COMPLAINT-AFFIDAVIT
COMES NOW, the Complainant thru himself, respectfully alleges:
I, BERNARDO A. BALBERAN, Filipino, of legal age and a resident of C/O:
EMILY E. BERAYA, Phase 3, Lot 127, Tonsuya, Malabon City, where he may be
served with summons and processes of this Honorable OFFICE OF THE CITY
PROSECUTOR, after being sworn to in accordance with law, depose and state:
(1) That the respondents GERLIE COPENGCO and ALONA HIDLAO, are all
LRT employees, all of legal ages, Filipinos, who may be served with notices and other
processes at: LRT Central Terminal Station, Ermita, Manila, Metro Manila, whereat
they may be served with summons and other legal processes of this Honorable OFFICE
OF THE CITY PROSECUTOR;
2) On April 8, 2017, at around 8:30 P.M. while walking and when inside at the
LRT EDSA STATION, I bought LRT ticket from respondent GERLIE COPENGCO.

(3) I gave my money to respondent GERLIE COPENGCO amounting to FIVE

HUNDRED (Php 500.00) PESOS. Complainant said to respondent TAYUMAN lang
ako bababa.
(4) Complainant waited for the change of his money. But to my surprise,
respondent only gave EIGHTY (Php 80.00) PESOS to complainant. So that on that
moment, I reacted and said: BAKIT EIGHTY (Php 80.00) PESOS LANG ANG
ISINUKLI MO SA AKIN, EH FIVE HUNDRED (Php 500.00) PESOS ANG PERA
KO NA IBINIGAY KO SAYO. MANDARAYA KA! But respondent got mad doesnt
want to give my change. Rather she got angry at me. Until I told to respondent:
TIGILAN NYO NA MGA MODUS NYO RITO. ARAW ARAW AKO
SUMASAKAY NG LRT.

(5) Instead to give my change to me, what the respondent (GERLIE

COPENGCO) did is she called respondent Security Guard ALONA HIDLAO, talking
in a loud voice: ;;GUARD HALIKA NGA RITO, ARESTUHIN MO NGA ITO PAKI
POSASAN MO. GAGO ITO. PASAHERO LANG NANGANGATWIRAN PA. So
that I said to both of them: BAKIT? MY WARRANT OF ARREST BA KAYO NA

BASTA BASTA NALANG KAYO MANG-AARESTO, HA? WALA YATA AKONG

NABASA SA BATAS NA ANG EMPLEYADO NG LRT AT MGA SEKYU AY
BATAS. MASKI ANG PRESIDENTE NG PILIPINAS AY HINDI BATAS. WE
ARE A GOVERNMENT OF LAWS, NOT OF MEN.

(6) Respondents GERLIE COPENGCO and ALONA HIDLAO DONNA

BULAONG continued shouting, harassing to complainant in a loud voice. Complainant
was embarrassed on that moment. They treated me like an animal. I was ridiculed,
embarrassed by so many people. ALONA HIDLAO continued talking, shouting to
complainant: TATAWAG AKO NG PULIS IPAARESTO KITA, GAGO KA???!!!
PARA MAKITA MO NA BATAS KAMI DITO! KILALANG KILALA KANA SA
CENTRAL STATION HA, NA MASAMANG TAO KA.

