MOTION FOR PRIORTY RELIEF


I, James W. Himes Sr. , respectfully, and anxiously request
that the Court enter an order referring this case to the Honorable Judge Spoto for further
relief. Pursuant to Sec. 61.508, Fla. Stat.,

1. Respondent, Kathryn Himes


and the State of F.D.o.R. filed a fraudulent peternity petition on 8-9-1995. The
final judgement order was for H.R.S. to issue a new Birth Certificate for my son
James Jr., whom is not the biological child of K.H.
2. This case was
modified on 5-2-2005 Based on a copy of my sons Birth Cirtifi- cate which
states MAREVA D. CALE is the biological mother. In fact my
case was seen by a Hearing Officer who only granted relief from 12-10-1999
instead of the geneses of this order. I presented evidence that proved
undisputed, that Kathryn did not have physical custody of James Jr. at no point,
even pre- order .
3. I
have already presented substantial evidence to challenge the physical custody of
Mitchell and Christopher between 8-3- 1995. to 12-10-1999. Kathryn Himes
did not have physical custody of these two children either. Kathryn was in state
custody from the previously mentioned dates. That was also undisputed in
my childrens custody order, which I wasnt even invited too.

4. I, James W. Himes further, beg this Court for PRIORITY RELIEF in


a dismissal of this case and all moneys paid in this case be allocated to new
payee as of 12-10-1999 in 95-0001758-FD

5. I beg this Court to return D.L. No. H520-459-68-302-0 until


further order of of the Court. The Officer deemed my case a Title IV-D Seec.651
