REGULATION ORDINANCE NO. 2005-178


AN ORDINANCE AME.N'.ClING ORDINANCE NO. 415, SERIES OF
1993 OTHERWISE KNOWN AS "AN ORDINANCE PROVIDING
FOR A NIGHT MARKET IN THE CITY OF ILOILO"

WHEREAS, the Rules and Regulations Implementing Republic Act 7160


otherwise known as the Local Government Code of 1991 provides that the Sanguniang
Panlungsod has the power to enact ordinances which shall ensure the efficient and
effective delivery of basic services and facilities including the establishment of markets
and authorize the operation by the city government.

WHEREAS, Ordinance 415, Series of 1993 otherwise known as "An Ordinance


Providing for a Night Market in the City oflloilo" was approved on September 8, 1993;

WHEREAS, efforts for economic growth such as revival of nigh markets will
revitalize the economic situation of the City and will make Iloilo City the center of
business and trade and promote tourism as well;

WHEREAS, the nighf market during the Chinese New Year celebration was
indeed successful.

NOW, THEREFORE, be it ordained by the Sangguniaf),j Panlungsod of the City


of Iloilo, that:

Section I. - There is hereby provided spaces in certain designated streets in the


City of Iloilo where persons having the qualifications and none of the disqualifications
under Section 2 hereof may sell any kind of general merchandise and/or any kind of
foodstuff from 7:00 P.M. to 12:00 MN, to be called "Night Market".

Section 2. - Any person having the following qualifications and none of the
disqualifications may apply for a single space only in the night market, to wit:

a. A natural born Filipino citizen;


b. Must have legal capacity to enter into a contract;
c. A resident of the City of Iloilo City;
d. Must have a stall duly registered with the City of Iloilo as a night market
vendor with a capitalization of not more than Pl00,000.00;
e. Has no fixed business establishment where people go to transact business;
f. Must not have been convicted of any crime involving moral turpitude.

Section 3. -The following streets are hereby designated as possible sites for night
market from 7:00 P.M. to 11:00 P.M., to wit:

a. Arsenal Street, between Muelle Loney and J.M. Basa Street


b. Aldeguer Street, between Muelle Loney and J.M. Basa Street
c. Guanco Street, between Muelle Loney and J.M. Basa Street
d. J. De Leon Street, between Iznart Street and Quezon Street
e. Along Promenade, Muelle Loney Street, between Comer of Quirino
Lopez Bridge and Comer ofYulo Street
f. HaH of the night market along Promenade, Muelle Lon,Street, between
Comer of Quirino Lopez Bridge and Comer ofYulo Street shall be
designated for vendors selling general merchandise and half of it shall be
designated for food peddlers selling foodstuff;
g. The City Council may designate such other streets as night market as the need
arises;
h. For the purpose of the night market, the designated streets are hereby closed to
vehicular traffic from 6:00 P.M. to 12:00 A.M.
t. For experimental purposes for a period of one (1) month to gauge public
acceptance, immediately upon the passage of this ordinance, only Arsenal
Street, between Muelle Loney and J.M. Basa Streets, shall be designated as a
night market, without prejudice to further designations by the City Mayor of
additional streets as provided above.

Section 4. - A Night Market Committee is hereby created to be composed of (I)


The City Mayor as Chairman, (2) the Chairman of the Committee on Trade,
Commerce and Industry as Vice Chairman, and as members (3) the City Treasurer (4)
the Head of the Department of General Services, (5) the Chairman of the Tourism and
Culture of the City Council or his duly authorized representative, and (6) the Chairman of
the Committee on Markets and Slaughterhouse or his duly authorized representative.
This Night Market Committee shall convene from time to time upon call of either the
Chairman or any two of its committee members for that purpose of acting upon a
applications for the night market and/or consider the awarding or raffling of specific
spaces in the designated streets. Applications recommended for approval and/or award
shall be submitted to the City Mayor for approval and entering into a contract. The
Committee is hereby authorized to formulate its own internal rules and regulations for
giving effect to the purpose for which it is created.

Section 5.-' The City Engineer shall cause to be painted along the entire length of
such designated streets on both sides, yellow lines two meters long and two meters apart
drawn at right angles from the side of the street thereby making an area of four square
meters each space, every market space to be numbered consecutively for identification
purposes.

Section 6. - Aside from regulatory fees and in lieu of local business taxes, those
granted spaces in this night market, shall pay only P20.00 per space per day, provided
that this amount shall be paid to the Office of the City Treasurer before the close of office
hours for that day and official receipt shall be openly displayed for the night and subject
to inspection by the representative of the City Treasurer.

Section 7. - Grantees of spaces in the night market shall be responsible for the
following:

a. Installing makeshift stalls in their respective designated market spaces from


6:00 P.M. to 7:00 P.M. and dismantle the same from 11:00 P.M. to 12:00
M.N. Such makeshift stalls shall conform to and be in accordance with the
inexpensive model designed by the City Engineer's Office;
b. Providing lights in their own premises, provided, however, that it shall be
prohibitory for them to use such lighting which will endanger or cause fire to
their makeshift stalls;
c. Clean their respective premises immediately upon closure of the night market
for that night. For this purpose, the City Government shall provided adequate
garbage receptacles in the area of the night market.

Section 8. - The City Government shall be responsible for the following:

1. Providing street lights in the designated streets to be brightly illuminated


during the duration of the night market;
2. Providing adequate protection by the police to ensure preservation of peace
and order;
3. Providing portable public toilet and shall cause the cleanliness of the
same during the duration of the night market;

Section 9. - The following shall be grounds for cancellation and/or revocation of


the license or grant to a night market space granted by the City Mayor, to wit:

a. Non-possession at anytime of any of the qualifications and none of the


disqualifications as provided for in Section 2 hereof;
b. Non use of the space granted to him for a continuous period of three days;
c. Non-payment of the fee as provided in Section 6 hereof;
d. Disturbance of the peace and other acts prejudicial to other grantees of the
night market;
e. Violation of anti-littering ordinance of the City of Iloilo;
f. The Night Market Committee may recommend such other causes as it may
deem legal for cancellation and/or revocation to the City Mayor.

Section 10. - All other ordinances and/or executive orders issued prior hereto
which are inconsistent herewith are hereby deemed repealed or amended accordingly.

Section 11. - This ordinance shall take effect immediately upon approval.
