&breakfast),(theme)parks,attractions,museums,sightseeingtours,cruises,rail
andcoachtours,transfers,touroperators,insurances,andanyothertravelor
relatedproductorserviceasfromtimetotimeavailableforreservationonthe
Platform.

1.ScopeofourService
ThroughthePlatform,we(Booking.comB.V.anditsaffiliate(distribution)partners)
provideanonlineplatformthroughwhichSupplierscanadvertisetheirproducts
andserviceforreservation,andthroughwhichvisitorsofthePlatformcanmake
suchreservations(i.e.thereservationservice).Bymakingareservationthrough
Booking.com,youenterintoadirect(legallybinding)contractualrelationshipwith
theSupplierwithwhichyoumakeareservationorpurchaseaproductorservice
(asapplicable).Fromthepointatwhichyoumakeyourreservation,weactsolely
asanintermediarybetweenyouandtheSupplier,transmittingthedetailsofyour
reservationtotherelevantSupplier(s)andsendingyouaconfirmationemailfor
andonbehalfoftheSupplier.

WhenrenderingourService,theinformationthatwediscloseisbasedonthe
informationprovidedtousbySuppliers.Assuch,theSuppliersaregivenaccessto
anextranetthroughwhichtheyarefullyresponsibleforupdatingallrates,
availabilityandotherinformationwhichisdisplayedonourPlatform.Althoughwe
willusereasonableskillandcareinperformingourService,wewillnotverifyif,
andcannotguaranteethat,allinformationisaccurate,completeorcorrect,norcan
webeheldresponsibleforanyerrors(includingmanifestandtypographicalerrors),
anyinterruptions(whetherduetoany(temporaryand/orpartial)breakdown,repair,
upgradeormaintenanceofourPlatformorotherwise),inaccurate,misleadingor
untrueinformationornondeliveryofinformation.EachSupplierremains
responsibleatalltimesfortheaccuracy,completenessandcorrectnessofthe
(descriptive)information(includingtheratesandavailability)displayedonour
Platform.OurPlatformdoesnotconstituteandshouldnotberegardedasa
recommendationorendorsementofthequality,servicelevel,qualificationor(star)
ratingofanySupplier(oritsfacilities,venue,productsorservices)madeavailable.

OurServiceismadeavailableforpersonalandnoncommercialuseonly.
Therefore,youarenotallowedtoresell,deeplink,use,copy,monitor(e.g.spider,
scrape),display,downloadorreproduceanycontentorinformation,software,
reservations,tickets,productsorservicesavailableonourPlatformforany
commercialorcompetitiveactivityorpurpose.

2.Prices,crossedoutratesandBestPriceGuarantee
ThepricesonourPlatformarehighlycompetitive.Allroompricesareperroomfor
yourentirestayandallpricesaredisplayedincludingVAT/salestaxandallother
taxes(subjecttochangeofsuchtaxes),unlessstateddifferentlyonourPlatformor
theconfirmationemail/ticket.Ticketpricesareperpersonorgroupandsubjectto
validityasindicatedontheticket,ifapplicable.Applicablefeesandtaxes(including
tourist/citytax)maybechargedbytheSupplierintheeventofanoshowor
cancellationfee.Applicabletaxesmaybechargedbytheaccommodationinthe
eventofanoshoworcancellationfee.

SometimescheaperratesareavailableonourPlatformforaspecificstay,product
orservice,however,theseratesmadeavailablebySuppliersmaycarryspecial
restrictionsandconditions,forexamplenoncancelableandnonrefundable.
Pleasechecktherelevantproduct,serviceandreservationconditionsanddetails
thoroughlyforanysuchconditionspriortomakingyourreservation.

