/LOI/LOC
ii. CopyofPFCodeallotmentletter
iii. WCInsurancePolicy(UnnamedORGroupAccidentPolicy).
iv. IndemnityBondonNonJudicialStampPaperofRs.100dulynotarizedDraftenclosed.
v. UndertakingfornotengagingInterstateMigrantlabourDraftenclosed.
vi. Undertakingforengaginglessthen20workersDraftenclosed.
vii. Legal document showing the incorporation / formation of the Company i.e. Copy of
Registration Certificate under Companies Act, Articles of Association / ByLaws or
PartnershipDeed.

Any changes taken place in the particulars of the above documents shall be informed
immediatelytousalongwithdocumentalproofforthesame.

B. POSTCOMMENCEMENTFORMALITIES

1.ContractLabour(R&A)Act,1970

LabourLicense:Ifintendtodeployworkmen20ormore.

FormalitiestoobtainLabourLicense.

a. Contractor will submit copy of the application in Form IV along with copy of the two
Demand Drafts obtained from Union Bank of India, in favour of The Assistant Labour
Commissioner(Central)payableatServiceBranchoftherespectivearea.

i. DDtowardsSecurityDepositamountingtoRs.90/perworkman.
ii. DDtowardsLicenseFeeasunder:

04 201to400 Rs.300/
05 401andabove Rs.375/

On receipt of the DDs and above documents Form V to obtain Labour License under
ContractLabour(R&A)Act,1970willbeissued.

b. ForobtainedLabourLicensecontractorshallapproachto;

TheAssistantLabourCommissioner(c)andLicensingOfficer,
GovernmentofIndia,MinistryofLabour,

WhoiscompetentauthorityundertheCL(R&A)ActtograntLabourLicensealongwith
thefollowingdocuments;

i. ApplicationinformIV(Copyenclosed)intriplicate.
ii. FormVissuedbythePrincipalEmployer(asmentionedaboveat(b).
iii. CopyofWorkOrder/LOC/LOI.
iv. TwoDDsasmentionedaboveat(a)i.andii.
v. IncorporationCertificateoftheCompany,ifregisteredorPartnershipDeedetc.
anydocumentstoprovelegalityofthecompany.

c. OnreceiptoftheLabourLicense,Contractorshallsubmitcopyofthesamewithinweek
timetotheHRDepartment.

d. Contractorshallsendintimation(Notice)aboutCommencement/CompletionofWork
inFormVIAtothecompetentauthorityunderintimationtotheHRDepartment.

e. Contractor shall display required notices and abstract of the Act / Rules on the Notice
BoardinEnglishandthelanguageknownbythemajorityoftheworkmenandshallsend
copyofthesametotheAuthorityunderintimationtotheHRDepartment.

f. Contractorshallmaintainallrecords/registersprescribedundertheAct.

1. RegisterofworkmenemployedbytheContractor XIII
2. ServiceCertificate XV
3. MusterRoll XVI
4. RegisterofWages
5. Wageslip XIX
6. Registerofdeductionfordamage&loss XX
7. RegisterofFines XXI
8. RegisterofAdvances XXII
9. RegisterofOvertime XXIII
10. AttendanceCard/EmploymentCard XIV

g. Contractor should get registers / records verified from HR Department before
disbursementofpaymentandshallarrangetodisbursepaymenttotheirworkmenonor
before7thoftheeverymonthinpresenceofourrepresentative.

h. Contractorshallarrangeforunpaidwagesimmediatelyunderourintimation.

i. Contractorshallattendinspectionconductedbytheauthoritiestoverifytherecordsand
shall send immediate compliance report to the Authorities for the irregularities pointed
outbytheinspectingAuthorityafterverificationfromtheHRDepartment.

j. Contractor shall send Half Yearly Returns to the Authorities in Form XXIV for the Half
Yearendingason30thJuneand31stDecemberinJulyandJanuaryrespectively.

k. ContractorshouldprovideallamenitiestotheirworkmenprescribedundertheActsuch
asdrinkingwater,urinals,firstaidbox,latrines,washingplaceetc.asmentionedintheCL
(R&A)Act.

2.EmployeesProvidentFund&Misc.ProvisionsAct,1952

EveryContractorshallcomplywiththeallprovisionslaiddowninthesaidActandwillsubmit
followingdocumentstoHRDepartment.


