WELCOME TO THE CITY OF FILLMORE CITY COUNCIL MEETING! Your participation at this
public meeting is valued and appreciated. Please note the City Council and Successor Agency
convene concurrently.

Agenda/Packet: The Agenda/Packet is available for review at Fillmore City Hall and online at
www.fillmoreca.com/cityhall/agendas 72 hours before the scheduled meeting (but generally
available the Thursday prior to the scheduled Tuesday meeting). Materials related to an item on this
agenda submitted to the City Council/Successor Agency after distribution of the agenda packet are
available for public inspection in the City Clerks Office during regular business hours and on the
Citys website subject to staffs ability to post the documents before the meeting.

Challenging City Council/Successor Agency Decisions: Any legal action by an applicant seeking to
obtain a judicial review of the City Council/Successor Agencys decision on a hearing or issue listed
on this Agenda may be subject to the 90-day filing period of, and governed by, Code of Civil
Procedure 1094.6. Additionally, if you challenge the actions of the City Council/Successor Agency
in court, you may be limited to raising only those issues you or someone else raised at the public
hearing described in the public notice, or in written correspondence delivered to the City
Council/Successor Agency at, or prior to, the public hearing pursuant to California Government
Code 65009.

Consent Calendar: Items listed on the Consent Calendar are considered to be routine in nature, not
discussed individually, and are normally approved by one motion. If a Councilmember or member of
the public wishes to comment on a particular item, that item shall be removed for separate action.

No New Business will be considered by the City Council/Successor Agency after 11:30 p.m. unless
a majority of the legislative body determines to continue.

Public Input; If you wish to address the Council/Successor Agency regarding an item listed on this
agenda, please complete and submit an Audience Participation Form to the City Clerk prior to
consideration of that agenda item. Public Comments is the time for presentations/comments not on
this agenda but within the subject-matter jurisdiction of the City Council/Successor Agency. Please

Public Comments. Pursuant to California Government Code/Brown Act, the City Council/ Successor
Agency ordinarily cannot take action on any item that is not listed on the agenda. As a result,
matters identified during Public Comment will be referred to staff for follow-up or considered on a
future agenda. In accordance with Resolution No. 09-3175, speakers are provided five (5) minutes

The Citys City Council will be meeting at the Veterans Memorial Building, [511 Second
Street] to hold a Listening Workshop concerning Medical Marijuana.

RE: LISTENING WORKSHOP: MEDICAL MARIJUANA

REQUEST

That the City Council conduct a medical marijuana listening workshop facilitated by Erik Sternad,
Sternad Consulting.

DISCUSSION

The Medical Cannabis Regulation and Safety Act (MCRSA), was signed into law by the Governor
in 2015. Effective January 1, 2016, this law established a regulatory and licensing program for
commercial activities relating to medical marijuana throughout the State, including cultivation,
transportation, manufacturing, testing and dispensing.

The Adult Use of Marijuana Act (AUMA or Prop 64) is a marijuana legalization initiative that
received the required number of votes to become state law at the November 8, 2016 election.
AUMA authorized the personal cultivation of marijuana and recreational use of marijuana by
adults with called for the establishment of recreational marijuana licenses to be issued by the State
commencing January 1, 2018. In response to the MCRSA and AUMA laws, the City Council
adopted regulations prohibiting all commercial activities relating to both medical and non-
medical marijuana.

ORDINANCES AND RESOLUTIONS

The ordinances and resolutions listed below were adopted by City Council to address medical and
recreational marijuana issues before unpermitted businesses could open and claim grandfathered
rights.

PUBLIC WORKSHOP

The City Council conducted a workshop on marijuana on Tuesday, July 25, 2016 which included
a panel of expert speakers both pro and con regarding AUMA. Residents at the meeting were also
afforded the opportunity to express their opinions regarding AUMA.

MARIJUANA TAX INITIATIVES

In June of 2016, the City Council placed two marijuana tax initiatives on the November ballot.

1. A tax on the sale and distribution of marijuana. This item passed with 64% in favor of
implementing a tax should these businesses be allowed.

2. A tax on space dedicated to commercial cultivation of marijuana. This item passed with
60% in favor of implementing a tax should these businesses be allowed.

WORKSHOP PURPOSE AND FORMAT

The purpose of this workshop is to:

1. Share information with our residents on requests to produce and distribute medical
marijuana within the city limits.

2. Provide a forum for interested parties to express their views regarding medical marijuana
cultivation and distribution.

The format of this workshop is as follows:

1. The session will be facilitated by Sternad Consulting in English with Spanish translation
provided to those desiring the translation.

2. Public seated at tables of 8-10 people each.


a. Fillmore residents will be gathered at their own tables.
b. Spanish-language preferred residents will be gathered together to receive
interpretation services.
c. City Council members will be divided among the tables.

5. Public Input on Specific Medical Marijuana Questions

The key issues that City Council will be considering with regard to a medical marijuana cultivation
policy:

1. Whether to continue with a complete prohibition or consider commercial cultivation and


distribution for medical marijuana only?

2. If commercial cultivation and distribution of medical marijuana were allowed where


should City Council devote any potential tax revenues generated in connection with those
activities?

Conduct a medical marijuana listening session.