Thecrossedoutrateshownforroomsisbasedonthethirdhighestcurrentpriceof
theSupplierforyourproductorservicewiththesamebookingconditionsina30
daywindowaroundyourcheckindate(15daysbeforeand15daysaftercheckin
dateiflessthan15daysarebetweentodayandthecheckindate,wewillusethe
correspondingnumberofdaysafterthecheckindatetoresultina30daytotal).
Toensurewearemakingafaircomparison,wealwaysusethesamereservation
conditions(e.g.mealplan,cancellationpolicyandroomtype).Thismeansthatyou
getthesameroomforalowerpricecomparedtoothercheckindatesatthesame
timeofyear.

Wewantyoutopaythelowestpricepossibleforyourproductandserviceof
choice.Shouldyoufindyourproductorserviceofchoicebookedthroughthe
Platform,withthesamereservationconditions,atalowerrateontheInternetafter
youhavemadeareservationthroughus,wewillmatchthedifferencebetweenour
rateandthelowerrateunderthetermsandconditionsoftheBestPrice
Guarantee.

Thecurrencyconverterisforinformationpurposesonlyandshouldnotberelied
uponasaccurateandrealtimeactualratesmayvary.

Obviouserrorsandmistakes(includingmisprints)arenotbinding.

Allspecialoffersandpromotionsaremarkedassuch.

3.Privacyandcookies
Booking.comrespectsyourprivacy.Pleasehavealookatourprivacyand

4.Freeofcharge
Ourserviceisfreeofchargebecause,unlikemanyotherparties,wewillnot
chargeyouforourServiceoraddanyadditional(reservation)feestotherate.
Supplierspayacommission(beingasmallpercentageoftheproductprice(e.g.
roomprice))toBooking.comaftertheenduserhasconsumatedtheserviceor
productoftheSupplieroraftertheguesthasstayedat(andpaid)the
accommodation.

5.Creditcardorbanktransfer
Ifapplicableandavailable,certainSuppliersoffertheopportunityforreservations
tobepaid(whollyorpartlyandasrequiredunderthepaymentpolicyofthe
accommodation)totheSupplierduringthereservationprocessbymeansof
secureonlinepayment(alltotheextentofferedandsupportedbyyourbank).For
certainproductsandservices,Booking.comfacilitates(throughthirdpartypayment
processors)thepaymentoftherelevantproductorservice(i.e.thepayment
facilitationservice)forandonbehalfoftheSupplier(Booking.comneveractsnor
operatesasthemerchantofrecord).Paymentissafelyprocessedfromyour
credit/debitcardorbankaccounttothebankaccountoftheaccommodation
providerthroughathirdpartypaymentprocessor.Anypaymentfacilitatedbyusfor
andonbehalfof,andtransferredtotheSupplierwillineachcaseconstitutea
paymentof(partof)thebookingpricebyyouoftherelevantproductorservicein
finalsettlement(bevrijdendebetaling)ofsuch(partial)dueandpayablepriceand
youcannotreclaimsuchpaidmonies.

Forcertain(nonrefundable)ratesorspecialoffers,pleasenotethatSuppliersmay
requirethatpaymentismadeupfrontbywiretransfer(ifavailable)orbycredit
card,andthereforeyourcreditcardmaybepreauthorisedorcharged(sometimes
withoutanyoptionforrefund)uponmakingthereservation.Pleasecheckthe
(reservation)detailsofyourproductorserviceofchoicethoroughlyforanysuch
conditionspriortomakingyourreservation.YouwillnotholdBooking.comliableor
responsibleforany(authorized,(allegedly)unauthorizedorwrong)chargebythe
Supplierandnot(re)claimanyamountforanyvalidorauthorizedchargebythe
Supplier(includingforprepaidrates,noshowandchargeablecancellation)of
yourcreditcard.

