REGULATION ORDINANCE NO. 2017-077


AN ORDINANCE ESTABLISHING THE TOURISM TRUST FUND IN THE
ILOILO CITY TOURISM AND DEVELOPMENT OFFICE UNDER THE
CONTROL OF THE CITY MAYOR AND FOR OTHER PURPOSES

Parcon and Hon. Eduardo L. Peiiaredondo

WHEREAS, Section 5, Article X of the 1987 Philippine Constitution provides that


each local government unit shall have the power to create its own source of revenue
and to levy taxes, fees and charges subject to such guidelines and limitations as the
Congress may provided consistent with the basic policy of local autonomy;

WHEREAS, under Section 3 (b) of Republic Act No. 9593 or the Tourism Act of
2009, one of its objectives is to encourage activities and programs which promote
tourism awareness, preserve the country's diverse culture and heritage, and instill a
sense of history and culture of tourism among the youth. and the populace;

WHEREAS, lloilo City was known for its many festivals, such as Dinagyang,
Paraw Regatta, Chinese New Year, District Fiestas, to name a few and mostly the City
government, through the City Tourism Office, is the one spearheading these said
activities;

WHEREAS, the City government of lloilo is collecting tourism license fee from
tourism establishment by virtue of the provision under the Tourism Code of lloilo City
and The Local Revenue Code of lloilo City;

WHEREAS, the tourism license fee collected yearly goes to the General Fund of
the City and is being used in other City's programs and projects;

WHEREAS, the City Tourism Office, aside from the various festivals of the City,
has drafted Tourism Development Plan 2016-2022 that will bring more development to
tourism industry, and such , will need more funding for its implementation.

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of lloilo


City, that:

Section 1. Title. - This ordinance shall be known as "AN ORDINANCE


ESTABLISHING THE TOURISM TRUST FUND IN THE ILOILO CITY TOURISM AND
DEVELOPMENT OFFICE UNDER THE CONTROL OF THE CITY MAYOR AND FOR
OTHER PURPOSES".

Section 2. Purpose. - The ordinance aims to provide additional budget to the


lloilo City Tourism Office to enable it to effectively implement all its proposed projects as
stated in the Tourism Development Plan 2016-2022;

Section 3. Coverage. - This Ordinance shall apply to all establishments in the


City of lloilo that undergoes payment for registration or renewal as a tourism accredited
establishment with the City Tourism and Development Office.

Section 4. Definition of Terms - The following terms under this ordinance shall
mean:

a) Tourism oriented enterprise - refers to the facilities, services and attraction


involve in tourism which primarily cater to tourists such as travel and tour services, land,
sea and air transport services exclusively for tourist use; accommodation
establishments, such as hotels, resort5s, tourist inns and apartment hotels or apartels,
convention and exhibition organizers, tourist estate management services, and theme
parks and zone.

b) Tourism related enterprise - refers to other tourism enterprises not covered


by Tourism Oriented Enterprises such as but not limited to motels, restaurants, pension
houses, homestays, beerhouse, lodging house, barber shop, carinderia, beauty parlor,
spa, grocery stores, department stores, boutique, malls, fitness gyms, sports and
recreational clubs, training centers, ticketing offices, internet stations, tourist rest areas
in gasoline stations, museums and galleries, coffee shops, bakeshops, pastry shops
pasalubong centers, handicraft/shellcraft, native product stores, KTV's, gaming and
amusement centers, convenience store, pharmacy with grocery stores and alla
establishment inside the mall.

c) Tourism Trust Fund - 15% of the total amount collected by the City
Treasurer's Office coming from the payment of tourism license of all tourism accredited
establishment in the City of lloilo to serve as a trust fund intended for lloilo City Tourism
and Development Office uses.

Section 5. Purpose of Tourism Trust Fund. - The Tourism Trust Fund of 15%
shall be used to fund for whatever tourism related purposes and programs, subject to
the usual government accounting and auditing rules and regulations. The Sangguniang
Panlungsod shall then be furnished with a copy of the liquidation report for information.

Section 6. Collecting Agent. - The City Treasurer's Office shall be responsible


in collecting the payment for tourism license and in setting aside the 15% of the amount
collected every year to become the Tourism Trust Fund.

Section 7. Inclusion in Supplemental Budget. - The City Tourism and


Development Office can make use of the Tourism Trust Fund only upon approval of the
lloilo City Supplemental Budget by the Sangguniang Panlungsod.

Section 8. Controlling Authority. - The City Mayor shall have the full control in
the implementation of this ordinance and shall have the power to order the release of
the Tourism Trust Fund in relation to the implementation of tourism programs and
projects of the lloilo City Tourism and Development Office.

Section 9. Separability Clause. - Should any section or provision of this


ordinance be declared by any court to be unconstitutional or invalid, such decision shall
not affect the validity of this ordinance as a whole or any part thereof other than the part
so declared to be unconstitutional or invalid.

Section 1o. Repealing Clause. - All ordinances or parts thereof which are in
conflict with the provisions of this ordinance are hereby repealed, modified or amended
accordingly.

Section 11. Effectivity. - This ordinance shall take effect immediately upon
approval.
