1. EXECUTIVE SUMMARY

The assessment is specifically in relation to the proposed movements of a Kirow 1200


Rail Crane for access to site and delivering and lifting new transformer and rectifier
modules (TRU) into position at Waterloo Substation.

Inspections were undertaken by Tony Gee and Partners from the underside of the deck
on the 13th December 2012 during daylight hours, with a trackside observation on the
3rd December 2012.

The bridge is generally in good condition with no observed defects considered to have
any immediate safety implications to the operation of the railway or public at large.
Some areas of the bridge could not be inspected due to the presence of bird mesh
screening, but appeared to be in a similar condition to the rest of the structure.

An assessment of the superstructure was undertaken using the information gained from
the inspections, and reference to record drawings supplied by Network Rail. The bridge
has been assessed in accordance with NR/GN/CIV/025 (Level 1 quantitative),
considering the deck as single simply supported span.

The assessment indicates that the structure has a capacity of RA14 at 15mph. The
critical elements are the main and edge girders in bending.

The Kirow1200 crane in travelling formation is at worst RA7 for short spans, or
equivalent to RA4 for a span of 12m. Therefore the existing structure is considered
adequate to carry the Kirow1200 crane.

The abutments and foundations have been qualitatively assessed using the
observations of the inspection and are considered to be satisfactory under the current
levels of loading.

2. INTRODUCTION

Tony Gee and Partners LLP were appointed by Network Rail Infrastructure Projects
Electrification and Plant Design Group to inspect and assess certain structures in
support of the proposed upgrade works to Waterloo substation in accordance with
Technical Work Scope 112040-10.03-WAT-62844651. The assessment work is
specifically in relation to the proposed movements of a Kirow Rail Crane for access to
site and delivering and lifting new transformer and rectifier modules (TRU) into position
at Waterloo Substation.

This assessment is to validate the existing route availability of the metallic structure
above Centaur Street to permit the crane in travelling formation along the up and down
main slow lines. This report presents the findings of the structural assessment.

The purpose of the inspections was to validate the existing record information and
condition of the structure enabling the subsequent completion of the load assessment.

Inspection procedures follow the guidelines in accordance with NR/L3/CIV/006/2A


Handbook for the examination of Structures Part 2A: Bridges, and NR/GN/CIV/025
The Structural Assessment of Underbridges.

The assessment has been carried out in accordance with the Approval In Principal for
Assessment, as detailed in Form AA document reference A112045/CSFAA contained in
Appendix E

The Inspection for Assessment Report is included within this report.

3. DESCRIPTION OF STRUCTURE

The structure across Centaur Street (formerly Allen Street) comprises two structures, a
masonry arch to the south, adjoining a single span metallic wrought iron deck structure.
The metallic deck is supported on masonry piers forming part of the Necropolis and
Classics Viaducts, and carries 5No. DC electrified railway lines between Vauxhall Street
and Waterloo stations in Lambeth, London. Of these three lines form the south sidings,
one of which terminates on the bridge deck. The remaining four DC electrified lines are
carried by the masonry arch. The maximum line speed for all lines is 15mph in either
direction.

The bridge is located in a commercial urban area with close proximity to Westminster
Bridge Road. The Viaduct arches to the north of the bridge are occupied by business
C.P.Hart Bathrooms. The rails over the bridge are carried on ballasted timber sleepers.

Record drawings indicate that the Necropolis and Classics arch viaducts were
constructed circa 1850 to carry the South Western Main Line as part of London and
South Western Railway (LSWR) into Waterloo Station. This was subsequently widened,
likely as part of the Necropolis Railway Station relocation in 1902, and subsequent
expansion of Waterloo Station between 1910 and 1922.

Please refer to Appendix B for inspection record sketches. The structure comprises
multiple I profile riveted girders which share top or bottom flanges with the adjacent
girder forming a continuous trough. The soffit of the girders contains regular holes
which permit access to the void created between girders. These openings are covered
with mesh and typically obscure the extent of girder than can be observed. The top of
deck is formed with the combined top flange of the girders, and infill plates riveted to the
top flange. The girders are orientated square to the abutment. The 9No. girders to the
western skew end of the structure connect to a larger edge girder which spans above
the adjoining masonry arch below.

The troughs and beams are simply supported, either directly on the masonry or a
concrete bearing shelf, with an end screen masonry wall behind to retain fill. The edge
girder from the original construction remains on the northern edge providing pedestrian
edge protection. Lead sheet bearings are provided between the underside of troughs
and top of abutment.