(7) So that, I immediately answered to her: BAKIT? DAHIL BA SA AKO

LANG ANG MARUNONG MAGREKLAMO LABAN SA MGA
PANGHUHULIDAP NYO RITO SA LRT SA MGA PASAHERO HA? But,
respondent ALONA HIDLAO continued shouting, harassing to complainant saying:
MAY CCTV CAMERA DITO HINDI KA MAKAKAPALAG. IPAPAARESTO
KITA SA PULIS. GAGO KA! PASAHERO KALANG DITO, KAMI DITO ANG
MASUSUNOD. WALA KANG MAGAGAWA ANUMAN ANG GUSTUHIN KO.
(8) Complainant reacted and said: HA? MAGDEDEMANDA AKO SA
INYO, KASI MGA AROGANTE KAYO. KINAKAMPIHAN NYO PA ANG MGA
TIWALING MGA TELLER DITO.
(9) On that moment I was looking for their head guard, but no to avail.
Respondent ALONA HIDLAO DONNA continues shouting to complainant in a loud
voice: GAGO KA, HINDI KANA MAKAKAAPAK DITO SA LRT. She is mad at
complainant. I was embarrassed, I have felt harassed and belittled by the wrong act done
to me by respondents, and have suffered stress, sleepless nights and shame to the people
and verbal abuse on the occurrence.
(10) Respondent ALONA HIDLAO DONNA continues talking, shouting,
harassing to complainant, saying repetitiously: IPAPAARESTO KITA SA PULIS,
GAGO KA. Because of irritating and threatening words utterd by the respondent.
I told to her: ANG PULIS AY HINDI IYAN BATAS. ANG PULIS AY TRABAHO
IYAN NG MGA TAMAD AT BOBO. MASKI BOBO KA HENERAL KANA.
HUWAG MO AKO TATAKUTIN SA MGA PULIS. KASI MARAMI NA AKO
IDENIMANDANG MGA KRIMINAL NA MGA PULIS.
(11) I right away lodge the incident to the admin office, LRT CENTRAL
STATION.

This is not the only incident occurred/happened to compalainant prior to the

above incident. Recounting from my previous experience of the arrogant security
guard in the LRT station:
12) Kapag nangatwiran ka sa panggigipit, sa pagbibintang nila ay ang
complainant pa ang masama. Kaya to prevent this kind of abuses, ay nagsampa na ako ng
kaso laban sa mga aroganteng respondents. Para hindi na makapambiktima pa ang mga
respondents na ito. Ang ugali ng mga guwardiya ay mananakot at magbibintang sa mga
inosenteng mga passengers sa LRT Station, at manggipit sa mga matitinong mga tao na
bibiktimahin nila. Kapag nangatwiran ka ay tatakutin ka at magbibintang na kung anu-
ano. At gagawan kana nila ng estorya para pagkaperahan ang kanilang mga binibiktima.
Ganiyan mga arogante ang mga guards at mga employees sa LRT Station. Halos araw-
araw ay sumasakay ako ng LRT, at inuobserbahan ko mga kilos ng mga guwardiya, na
ma no-notice mo ay mga arogante. Hindi lang ako isang basis na nabiktima ng mga
guwardiya. Last February 15, 2016 along Buedia LRT Station at gusto ako saktan sa
harapan ng maraming tao, their names were: SG REY PAMILARA and SG RENZ

