SOLVE THE FOLLOWING PROBLEMS:

1. Mrs. Sophie while entering into Hotel Reagent left her velvet overcoat with a
diamond brooch in the coat stand at the entrance. After the dinner, she left the hotel
hurriedly as it was very late. In the hurry, she didnt notice that her diamond brooch
has fallen down. But one Mr. Nicolas, a staff of the Hotel found the brooch and
handed it over to the Manager. The Manager just left the pin in the cash locker near
the entrance. But, unfortunately, a burglary happened on that night. And Mrs. Sophie
came to the Hotel the very next day searching for her diamond brooch. Can Mrs.
Sophie claim any remedy against the Hotel Reagent under contractual law?

2. Mr. Clarke was acting as surety for Mr. Sullivan who had a bank loan of $85,000 in
Barclays Bank. The guarantee contract provided that the Bank can at any time
without obtaining the consent of the surety change the interest rate such that it
doesnt affect the liability of the Surety. In pursuance of the same, the bank changes
the interest rate from 10% to 12% p.a. Mr. Clarke comes to know about the same and
sues in the court for breach of contract of suretyship. Is his claim valid?

3. There are 3 sureties in a debt contract-Alpha, Beta and Gama. Alpha and beta each
undertake a surety for one-third of debts and Gama promises to undertake the half of
the debt. The Principal debtor makes a default of Rs. 50,000. Apply the rule of
contribution to divide the shares of debts by the sureties.

4. Mr. Subbu, the Director of the Welcare Hospital contacted one Mr. Jiby, owner
of Maria Commodities Ltd for the monthly supply of Hospital Essentials, who also
provide the delivery services. He ordered for 100 cans of spirits to be delivered within
5 days. Since the delivery of spirits need to done early, Mr. Jiby couldn't wait for glass
bottles which are ordinarily used for the storage. Therefore, he had to transport the
spirits using the available plastic containers. But unfortunately, there was a sudden
mass protests by certain political party with regard to the arrest of their party leader
due to which the truck was made to stop in the side of the highway for one whole day
in the sun. Finally upon the delivery of the spirits, it was found that the spirits were
less than the required quantity. Thus, Mr. Subbu refused to pay for the transportation
services and also reduced quantity of goods. Mr. Jiby files a case in the court seeking
the repayment for his delivery services as well as for the full payment. Decide the
case.

5. Jamuna and Jagan are Wife and Husband. Jagan left to France for one of his business
conferences. While in the conference, he comes to know that the business deal to
transact the computer parts needs a signature of his to finish the whole transaction. So,
he calls his wife, Jamuna and asks her to put the signature for him and finish of the
transaction. Does this imply that Jamuna was acting as a agent of Jagan?

6. Thaybhaji Industries had a contract with the Green Farms for the delivery of the
sugarcanes for their factory every Thursday of month. As per their agreement,
Thaybhaji Industries had the give the required quantity and quality of the sugarcanes.
The Green Farms needs to accordingly deliver the sugarcanes at their factory. As
usual, on Thursday when, Green Farms delivered the sugarcanes, the commodities
were rejected. Now, Green Farms sues the Thaybhaji Industries for the compensation
claiming themselves as agents of Thaybhaji Industries . Is the suit sustainable?

7. Mrs. Tina Samuel is a housewife who does her daily grocery shopping from a shop
called Ranganathan & Sons. Once she went to purchase sunflower oil from the shop.
But her usual brand was not available. So, the shopkeeper suggested her to buy the
new branded sunflower oil, Pure Sun Oil. But after coming home she found that
there were no details about the ingredients or the content of the product. Also, there
was no detail as to the manufacturing date and expiry date of the oil. She was shocked
very much and approached her advocate. As her advocate, explain to her the duties of
a seller in this contract of sale and remedy for the fault of the sellers duty.

8. Das & Sons is a successful 5 member partnership firm out of which 1 partner is a
minor. The firm owned a two-storey building in Palakkad for one of their branch
office. Mr. Akhil was the partner who was managing the Palakkad branch. Mr. Akhil
had some personal debts. In order to clear this personal debt, he sold the two -storey
building to Mr. Tijo. When this matter came to the knowledge of all other partners,
they filed a case against Mr. Akhil. Explain what failure of duty Mr. Akhil performs
using the Partnership Act,1932.