Ballast depth has been determined using track level and road level topographic
surveys. The minimum ballast depth below underside of sleeper is approximately
125mm compared with (102mm) 4 on the record drawings, with allowance for 1 tiles
and 1 asphalt.

4. INSPECTION FOR ASSESSMENT

No previous inspection reports or structural assessments related to the structure have


been provided for our review prior to undertaking the assessment.

An inspection of the structure was carried out during daylight hours on the 13th
December 2012 by Tony Gee and Partners. The weather conditions on the day were
cold but dry. A close inspection was carried out to the underside of the deck from a
mobile elevated work platform from the road below.

Access to the track side from above the deck was limited, but observed on foot from the
adjacent substation land.

A survey was undertaken to confirm the basic dimensions for the assessment and
levels were taken to establish the construction depths and clearances beneath the
structure. The measurements are used in the structural assessment. As far as could be
observed, the superstructure was as shown on the record drawings supplied by
Network Rail.

No material testing was carried out but from the record drawings and form and dates of
construction the deck was taken to be wrought iron.

There were no observed defects considered to have any immediate safety implications
to the operation of the railway or public at large. The bridge was generally in good
condition, showing minor signs of degradation to the protective coating system around
the openings in the underside of the deck. Therefore no reduction in section properties
to account for corrosion loss is required.

However areas of corrosion were observed local to each end of the supporting beams
around the drainage pipes and openings in the bottom flange. We also noted no
coating protection internally between girders (observed from the openings in the bottom
flange) and the interior surface was mottled and slightly corroded.

Centaur Street Bridge 1\A8

Element Description of Defects

Abutments The abutments are of brickwork construction, with masonry or


concrete bearing shelves below the longitudinal girders.
Generally the condition of the abutments is good.
The Waterloo abutment contains 1No. large arch opening
which provides access to the Necropolis viaduct arches and
CP.Hart premises, and 2No. smaller arch openings. The main
arch is built within the face of the abutment and surrounded
by masonry. The arch showed a vertical crack in the intrados
approximately 1.5m back from the face of the abutment,
suggesting some settlement had occurred. There were no
other signs of distress or movement in these areas.

The Vauxhall abutment contains two smaller arches, which
have been bricked up and replaced with metal doors.
On both abutments there were large areas of damp, water
ingress and efflorescence. To the western end the masonry
has been repointed, and the brick work surface has been
eroded by 10-15mm (Photograph 3). The eastern end of both
abutments is faced with glazed white brickwork. Some local
areas were loose and had come away to show the older
masonry behind (Photograph 8)

Parapets and Fencing The eastern edge girder provides an upstand forming the
pedestrian parapet / restraint. Viewed from a distance it did
not show any obvious signs of wear. Some minor vegetation
noted at the supports. (Photograph 17)

Piers Not applicable

Bearings The trough girders bear directly onto sheet lead on the
concrete bearing shelf. The lead was only visible in some
locations but assumed to be present. (Photographs 5)
The Western Edge Girder appears to be supported by two
large steel soffit plates bearing directly on to the concrete
shelf. The adjacent girder is then supported with two bearing
plates to account for the change in level. It was not possible
to inspect the condition of these due to bird mesh. The
southern bearing plate located on grout / cement was heavily
corroded but appeared to be performing satisfactorily due to
its thickness. (Photograph 4)

Foundations The foundations were not visible for inspection. The


abutments form part of the adjacent Classics and Necropolis
Viaducts and anticipated to be founded on spread footings,
on the Kempton Sands and Gravels below. No signs of
significant movement or considered to have occurred

Cutting Slopes

Longitudinal Girders General


Inspections of the inner trough girders was obstructed by
mesh screens. Several of these were lifted to examine the
insides of the girders. (Photographs 2 & 12)
The bottom flange of the trough typically contains a cover
plate at midspan to splice the two plates together.
The girders also contain 2No. web splices at third points
within the beam length.
Edge Girder (No. 1)
At the western skew end of the deck 8No. I profile trough
girders are supported on a larger single span edge girder.
This beam sits directly above the face of the adjoining
masonry arch but does not bear on to it. The clear span of the
beam is 43 (13.1m). Due to the proximity to the adjacent arch
it was not possible to inspect the western side of the girder,
or the top flange. In general the beam was in good condition
and the coating protection system was intact.
Typical Trough Girders (2No girders forming troughs
Nos. 2-37)
The inside of the girders were uncoated and had a mottled
corrosion patina on the surface. In general the sections,
rivets, and plates were in good condition. (Photograph 12)
There were areas of local corrosion around the openings, and
loss of coating protection in these areas.(Photographs 7 & 10)
The inside of the girders voids contained a small amount of
debris resting in and around the transverse tee stiffeners.
Beam. The void within the south end of beam 5 at the
interface with the skew edge beam contained a large amount
of rubble. We anticipate that it was left after the conversion
works to the bottom flange, and covered up. (Photograph 6)
The insides of the trough webs are heavily corroded at the
interface with the end screen wall. (Photograph 9)
1No. girder bottom flange was split in half over the full length,
with internal cover plates along the full length joining the two
sections together. (Photograph 13)