Intheeventofcreditcardfraudorunauthoriseduseofyourcreditcardbythird
parties,mostbanksandcreditcardcompaniesbeartheriskandcoverallthe
chargesresultingfromsuchfraudormisuse,whichmaysometimesbesubjecttoa
deductible(usuallysetatEUR50(ortheequivalentinyourlocalcurrency)).Inthe
eventthatyourcreditcardcompanyorbankchargesthedeductiblefromyou
becauseofunauthorisedtransactionsresultingfromareservationmadeonour
Platform,wewillpayyouthisdeductible,uptoanaggregateamountofEUR50(or
theequivalentinyourlocalcurrency).Inordertoindemnifyyou,pleasemakesure
thatyoureportthisfraudtoyourcreditcardprovider(inaccordancewithits
reportingrulesandprocedures)andcontactusimmediatelybyemail
(customer.relations@booking.com).Pleasestate'creditcardfraud'inthesubject
lineofyouremailandprovideuswithevidenceofthechargeddeductible(e.g.
policyofthecreditcardcompany).Thisindemnificationonlyappliestocreditcard
reservationsmadeusingBooking.com'ssecureserverandtheunauthoriseduseof
yourcreditcardresultedthroughourdefaultornegligenceandthroughnofaultof
yourownwhileusingthesecureserver.

6.Prepayment,cancellation,noshowandfineprint
BymakingareservationwithaSupplier,youacceptandagreetotherelevant
cancellationandnoshowpolicyofthatSupplier,andtoanyadditional(delivery)
termsandconditionsoftheSupplierthatmayapplytoyourvisitorstay(including
thefineprintoftheSuppliermadeavailableonourPlatformandtherelevant
houserulesoftheSupplier),includingforservicesrenderedand/orproducts
offeredbytheaccommodationprovider(thedeliverytermsandconditionsofan
accommodationprovidercanbeobtainedwiththerelevantaccommodation
provider).ThegeneralcancellationandnoshowpolicyofeachSupplierismade
availableonourPlatformontheSupplierinformationpages,duringthereservation
procedureandintheconfirmationemailorticket(ifapplicable).Pleasenotethat
certainratesorspecialoffersarenoteligibleforcancellationorchange.Applicable
city/touristtaxmaystillbechargedbytheSupplierintheeventofanoshowor
chargedcancellation.Pleasecheckthe(reservation)detailsofyourproductor
serviceofchoicethoroughlyforanysuchconditionspriortomakingyour
reservation.Pleasenotethatareservationwhichrequiresdownpaymentor
(whollyorpartly)prepaymentmaybecancelled(withoutapriornoticeofdefaultor
warning)insofartherelevant(remaining)amount(s)cannotbecollectedinfullon
therelevantpaymentdateinaccordancewiththerelevantpaymentpolicyofthe
Supplierandthereservation.Cancellationandprepaymentpoliciesmayvary
accordingtoroomtype.Pleasecarefullyreadthefineprint(belowtheroomtypes
oratthebottomofeachSupplierpageonourPlatform)andimportantinformation
inyourreservationconfirmationforadditionalpoliciesasmaybeappliedbythe
Supplier(e.g.inrespectofagerequirement,securitydeposit,non
cancellation/additionalsupplementsforgroupbookings,extrabeds/nofree
breakfast,pets/cardsaccepted).Latepayment,wrongbank,debitorcreditcard
details,invalidcredit/debitcardsorinsufficientfundsareforyourownriskand
accountandyoushallnotbeentitledtoanyrefundofany(nonrefundable)prepaid
amountunlesstheSupplieragreesorallowsotherwiseunderits(pre)paymentand
cancellationpolicy.

Ifyouwishtoreview,adjustorcancelyourreservation,pleasereverttothe
confirmationemailandfollowtheinstructionstherein.Pleasenotethatyoumaybe
chargedforyourcancellationinaccordancewiththeaccommodationprovider's
cancellation,(pre)paymentandnoshowpolicyornotbeentitledtoanyrepayment
ofany(pre)paidamount.Werecommendthatyoureadthecancellation,
(pre)paymentandnoshowpolicyoftheaccommodationprovidercarefullypriorto
makingyourreservationandremembertomakefurtherpaymentsontimeasmay
berequiredfortherelevantreservation.

