AFFIDAVIT

I, _______________________________, of legal age, married and resident of

________________, Aurora, Zamboanga del Sur, after having been duly sworn to in
accordance with law hereby deposes and states: THAT-

1. We are children and sole heirs of deceased spouses Geraldo Tubiano and
Charita Toledo Tubiano who died on ____________________ and
________________________;

2. Charita Toledo Tubiano was the lawful possessor and registered owner of a
parcel of land bearing Original Certificate of Title No. P-28,829 situated
at Aurora, Zamboanga del Sur, which is more particularly described as
follows:

Beginning at a point marked 1 of Lot 57-B, Csd-12156, being

S. 36-48 W., 1383.47 m. from B.L.L.M. No. 6, Pls-61; t h e n c e
N. 33-11 W., 55.68 m. to point 2; N. 62-42 E., 365.87 m. to point 3;
N. 62-42 E., 20.00 m. to point 4; S. 26-36 W., 213.32 m. to point 5;
S. 79-15 W., 247.72 m. to point 1, point of beginning;

Containing an area of THIRTY TWO THOUSAND FIVE HUNDRED SEVENTY

THREE (32,573) SQUARE METERS.

3. After the death of our mother, Charita Toledo Tubiano, we decided to extra-
judicially settle the above-described property among ourselves;

4. For how many years that had passed, even during the lifetime of our mother,
we firmly believe that the above-described parcel of land is still registered
under the name of our mother;

5. And during the lifetime of our mother, she strongly believed that she owns
said parcel of land. She never mentioned that it was covered under CARper.
No notices

6. Never did it come into the knowledge of Charita Toledo that the said parcel of
land was subjected under the coverage of R.A. 6657, as amended by R.A.
9700, otherwise known as, CARPer Law during its implementation. In addition
thereto, said parcel of land contains a total land area of THIRTY TWO
THOUSAND FIVE HUNDRED SEVENTY THREE (32,573) SQUARE
METERS which is beyond the coverage of the CARper Law