Outer Edge Girder (No. 38)


The outer edge girder and parapet upstand was generally in
good condition. Observed from the road the coating protection
was also in good condition with only minor signs of spot
corrosion spots at the bearing shelf support. Minor vegetation
at the support. (Photograph 17)

Deck Elements Floor plate (Between Type 1 and 2 girders)


The top flange of the girders forms half of the trough and deck
plate, spanning between girders. This was inspected from the
underside of the deck between girders, and generally in good
condition. (Photograph 10 & 11)
The other half of the deck plate enclosing the trough consists
of an additional plate spanning transversely between the top
flanges of the girders.
Record drawings suggest this enclosed void may have once
contained asphalt laid to fall towards a down pipe and a single
access hole in the bottom flange. Subsequent works added
holes to all the bottom flanges, removing the asphalt. The
inspection confirmed bottom flange openings on all girders.
Record drawings for the top of the trough also shows
concrete planks supported on cross frame supports. These
were not present in any of the girders.
The underside has some localised corrosion spots. There was
however no obvious deformation and the transverse tee
stiffeners appeared intact. At the ends of the beams at the
interface with the masonry end screen wall there is more
corrosion over a width of 150mm (Photograph 9)

Drainage and Gutters are fixed to the face of the abutments to channel any
Waterproofing water that seeps through the masonry end-screen wall to the
highway drainage. The drainage is only partly effective as it is
spaced away from the face of the wall, with sloping infill
panels to divert water into the gutter. (Photograph 18)
Bituminous asphalt laid to falls on top of the deck is shown on
record drawings but not inspected. There was evidence of
water ingress and staining the front of the abutment bearing
shelves, consistent with corrosion to the beams in this area.

5. ASSESSMENT

A Level 1 Quantitative assessment has been carried out, in accordance with


NR/GN/CIV/025 and the Approval in Principal for Assessment, document reference
A112045/CSFAA.

The Form AA document is included in Appendix E, and the calculations are provided in
Appendix F

5.1 Superstructure

The superstructure comprises multiple I section girders, joined together with


alternating top and bottom flanges forming a continuous trough profile. In alternate bays
another top plate is installed between girder flanges to provide a flat deck. The girders
are transversely braced with tee section stiffeners at regular intervals which support the
deck plate above. The girders are aligned perpendicular to the abutment face, and
slightly skew to the railway lines above. Each pair of girders has cover plates at mid
span to join the splice in the bottom flange plate. The girders also have web splices at
third points and identified on the record drawings. The record drawings indicate a small
precamber of 1.5

Rail levels have been identified from topographic survey and compared with the bridge
surveyed deck soffits to determine the ballast depths. The depths found were consistent
with the record drawing information.

Typical girders have been assessed using 20Units RA1 EUDL and End Shears allowing
for dispersion of live load to the deck in accordance with NR/GN/CIV/025. The girders
are compact and have been assessed as simply supported with an effective flange
area ignoring the openings within the bottom flange.

A simple grillage analysis was carried out to determine the distribution of load on to the
western skew edge beam from 20 units of RA1 axle loads. The edge beam is non-
compact and has been assessed as simply supported with regular torsional restraints
from the longitudinal beams.

The deck plate has been assessed by deriving the imposed load underneath the
sleepers dispersed through the ballast fill to the deck from a single RA10 axle load.

5.2 Substructure

The abutments and foundations have been qualitatively assessed using the
observations of the inspection, and are considered to be satisfactory for the current
levels of loading.

5.3 RA Group Rating

The overall capacity of the bridge is assessed as RA Group 14 at 15mph. The critical
elements are the main and edge girders in bending.

