ANACTMANDATINGALLMOTORCYCLERIDERSTOWEARSTANDARD
PROTECTIVEMOTORCYCLEHELMETSWHILEDRIVINGANDPROVIDING
PENALTIESTHEREFOR
BeitenactedbytheSenateandHouseofRepresentativesofthePhilippinesinCongress
assembled:
Section1.ShortTitle.ThisActshallbeknownasthe"MotorcycleHelmetActof2009".
Section2.DeclarationofPolicy.ItisherebydeclaredthepolicyoftheStatetosecureand
safeguarditscitizenry,particularlytheoperatorsordriversofmotorcyclesandtheir
passengers,fromtheruinousandextremelyinjuriouseffectsoffatalorlifethreatening
accidentsandcrashes.Towardsthisend,itshallpursueamoreproactiveandpreventive
approachtosecurethesafetyofmotorists,theirpassengersandpedestriansatalltimes
throughthemandatoryenforcementoftheuseofstandardprotectivemotorcyclehelmet.
Section3.MandatoryUseofMotorcycleHelmets.Allmotorcycleriders,includingdrivers
andbackriders,shallatalltimeswearstandardprotectivemotorcyclehelmetswhiledriving,
whetherlongorshortdrives,inanytypeofroadandhighway.
Standardprotectivemotorcyclehelmetsareappropriatetypesofhelmetsformotorcycle
ridersthatcomplywiththespecificationsissuedbytheDepartmentofTradeandIndustry
(DTI).
TheDTIshallissueguidelines,whichshouldincludethespecificationsregardingstandard
protectivemotorcyclehelmets.
Section4.Exemption.Driversoftricyclesshallbeexemptedfromcomplyingwiththe
mandatorywearingofmotorcyclehelmetsasprovidedinthisAct.
Section5.ProvisionofMotorcycleHelmets.Anewmotorcyclehelmetwhichbearsthe
PhilippineStandard(PS)markorImportCommodityClearance(ICC)oftheBureauof
ProductStandards(BPS)andcomplieswiththestandardssetbytheBPSshallbemade
availablebyeverysellerand/ordealereverytimeanewmotorcycleunitispurchasedand
whichthepurchasermaybuyatbisoption.Failuretocomplywiththerequirementsprovided
underthissectionshallconstituteaviolationofthisAct.
Section6.Implementation.TheDepartmentofTransportationandCommunications
(DOTC),withitsattachedagency,theLandTransportationOffice(LTO),ismandatedbythis
ActtoissueguidelinesnecessarytoimplementtheprovisionsofthisAct.
TheDTI,throughtheBPS,ismandatedtoutilizetheUnitedNationsEconomicCommission
forEurope(UNECE)Protocolswithregardtothestandardsthatwillbeapplicabletothe
approvalordisapprovalofmotorcyclehelmetsthatwillbesoldinthePhilippines.
TheDTI,throughtheBPS,shallconductamandatorytestingofallmanufacturedand
importedmotorcyclehelmetsinthePhilippines.Allmanufacturersandimportersofstandard
protectivemotorcyclehelmetsarerequiredtosecureaPSlicenseorICCpriortothesaleand
distributionoftheirproducts.TheBPSshallissueperiodicallyalistofmotorcyclehelmet
manufacturersandimportersandthebrandswhichpassthestandardsoftheBPStobe
publishedinanewspaperofgeneralcirculationorinitswebsite.
UpontheeffectivityofthisAct,onlythosestandardprotectivemotorcyclehelmetsbearing
thePSorICCmarkshallbesoldinthemarket.
Section7.Penalties.(a)Anypersoncaughtnotwearingthestandardprotectivemotorcycle
helmetinviolationofthisActshallbepunishedwithafineofOnethousandfivehundred
pesos(Php1,500.00)forthefirstoffense;Threethousandpesos(Php3,000.00)forthesecond
offense;Fivethousandpesos(Php5,000.00)forthethirdoffense;andTenthousandpesos
(Php10,000.00)plusconfiscationofthedriver'slicenseforthefourthandsucceeding
offenses.
(b)Anysellerand/ordealerwhoviolatesSection5ofthisActshallbepunishedwithafine
ofnotleesthanTenthousandpesos(Php10,000.00)butnotmorethanTwentythousand
pesos(Php20,000.00).
(c)Anypersonwhouses,sellsanddistributessubstandardmotorcyclehelmetsorthosewhich
donotbearthePSmarkortheICCcertificateshallbepunishedwithafineofnotlessthan
Threethousandpesos(Php3,000.00)forthefirstoffense;andFivethousandpesos
(Php5,000.00)forthesecondoffense,withoutprejudicetootherpenaltiesimposedin
RepublicActNo.7394orthe"ConsumerActofthePhilippines".
(d)Tampering,alteration,forgeryandimitationofthePSmarkandtheICCcertificatesinthe
helmetsshallbepunishedwithafineofnotlessthanTenthousandpesos(Php10,000.00)but
notmorethanTwentythousandpesos(Php20,000.00),withoutprejudicetootherpenalties
imposedinRepublicActNo.7394orthe"ConsumerActofthePhilippines".
Section8.NationwidePublicInformationCampaign.TheLTO,incoordinationwiththe
PhilippineInformationAgency(PIA),theDepartmentofEducation(DepED)andprivate
agenciesandorganizations,shallundertakeanationwideinformation,educationand
communication(IEC)campaignforaperiodofsix(6)monthsfortheattainmentofthe
objectivesofthisAct.
Section9.SeparabilityClause.Ifanyprovisionorparthereofisheldinvalidor
unconstitutional,theremainderofthisActortheprovisionsnototherwiseaffectedshall
remainvalidandsubsisting.
Section10.RepealingClause.Alllaws,decrees,orders,rulesandregulationsorparts
thereofinconsistentwiththisActareherebyrepealedormodifiedaccordingly.
Section11.EffectivityClause.ThisActshalltakeeffectfifteen(15)daysafterits
publicationinatleasttwo(2)newspapersofgeneralcirculation.
