Proposition 65 (Prop 65) is the Safe Drinking Water and Toxic Enforcement Act of 1986, a ballot initiative passed overwhelmingly by California residents in 1986. Since its enactment, there have been numerous lawsuits which resulted in the reduction of carcinogenic and reprotoxic chemicals by significant reformulations of consumer products containing such chemicals1. Over the years, Prop 65 has produced consent agreements for a number of consumer products including, but not limited to, bibs, bicycles, brass- containing products, cookware, cosmetics, exercise mats, ceramicware and glassware, clothing, faux leather furniture, headphone cables, jewellery, lunchboxes, luggage and accessories, poker chips and personal carrying products2. In the last few months, a number of Prop 65 settlements have been reached for a variety of products, including, but not limited to, belts, brass door handles, exterior decorations on glassware and ceramic mugs, folding chairs with sport team logos on exterior surface, and upholstered storage furniture. Under the terms of some of the settlements, surface coating materials on glassware and ceramic mugs, and folding chairs with sport team logos were notable to be in line with federal standards for paints and 1 similar surface coating materials (16 Prop 65, Office of Environmental Health Hazard Assessment (OEHHA) 2 CFR 1303, Public Law 110-314, Safeguards 96/07, 63/08, 81/08, 109/09, 81/09, 129/09 and references therein 3 CPSIA)3.