The Kirow1200 crane is to be used to unload and lift into place TRUs for Waterloo
Substation. To enable the Kirow crane to arrive at site it needs to travel north along the
Up Main Slow line to Waterloo Station, south back along the Down Main slow before
reaching the No2. South Siding. This route requires the crane to cross Centaur Street in
travelling formation. In this arrangement the crane weight is reduced to 98t as the boom
and counterweights are removed to adjacent wagon. Axle loads are therefore 8No.
12.25t.

By comparison with RA10 the Kirow1200 crane in travelling formation is at worst RA7
for short spans (<5m), or equivalent to RA4 for a span of 12m. Therefore the existing
structure is considered adequate to carry the Kirow1200 crane.

Advice to Civil Contractors on Avoiding Danger from Buried Electricity
Services
The expression EDF Energy includes EDF Energy Networks (EPN) plc, EDF Energy Networks (LPN) plc, EDF Energy
Networks (SPN) plc, EDF Energy Networks Ltd and any of their successors and predecessors in title.

The New Roads and Street Works Act 1991 has required since August 1997 that at least one accredited person be present on a street works site while work is in progress. This information sheet is
not meant as a substitute for proper accreditation but does however provide guidance and simple precautions that should be adopted before any work is carried out on the public footpath or
highway.

Please note: At least one member of the working party should be street works accredited and have this accreditation available for inspection if required to produce it.

Many accidents occur when underground cables are damaged during the course of excavation. Damage to Live electricity cables can result an explosion which can cause serious injury or even
death.

Nearly every footpath in major towns and cities has one or more electricity cables beneath it. Therefore your attention is drawn to the following:

1. Have a copy of the most up to date cable drawings with you on site and check them before you start any and all excavations. Remember: some cables do not belong to EDF Energy and
therefore will not be shown on the drawings. All records are a guide only and may not be accurate due to geographical changes e.g. footpath level being increased/decreased for
example.
2. Have a cable location device on site e.g. CAT (Cable Avoidance Tool) and use this to help you survey the entire site before you start digging. If you dont know how to use a Cable
Avoidance Tool, then please refer to your supervisor or supplier/manufacturer in order to gain training in the competent use of Cable Avoidance Tools before using them. Furthermore, if
you have not received adequate training, cable detection should be referred to trained colleagues before work commences rather than cable detection being abandoned.
3. Mark out the location of electricity cables in accordance with the signals that are obtained from the location tool. Remember that:

The cable locator in the Power mode will not always detect the presence of all cables especially if they are not carrying any current at the time.
When the cable locator is being used along with a signal generator or in the radio mode, it is more likely that cables not carrying current will be detected.

4. Look around you to see if there is anything nearby that would have an electricity service such as lamp columns, phone boxes, bus shelters, traffic light control boxes etc. These will all
have a small service cable running to them that can easily be damaged.
5. Continue to use the cable locator during the entire excavation process. You may be only inches away from a live cable.
6. Do not use mechanical excavators within 0.5m of the known presence of an electricity cable. If a mechanical excavator is used at any time keep everyone away from the bucket while
digging.
7. Use spades and shovels with insulated handles in preference to other tools such as forks and picks and never throw or spike tools forcibly into the ground.
8. If forks and picks have to be used, then tools with short blunted chisel ended tines should be used. This may be the case if the ground is very hard and the surface needs to be broken up
first.
9. If any cables are suspected of being embedded in concrete that you need to excavate, do not start work until:
The cables have been made dead, (likely to require EDF Energy attendance on site)
Or
A representative of EDF Energy has established and communicated to you, an agreed alternative safe method of safe working.
10. Never assume that cables follow an straight line or that they run at the same depth.
11. Never disturb electricity cables or their joints or their protective covers.
12. Always ensure that all exposed cables are adequately supported, e.g. house bricks etc. and never use cables or joints as hand holds or steps for gaining entry /exit to an excavation. If
necessary protect cables using sandbags, timber shuttering etc.

In the event that a cable is damaged or you suspect that a cable is damaged (No matter how slightly).
Mark the location.
Keep people at a safe distance.

where cable repairs are not required.

TERMS AND CONDITIONS FOR THE SUPPLY OF UTILITY MAPS

This contract (the Contract) is made on the receipt by Scotia Gas Networks Limited, a company
incorporated and registered in England and Wales with company number 04958135 whose registered
office is at St Lawrence House, Station Approach, Horley, Surrey RH6 9HJ (the Supplier), of a
signed acceptance (the Acceptance) from the customer (the Customer) of these terms and
conditions for the supply of Utility Maps data in relation to the location of gas mains owned by the
Supplier (the Data) viewable by the Customer via DVD format (the DVD), hereinafter referred to
as the Software.