MARIO MANALO. Pinagsisigawan din ako. Kasi nag-reak ako, kasi pilit nila
ipinapasok sa bulsa ko mga kamay nila, na may nakaipit na droga sa kamay nila.
Usung-uso ang pagtatanim ng mga guwardiya sa LRT Station ng droga at pagbibintangan
ang kanilang biktima, at kapag natakot ka, diyan kana nila peperahan ng mga tiwaling
guwardiya. Nag-react ako, kasi may Fifteen Thousand (Php 15,000.00) akong dala sa bag
ko. Natakot ako, baka kunin ng mga guwardiya ang pera kong dala. Nagalit sila at
pinagsisigawan din ako at pinagmumura at pinagduduro ako at aakmang sasaktan ako,
kaya tumakbo na ako. (Mantakin mo, ang mga modus ng mga guard sa LRT Station ay
magbintang sa mga taong nag-iisa, na walang kasama. Kung hindi ako nangatwiran sa
kanila, baka nakulong ako sa kasalanan hindi ko ginawa). Nagulat ako sa mga pangit na
asal ng mga guwardiya. Kaya tumawag agad ako ng pulis. Akala niya siguro ang lahat na
mga binibiktima nila ay hindi magsusumbong sa pulis. Tinatakot nila, at kapag natakot ka
sa modus nila na ikukulong ka, diyan kana peperahan ng mga tiwaling guwardiya. (Hindi
na ito bago na modus ng mga guwardiya. Kahit saan ka magpunta, kapag malinis
ang hitsura mo, ay suspects ka agad nila).
12) Also in LRT Station, way back June 2007 mga around 5:30 pm din ay
ganitong modus din ang nangyari sa akin. Ininspek ako ng mga guard sa LRT Central
Station, papauwi na ako noon, galing akong SM Manila, tapos ng wala silang makita sa
bag ko, kasi hindi na naman ako masamang tao, at hindi ako drug addict, ay
pinagbintangan ako na may bomba ako at may droga. Na ganun din ang style or modus
nila na manakot at magbintang sa mga pasahero. Nagulat talaga ako sa mga pagbibintang
sa akin ng mga guard sa LRT Central Station. Naghakot sila ng kasabwat nilang mga
pulis at pinalibutan ako ng armadong mga pulis sa LRT station. Natakot ako at walang
magawa. Dahil sa wala naman akong kasalanan hindi ko inamin ang droga at bomba na
ibinibintang nila sa akin. Hanggang sa pinakawalan ako ng mga tiwaling guwardiya sa
LRT Central Station. At mabuti nalang may isang pulis na medyo may puso at mabait na
lumapit sa akin after na pakawalan nila ako, sabi sa akin, alam mo ba sir, kung hindi ka
lumaban at nangatwiran sa mga iyan, pang pito (7) ka sa mga biktima nila sa araw na ito.
Alam mo ba mga estudyante na mga mag-siyota ang kanilang binibiktima, at nag-iisa.
Para kapag nagreklamo ka, sasabihin sayo, bakit may witnesses ka ba, ha? Kasi alam nila
na matatakot sa kanila, kasi may mga baril sila. Hinuhulidap nila mga pasahero sa LRT
Station. That is why, I said to the policeman, thank you sa information.
13) At hindi lang yan, way back August 2011 ay pinagbintangan din ako ng mga
lady guard sa may LRT Blumintritt din na may dala akong bomba at droga, tinakot ako,
hindi ako umamin na akin ang droga, kasi wala naman talaga akong bomba at droga,
alam mo ba ang nangyari, pinagsisigawan ako ng head guard nila na ang pangalan niya
ay MR. HENERO, tinakot ako at pinasulat sa log book nila na may dala akong bomba at
droga. Hinawakan kuwelyo ng damit ko at pinagduduro sa harapan ng mga tao
pinagmumura at pinagsisigawan. Sa takot ko, kasi pinagsisigawan ako, at tinatakot na
ikukulong kapag hindi ko aminin na may droga ako at bomba. Magbigay daw ako ng pera
para hindi nila ako ikulong at dadalhin sa pulis. Hindi nila ako ikinulong, kasi sabi ko
wala akong pera. Kaya ang ginawa nila sa akin, ay pinilit nila ako na isulat sa logbook
nila na aminin ko na akin ang droga at bomba. Kaya sa takot ko, kasi pinalibutan ako ng
armadong mga guwardiya at pulis ay isinulat ko sa logbook nila, pinilit nila ako at
pinaamin na akin ang droga at bomba. Kaya ayon pinakawalan nila ako after na maisulat
ko na akin ang droga at bomba at pinapirmahan sa akin sa logbook. (MODUS
OPERANDI NA YATA NG MGA GUARDS SA LRT AT MRT NA MAGBINTANG
AT MANAKOT SA MGA PASAHERO NA KANILANG BINIBIKTIMA). KAPAG
NATAKOT KA SA MGA MODUS NILA, TIYAK BIKTIMA KA AT
PAGKAKAPERAHAN KA NILA. HINDI NA ITO BAGO SA LRT AT MRT).
14) At hindi lang iyan, on September 2014 ay tinakot din ako sa may LRT
Tayuman ng dalawang guard, the same modus nila, na paaminin sayo na may dala kang
illegal drugs at kung anu-ano pang pagbibintang ang ginagawa nila. At hindi lang yan ha,
nakakatawa nga, ng sabihin ko na ako ang pumatay kay DR. JOSE RIZAL, alam mo ba,
inaresto ako at pinusasan ng guwardya na sabi ba naman ikaw pala ang pumatay kay

RIZAL, kaya arestado ka. Kaya inereport ko sa Central Station at pinatawag ng

Administration Office yung guard at pinagalitan.