Ifyouhavealateordelayedarrivalonthecheckindateoronlyarrivethenext
day,makesureto(timely/promptly)communicatethiswiththeSuppliersothey
knowwhentoexpectyoutoavoidcancellationofyourreservationorroomor
chargeofthenoshowfee.Ourcustomerservicedepartmentcanhelpyouif
neededwithinformingtheSupplier.Booking.comdoesnotacceptanyliabilityor
responsibilityfortheconsequencesofyourdelayedarrivaloranycancellationor
chargednoshowfeebytheSupplier.

7.(Further)correspondenceandcommunication
Bycompletingabooking,youagreetoreceive(i)anemailwhichwemaysendyou
shortlypriortoyourarrivaldate,givingyouinformationonyourdestinationand
providingyouwithcertaininformationandoffers(includingthirdpartyofferstothe
extentthatyouhaveactivelyoptedinforthisinformation)relevanttoyour
reservationanddestination,and(ii)anemailwhichwemaysendtoyoupromptly
afteryourstayinvitingyoutocompleteourguestreviewform.Pleaseseeour
privacyandcookiespolicyformoreinformationabouthowwemaycontactyou.

Booking.comdisclaimsanyliabilityorresponsibilityforanycommunicationwiththe
Supplieronorthroughitsplatform.Youcannotderiveanyrightsfromanyrequest
to,orcommunicationwiththeSupplieror(anyformof)acknowledgementof
receiptofanycommunicationorrequest.Booking.comcannotguaranteethatany
requestorcommunicationwillbe(dulyandtimely)received/readby,compliedwith,
executedoracceptedbytheSupplier.

Inordertodulycompleteandsecureyourreservation,youneedtouseyour
correctemailaddress.Wearenotresponsibleorliablefor(andhavenoobligation
toverify)anywrongormisspelledemailaddressorinaccurateorwrong(mobile)
phonenumberorcreditcardnumber.

AnyclaimorcomplaintagainstBooking.comorinrespectoftheServicemustbe
promptlysubmitted,butinanyeventwithin30daysafterthescheduleddayof
consummationoftheproductorservice(e.g.checkoutdate).Anyclaimor
complaintthatissubmittedafterthe30daysperiod,mayberejectedandthe
claimantshallforfeititsrighttoany(damageorcost)compensation.
Duetothecontinuousupdateandadjustmentsofratesandavailability,westrongly
suggesttomakescreenshotswhenmakingareservationtosupportyourposition
(ifneeded).

8.Ranking,preferredprogramme,starsandguest
reviews
ThedefaultsettingoftherankingofSuppliersonourPlatformis'Recommended'
(oranysimilarwording)(the"DefaultRanking").Foryourconveniencewealso
offerotherwaystorankSupplier.PleasenotethattheDefaultRankingiscreated
throughafullyautomaticrankingsystem(algorithm)andbasedonmultiplecriteria,
whichincludenotonlythepopularityofaSupplieramongourvisitors,butalso
customerservicehistoryandcertainbookingrelateddata(numberofbookings,
cancellations,conversionrate,etc).OntimepaymentofcommissionbyaSupplier
andthecommissionpercentagearealsoincludedinthealgorithmhowever,they
aretwooftheseveral(butdefinitelynotleading)factorsintheDefaultRanking.

Incertaincitiesandregions,Booking.comoperatesapreferredpartnership
program,allowingcertainSuppliersthatmeetandmaintainthepreferredprogram
termstobelistedaheadoftherestoftheSuppliersinthedefaultRecommended
rankingfortherelevantcity/region.ThepreferredSuppliersaremarkedwitha
thumbsupsymbolandinreturnforthishighranking,thepreferredSupplierpays
ahighercommission.OnlySuppliersthatmeetandmaintaincertainqualification
criteriacanbelistedaspreferred.

Thestarsusedfornonhotelaccommodations(e.g.bed&breakfasts)donot
correspondtothestarrankingsystemasmaybeapplicabletohotel
accommodations.