1. LICENCE AND TERM


1.1. The Supplier grants to the Customer a non-exclusive licence for a term of 5 years commencing
on, and including, the date of this Contract to use the Software on the following terms: (a) to use the
Data for operational purposes only; and (b) to use the Software to view and print the Data.
1.2. In relation to scope of use the Customer is not permitted to:
(a) use the Software other than as specified in clause 1.1, without the prior written consent of the
Supplier and the Customer acknowledges that additional fees may be payable on any change of use
approved by the Supplier;
(b) copy, adapt, reverse engineer, decompile, disassemble or modify the Data and/or Software in
whole or in part from the DVD;
(c) merge the Software in whole or part with any other software;
(d) forward or make available the DVD to any third party;
(e) use print outs of the Data for any purpose other than showing the location of underground
apparatus, unless the appropriate survey digital mapping has been purchased; or
(f) sub-license, assign, charge or otherwise transfer any of its rights or obligations under this
Contract.
2. UPDATES
2.1. Subject to the availability of resources, the Supplier shall provide the Customer with releases
of the Software which corrects faults, adds functionality or otherwise amends or upgrades the Software,
but which does not constitute a new version (Updates), to the Software on a quarterly basis during
the term of this Contract.
2.2. Upon receipt of any such Updates, the Customer agrees to promptly return to the Supplier all
previous and redundant copies of the Software.
2.3. The Customer acknowledges that Updates are dependant on the timely return of the Software
(pursuant to clause 2.1 above) from the previous quarter.
3. WARRANTIES
3.1. The Supplier warrants that as at the date of this Contract:
(a) it has the right to enter into this Contract and to grant to the Customer a licence to use the
Software as contemplated by this Contract;
(b) the Software (and the use by the Customer of the Software as at the delivery date) shall not
breach the Intellectual Property Rights of any third party;
(c) the Software is free from material defects preventing the Software carrying out the functions
for which it was designed but this warranty shall not extend to such defect or fault from the Customer,
having amended the software or used it out side the terms of this Contract;
(d) subject to clause 3.3, the Data is up to date as at the date of delivery; and
(e) so far as it is aware the Software and the media on which the Software is delivered are free
from viruses and other malicious code as at the delivery.
3.2. If, within 15 days of the delivery, the Customer notifies the Supplier of any defect or fault in
the Software in consequence of which it fails to conform to any of the warranties in clause 3.1, the
Supplier shall, at the Suppliers option, promptly do one of the following: (a) repair the Software; or (b)
replace the Software.
3.3. Except as otherwise expressly agreed, the Supplier makes no representation or warranty
expressed or implied, is or will be made, and no responsibility or liability is or will be accepted by the
Supplier, as to, or in relation to, the accuracy or completeness of any Data encompassed within the
Software or made available to the Customer by way of this Contract, and the Customer agrees that it is
responsible for making its own evaluation of such Data.
3.4. The Supplier does not warrant that the use of the Software will be uninterrupted or error-free.
3.5. The Customer accepts responsibility for the selection of the Software to achieve its intended
results.
3.6. All other conditions, warranties or other terms which might have effect between the parties or
be implied or incorporated into this Contract or any collateral contract, whether by statute, common
law or otherwise, are hereby expressly excluded.
4. EXCLUSIONS
4.1. The Customer acknowledges that apparatus, including, but not limited to, service pipes,
service vales, siphons, sub-connectors are not shown on the Software, however their presence
should be anticipated. The Customer undertakes to use safe digging practices when excavating
and at all times will act in accordance with the HS (G) 47 guidelines and recommendations.
4.2. The Customer acknowledges that it is its sole responsibility to establish the actual
position of mains, pipes, services and other underground apparatus on site and that the Software
should only be used as an aid to help locate such apparatus.
4.3. For the avoidance of doubt, the gas mains identified on the Software, are those owned
and operated by the Supplier. Gas mains owned by other gas transporters or otherwise privately
owned may also be present in the area of excavating, however they will not be identified on the
Software. The Customer should contact the relevant third party in order to collate information
about the location of their apparatus.
4.4. Subject to the provisions of this clause 4, neither party shall have any liability for any
losses or damages which may be suffered by the other or any group company of the other (or any
person claiming under or through the same), whether the same are suffered directly or indirectly
or are immediate or consequential, which fall within any of the following categories: (a) special