EveryMonth:

i. SeparatePFChallanforprecedingmonth Before15thofeverymonth
ii. MonthlyReturndulystampedbytheRPFC Before20thofeverymonth
ii. Listoftheworkmenalongwiththeircontribution Before15thofeverymonth
iv. AnnualReturn Onceinayear
v. PFslipandmonthwisedeductiondetails Onceinayear

Asandwhenrequired:

i. Everycontractorshallgetrequiredformsfilledusfromtheworkmanatthetimeofjoining
andleavingtheorganization.
ii. Contractor shall provide all help to transfer orwithdraw the amount standing in credit of
theworkmenaspertheprovisionspaiddownundertheAct.
iii. Every contractor should mention Pf number on the payment slip to be distributed to the
individualworkman.
iv. Every contractor should send required annual returns to the competent Authority and
intimationtotheHRDepartment.

3.WorkmencompensationAct,1923:

EverycontractorshallobtainunnamedWCInsurancePolicyinfavourofrespectivecompany
coveringalltheworkmendeployedatsiteandshallrenewitintime.Thecopyofthesame
shallsubmittotheHRDepartment.
Contractor should inform immediately to the HR Department in case of any accident and
shallactaspertheinstructionsgivenfromtimetotime.
Contractorshouldprovideallpossiblehelpincludingfinancialhelptotheirworkmenincase
ofanyaccidentarisingoutofandinthecourseofemploymentasperinstructionoftheHR
Department.
Contractorshoulddepositcompensationinfavouroftheeligibleworkman/legalheirswith
competentAuthority i.e. WCCommissionercumLabour Court Judge, within 30days from
thedateofaccidentincaseofFATALACCIDENTandincaseofNONFATALACCIDENT,atthe
earliestfromthedateofreceiptofDISEABILITYCERTIFICATEfromtheCIVILSURGEON.

4.MinimumWagesAct,1948:

ContractorshouldpaywageswhichisnotlessthanMinimumRatesofwagesfixedbythe
Central/StateGovt.(whicheverishigher).
ContractortodisplayNoticesrequiredundertheActandCentralRules.
ContractorshallsendAnnualReturnstotheAuthoritiesinFormIIIforYearendingason
31stDecemberinJanuary.

5.PaymentofWagesAct,1936:

Contractorshallarrangedistributionofwagepaymentaspertheprovisionlaiddownunder
theActi.e.byonorbefore7thofeverymonthwithpresenceofrepresentativeofPrincipal
employer(RIL).
Contractorshallmakeonlyauthorizeddeduction(s)fromthewagesoftheworkmenasper
theprovisionlaiddownunderthesaidact.
Contractor shall display required notices and abstract of the rules at prominent place in
locallanguageorthelanguageknownbythemajorityoftheworkmen.
Contractor should immediately resolve dispute(s) relating to wage payment before it gets
aggravatedandsubmitreportthereoftoHR(IR)Department.

6.LabourWelfareFundAct

Contractor shall send Return and deposit in LABOUR WELFARE FUND to the competent
Authority.

Heretheeffortshavebeenmadetocoverfewimportantenactmentsonly.Therearealsoother
enactmentswhichareapplicabletoyouwouldbeexplainedinperson.Moreover,thestatutory
compliance under different Labour Laws will also be intimated to you from HR Department as
andwhenrequired.

ToavoidIRProblemsincludingworkstoppageatworksite/LabourCamp(s)precautionstobe
takenandDisciplinetobeobserved.

Otherlabourrelatedrequirementshallbeinformed/explainedatContractsigningstage.
LABORLAWS:

1.1. TheContractorshallcomplywiththeprovisionsofalllaborlegislationsoftheState/Central
Governmentoranycompetentauthorityasapplicableinrespectofallmenemployedbyhim
in executing the contract. The Contractor shall indemnify the Owner against all actions,
proceedings,claims,demands,costsandexpenseswhatsoeverarisingoutofanyfailureon
the part of the Contractor to comply with all or any other Acts and regulations of
State/Central Government. The owner shall have no liability whatsoever concerning the
employeesoftheContractor.Followingareimportantenactments.