Thecompletedguestreviewmaybe(a)uploadedontotherelevantSupplier's
informationpageonourPlatformforthesolepurposeofinforming(future)
customersofyouropinionoftheservice(level)andqualityoftheSupplier,and(b)
(whollyorpartly)usedandplacedbyBooking.comatitssolediscretion(e.g.for
marketing,promotionorimprovementofourservice)onourPlatformorsuchsocial
mediaplatforms,newsletters,specialpromotions,appsorotherchannelsowned,
hosted,usedorcontrolledbyBooking.comandourbusinesspartners.Wereserve
therighttoadjust,refuseorremovereviewsatoursolediscretion.Theguest
reviewformshouldberegardedasasurveyanddoesnotincludeany(further
commercial)offers,invitationsorincentiveswhatsoever.

costssuffered,incurredorpaidbyyou,whetherdueto(legal)acts,errors,
breaches,(gross)negligence,willfulmisconduct,omissions,nonperformance,
misrepresentations,tortorstrictliabilitybyor(whollyorpartly)attributabletothe
Supplieroranyofourotherbusinesspartners(includinganyoftheiremployees,
directors,officers,agents,representativesoraffiliatedcompanies)whoseproducts
orserviceare(directlyorindirectly)madeavailable,offeredorpromotedonor
throughthePlatform,includingany(partial)cancellation,overbooking,strike,force
majeureoranyothereventbeyondourcontrol.

WhetherornottheSupplierhaschargedyouforyourroom,productorservice,or
ifwearefacilitatingthepaymentofthe(room/reservation)price,youagreeand
acknowledgethattheSupplierisatalltimesresponsibleforthecollection,
withholding,remittanceandpaymentoftheapplicabletaxesdueonthetotal
amountofthe(room/reservation)pricetotherelevanttaxauthorities.Booking.com
isnotliableorresponsiblefortheremittance,collection,withholdingorpaymentof
therelevanttaxesdueonthe(room/reservation)pricetotherelevanttax
authorities.Booking.comdoesnotactasthemerchantofrecordforanyproductor
servicemadeavailableonthePlatform.

Byuploadingphotos/imagesontooursystem(forinstanceinadditiontoareview)
youcertify,warrantandagreethatyouownthecopyrighttothephotos/imagesand

Booking.comdoesnotownorendorsethephotos/imagesthatareuploaded.The
truthfulness,validityandrighttouseofallphotos/imagesisassumedbythe

Booking.comdisclaimsallresponsibilityandliabilityforthepicturesposted.The

Booking.comexclusivelyretainsownershipofallrights,titleandinterestinandto
(allintellectualpropertyrightsof)(thelookandfeel(includinginfrastructure)of)the
Platformonwhichtheserviceismadeavailable(includingtheguestreviewsand
translatedcontent)andyouarenotentitledtocopy,scrape,(hyper/deep)linkto,
publish,promote,market,integrate,utilize,combineorotherwiseusethecontent
(includinganytranslationsthereofandtheguestreviews)orourbrandwithoutour
expresswrittenpermission.Totheextentthatyouwould(whollyorpartly)useor
combineour(translated)content(includingguestreviews)orwouldotherwiseown
anyintellectualpropertyrightsinthePlatformorany(translated)contentorguest
reviews,youherebyassign,transferandsetoverallsuchintellectualproperty
rightstoBooking.com.Anyunlawfuluseoranyoftheaforementionedactionsor
behaviourwillconstituteamaterialinfringementofourintellectualpropertyrights

shallexclusivelybesubmittedtothecompetentcourtsinAmsterdam,the
Netherlands.

translatedintootherlanguages.Thetranslatedversionisacourtesyandoffice
translationonlyandyoucannotderiveanyrightsfromthetranslatedversion.Inthe
eventofadisputeaboutthecontentsorinterpretationofthesetermsand
