Chapter5PUBLICPROTECTION
ABATEMENTOFCHRONICDISORDERLYPROPERTY
5.704Procedure.
(1)Whenthechiefofpolicereceivestwoormorepolicereportsdocumentingtheoccurrenceofprohibited
activityonorwithin200feetofapropertyinaresidentialneighborhoodwithinthecity,thechiefofpoliceshall
independentlyreviewthereportstodeterminewhethertheydescribeprohibitedactivitiesenumeratedinthiscodeunder
section5.700.Uponsuchafindingthechiefofpolicemay:
(a)Notifythepersoninchargeinwritingthatthepropertyisindangerofbecomingchronic
disorderlyproperty.Thenoticeshallcontainthefollowinginformation:
(i)Thestreetaddressorlegaldescriptionsufficientforidentificationoftheproperty.
(ii)Astatementthatthechiefofpolicehasinformationthatthepropertymaybechronic
disorderlyproperty,withaconcisedescriptionoftheprohibitedactivitiesthatmayexist,orthathaveoccurred.The
chiefofpoliceshallofferthepersoninchargeanopportunitytoproposeacourseofactionthatthechiefofpolice
agreeswillabatetheprohibitedactivitiesgivingrisetotheviolation.
(iii)Demandthatthepersoninchargerespondtothechiefofpolicewithin10daysto
discusstheprohibitedactivities.
(2)Afternotificationofnuisanceactivitiestothepersonincharge,whenthechiefofpolicereceivesa
policereportdocumentingtheoccurrenceofathirdprohibitedactivityatorwithin200feetofapropertyinaresidential
neighborhoodwithina60dayperiodanddeterminesthatthepropertyhasbecomechronicdisorderlyproperty,thechief
ofpoliceshall:
(a)Notifythepersoninchargeinwritingthatthepropertyisachronicdisorderlyproperty.The
noticeshallcontainthefollowinginformation:
(i)Thestreetaddressorlegaldescriptionsufficientforidentificationoftheproperty.
(ii)Astatementthatthechiefofpolicehasdeterminedthepropertytobechronicdisorderly
propertywithaconcisedescriptionoftheprohibitedactivitiesleadingtothefindings.
(iii)Demandthatthepersoninchargerespondwithin14daystothechiefofpoliceand
proposeacourseofactionthatthechiefofpoliceagreeswillabatetheprohibitedactivitiesgivingrisetotheviolation.
(iv)Serviceshallbemadeeitherpersonallyorbyfirstclassmail,postageprepaid,return
receiptrequested,addressedtothepersoninchargeattheaddressofthepropertybelievedtobeachronicdisorderly
property,oranyotherplacewhichislikelytogivethepersoninchargenoticeofthedeterminationbythechiefof
police.
(v)Acopyofthenoticeshallbeservedontheownerattheaddressshownonthetaxrolls
ofthecountyinwhichthepropertyislocated,theoccupant,attheaddressoftheproperty,ifthesepersonsaredifferent
fromthepersonincharge,andshallbemadeeitherpersonallyorbyfirstclassmail,postageprepaid.
(vi)Acopyofthenoticeshallalsobepostedattheproperty.
(vii)Thefailureofanypersontoreceivenoticethatthepropertymaybeachronicdisorderly
propertyshallnotinvalidateorotherwiseaffecttheproceedingsundersections5.700to5.714.
(b)Chronicdisorderlyproperty,asdefinedbysection5.700,shallbesubjectonlytothenotification
requirementsofsubsection(2)ofthissection.
(c)If,afterthenotification,butpriortothecommencementoflegalproceedingsbythecity
pursuanttosections5.700to5.714,apersoninchargestipulatestothechiefofpolicethatthepersoninchargewill
pursueacourseofactionthepartiesagreewillabatetheprohibitedactivitiesgivingrisetotheviolation,thechiefof
policemayagreetopostponelegalproceedingsforaperiodofnotlessthan10normorethan30days.Iftheagreed
courseofactiondoesnotresultintheabatementoftheprohibitedactivityorifnoagreementconcerningabatementis

reachedwith30days,thechiefofpolicemayreferthemattertothecityattorneytocommencealegalproceedingto
abatethenuisance.
(d)Concurrentwiththenotificationproceduressetforthinsubsections(1)and(2),thechiefof
policeshallsendcopiesofthenotice,aswellasanyotherdocumentationwhichsupportslegalproceedingsagainstthe
property,tothecityattorney.(3)Whenapersoninchargemakesaresponsetothechiefofpoliceasrequired
bysubsection(2)(c)above,anyconductorstatementsmadeinconnectionwiththefurnishingofthatresponseshallnot
constituteanadmissionthatanyprohibitedactivitieshaveorareoccurring.Thissubsectiondoesnotrequirethe
exclusionofanyevidencethatisotherwiseadmissibleorofferedforanyotherpurpose.[Section5.704amendedby