damage even though that party was aware of the circumstances in which such special damage
could arise; (b) loss of profits; (c) loss of anticipated savings; (d) loss of business opportunity; (e)
loss of goodwill; (f) loss of data; provided that this clause 4.4 shall not prevent claims for direct
financial loss that are not excluded by any of categories (a) to (f) inclusive of this clause 4.4.
4.5. The exclusions in clause 4.4 shall apply to the fullest extent permissible at law but neither
party excludes any liability for death or personal injury caused by its negligence, or the
negligence of its employees or agents, or for fraud or fraudulent misrepresentation.
5. INTELLECTUAL PROPERTY RIGHTS
5.1. The Customer acknowledges that, subject to clause 5.2, all Intellectual Property Rights in the
Software and any Updates belong and shall belong to the Supplier, and the Customer shall have no
rights in or to the Software other than the right to use it in accordance with the terms of this Contract.
5.2. The Customer acknowledges that the Supplier does not own the Intellectual Property Rights in
respect of the Ordnance Survey maps (Background Data).
5.3. The Background Data is subject to Crown copyright for which the Customer must hold a
separate Ordnance Survey licence for the purposes of this Contract.
5.4. In the event the Customer has any queries in regard to the Background Data they should
contact: Ordnance Survey Copyright Section, Romsey Road, Southampton SO16 4GU.
5.5. The Customer undertakes at its own expense to defend the Supplier or, at its option, settle any
claim or action brought against the Supplier alleging that the possession, use, development,
modification or maintenance of the Software (or any part thereof) in accordance with the terms of this
Contract infringes the UK Intellectual Property Rights of a third party (Infringement Claim) and shall
be responsible for any reasonable losses, damages, costs directly incurred by or awarded against the
Supplier as a result of or in connection with any such Infringement Claim.
5.6. For the purposes of this clause 5, the term Intellectual Property Rights shall mean all
patents, copyrights, design rights, trade marks, service marks, trade secrets, know-how, database rights
and other rights in the nature of intellectual property rights (whether registered or unregistered) and all
applications for the same, anywhere in the world.
6. TERMINATION
6.1. Either party may terminate this Contract at any time on written notice to the other if the other:
(a) is in material or persistent breach of any of the terms of this Contract and either that breach is
incapable of remedy, or the other party fails to remedy that breach within 30 days after receiving
written notice requiring it to remedy that breach; or
(b) is unable to pay its debts (within the meaning of section 123 of the Insolvency Act 1986), or
becomes insolvent, or is subject to an order or a resolution for its liquidation, administration, winding-
up or dissolution (otherwise than for the purposes of a solvent amalgamation or reconstruction), or has
an administrative or other receiver, manager, trustee, liquidator, administrator or similar officer
appointed over all or any substantial part of its assets, or enters into or proposes any composition or
arrangement with its creditors generally, or is subject to any analogous event or proceeding in any
applicable jurisdiction; or
(c) upon giving 30 calendar days written notice to the other.
6.2. Termination by either party in accordance with the rights contained in clause 6 shall be
without prejudice to any other rights or remedies of that party accrued prior to termination.
6.3. On termination for any reason:
(a) all rights granted to the Customer under this Contract shall cease;
(b) the Customer shall cease all activities authorised by this Contract;
(c) the Customer shall immediately pay to the Supplier any sums due to the Supplier under this
Contract; and
(d) the Customer shall immediately destroy or return to the Supplier (at the Suppliers option) all
copies of the Software then in its possession, custody or control and, in the case of destruction, certify
to the Supplier that it has done so.
7. FORCE MAJEURE
No party shall be liable to the other for any delay or non-performance of its obligations under this
Contract arising from any cause beyond its control including, without limitation, any of the following:
act of God, governmental act, war, fire, flood, explosion or civil commotion. For the avoidance of
doubt, nothing in clause 7 shall excuse the Customer from any payment obligations under this Contract.
8. CONFIDENTIALITY AND PUBLICITY
Each party shall, during the term of this Contract and thereafter, keep confidential all, and shall not use
for its own purposes nor without the prior written consent of the other disclose to any third party any,
information of a confidential nature (including, without limitation, trade secrets and information of
commercial value) which may become known to such party from the other party and which relates to
the other party or any of its group company, unless such information is public knowledge or already
known to such party at the time of disclosure, or subsequently becomes public knowledge other than by
breach of this Contract, or subsequently comes lawfully into the possession of such party from a third
party.
