Designation of Representation
Federal Law as explicitly supported by the National Labor Relations Act gives employees
"rte right to choose a representative to bargain with your employer on your beball..
USPS Elm 651.2 APWU National and Local #89 Constitutions ALL advocate an employee's
individual right to choice of representation. The assertion ofan employee's individual rights
tunder Federal Law in no way usurps the APWU's sovereign union cerification as defined in Art 1
section | ofthe Collective Bargaining Agreement
Formally, in writing I the undersigned exercise said right and hereto
designate myself as “choice of representation” at BOTH Step 1 and Step 2
of the grievance-arbitration procedure. The Collective Bargaining
Agreement specifically states that representation must be provided “on
the clock”. In compliance with the enclosed cited Federal Law, upon
“request for representation”, the onus is on Lindbergh Plant Management
to make wha:ever provisions necessary to satisfy said request. Bearing in
mind requested time will be used to research, write and have investigated
grievances on my own behalf.
This in no way absolves APWU Local 89 of its responsibility to provide
requested information to assist in grievance investigation, adjustment and
processing.
