Iloilo City Regulation Ordinance 2009-216

ABSENT:
WHEREAS, the latest ordinances regulating parking were enacted last 1978 and 1983,
respectively;
WHEREAS, since then, the traffic scenario in terms of vehicular volume, road network,
and distribution of business areas, has totally changed, requiring new legislative approaches.
ARTICLE I
DEFINITION OF TERMS
Parking - an act wherein a driver brings a vehicle to a stop, remains inactive in that
place or close thereto for an appreciable period of time. A vehicle which stops merely to
discharge passenger or take in a waiting passenger, or loads or unloads small quantity of freight
with reasonable dispatch shall not be considered as "parked'', if the vehicle again moves away
without delay.

On-road Parking - an act wherein a driver brings a vehicle to a stop, remains in that
place or close thereto for an appreciable period of time at the proper shoulder or edge of a
roadway or street remains inactive in that place for a period of time.
Double Parking - as used in this ordinance shall mean the act of improperly stopping or
parking near the shoulder or edge or beside a properly parked motor vehicle to load or unload
passengers or cargoes causing obstruction to pedestrians or vehicles.
Parallel Parking - parking where the longitudinal axis of the vehicle is parallel with the
line of the curb of the roadway or street.
Diagonal Parking - as used in this ordinance shall mean parking where the longitudinal
axis of the vehicle is approximately 45 degrees with the line of the street or roadway curb or less.
Perpendicular Parking - as used in this ordinance shall mean parking where the
longitudinal axis of the vehicle is approximately more than 45 degrees with the line of the street
or roadway curb.
Set-back for Parking - area intended for parking purposes in front of buildings or
establishments which is outside the "road right of way".
"Road-right of way" - technically under the National Building Code means "roadway
plus sidewalk on both sides (open or arcaded) of the roadway".
the distance between the property or building line in one side of the street or roadway
to the property or building line of the opposite side.

D: For Barangay roads, local barangay councils shall be authorized to identify by way
of a barangay legislation parking and no parking areas provided no parking fee or penalties
shall be extracted. In any event of non-compliance, the respective Barangay Captains may
refer matters to the TMEUfor proper disposition.
ARTILCEIII
GENERAL PROVISIONS
Section 2. - In streets where on-road parking is allowed, parking within fifteen (15)
meters of any road junction or intersection; parking to obstruct passageways and driveways,
parking to obstruct fire hydrants shall be prohibited.
Section 3. - In areas where there is a set-back for parking, "over-hanging" of any part of
the vehicle beyond the curb and encroaching on the roadway shall be prohibited.
Section 4. - Parking along curbs/shoulders painted RED and/or along zones with "no
parking" signages shall be prohibited.
Section 5. - Placing of "reserve" signs along zones where parking is allowed, shall be
prohibited, except along Mabini Street fronting Robinson's Mall which serves as a temporary
City Hall; and the space fronting the Sangguniang Panlungsod as provided for under Regulation
Ordinance No. 2003-191.
ARTICLE IV
PENALTY
Section 1. - Any person or driver of a vehicle who violates any provision of Article III of
this Ordinance shall be subject to a fine of three hundred pesos (P300.00). In case of insolvency
the violator shall be subjected to an imprisonment of three (3) days.

REPEALING CLAUSE
All other ordinances, executive orders, resolutions, regulations, or part thereof, in conflict
with the provision of this Ordinance are hereby repealed and revised.

EFFECTIVITY
This ordinance shall take effect upon approval and after publication in a newspaper of
general circulation in the City and Province of Iloilo.