(15) way back also, January 2013, same modus ng mga teller, inabot ko sa teller
ang ONE (Php 1,000.00). Mantakin mo ang kulang ang isinukli sa akin. Sabi ko bakit
kolang skli mo ng NINE HUNDRED something pa sapat sukli ko. Sabi ba naman sa
akin, bakit hindi mo sinabi sa akin na isang libo pala pera mo. Kaya sabi ko kapag hindi
mo ibigay sukli ko tatawag ako ng pulis at idedemanda kita ng estafa. Ayon natakot, kaya
ibinigay sa akin ang sukli ko. Kung hindi ako nangatwiran sa modus ng mga teller, tiyak
tangay pera ko.

(16) As the Supreme Court would put it, whether a government employee or a
security who are detailed within the premises of a government public utility, are
indispensably in close contact with riding public, their conduct should be geared towards
maintaining the prestige and integrity of the office, for the image of the government
offices is necessarily mirrored in the conduct, official or otherwise, of the men and
women who work thereat, from their separate to the least and lowest of its personnel;
hence, it become imperative sacred duty of each and everyone in their offices to maintain
good name and standing as a temple. Respondents behavior erodes the faith and
confidence of the riding public in the delivery of public services.
(17) Kaya kung magpapatuloy ang ganitong modus ng mga guwardiya at
walang magrereklamo laban sa kanila, tinitiyak ko marami pa silang mabibiktima na mga
inosenteng mga pasahero. Ang purpose ng mga guard ay manakot sa mga pasahero ng
LRT na maaari nila pagkaperahan. May mga kasabwat silang mga pulis. Ang modus ng
mga guwardiya at ang mga pulis ay tatakutin at tutukan ng baril ang pasahero ng
huwag kang kikilos kung hindi maeeskandalo ka. (iyan ang ginagamit nilang
wordings kapag nambibiktima sila. Kaya kapag natakot ka sa kanila, tiyak biktima
ka) Pera o maeskandalo ka? Iyan ang modus nila. Iyan ang panakot nila sa kanilang
binibiktima. Syempre sa takot mo at ayaw maeskandalo ay magbibigay ka sa kanila ng
pera. Talamak sa LRT at MRT Station ang mga ganitong MODUS ng mga guwardiya
na kung saan ang kasabwat nila ay mga pulis.
(18) Therefore, by reason of the GRAVE THREATS/LIGHT THREATS;
UNJUST VEXATION; SLANDER BY DEEDS/ORAL DEFAMATION perpetrated
by respondents, herein complainants damaged and prejudiced suffered sleepless nights,
mental anguish and anxiety, for which he is entitled to moral damages. Complainant is
reserving his right to file civil case against the respondents, and their agency as a juridical
entity.
(19) Clearly, complainant is entitled to the relief demanded; that the commission
or continuance of the acts of the respondents will result to positive and irreparable
damage and prejudice to herein complainant. I have felt harassed and belittled by the
wrong act done to me by respondents, and have suffered stress, sleepless nights and
shame to the people and verbal abuse on the occurrence.
(20) Kaya kung itotoleret ang masamang gawain ng mga masasamang tao sa ating
lipunan, sila ang mga salot sa LRT na bumibiktima sa mga inosenteng mga pasahero,
gaya ng respondents na ito, tiyak marami pa silang mabibiktima.
(21) I am accusing the respondents for the offenses as charged.
(22) Complainant further sayeth none.

WHEREFORE, premises considered, it is most respectfully prayed of this

Honorable OFFICE OF THE PROSECUTOR that respondent be guilty of the crime as
charged and that judgment be rendered in favor of the complainant and against the
respondents; other reliefs are also prayed for.
