URDU - VIEWS OF THE ISLAMIC SCHOLARS (FUQAHAA) ABOUT ANNULMENT OF NIKAH

ABSTRACT:

There are many deadly diseases which are considered as incurable by the medical experts. In the Holy
Quran and Sunnah there are no explicit statements about such diseases. However, in the Quran we find
a hint which elucidates that Plague can be considered a punishment of Allah. In one of the sayings of the
holy Prophet (), we find some points dealing with spreadable diseases. In some sayings, it is
mentioned that people should escape from leprosy. In another narration, it is mentioned that a person
who has got a contagious disease should not approach a healthy person. Narrations also point out that
there is no adwa. Adwa (contagion) refers to the spread of a disease from a sick person to a healthy
one. Scholars explain that these words of the Prophet are general in meaning, thus the Prophet ,
peace and blessings of Allah be upon him, mean that there is no contagion without the permission of
Allah as it can be understood in combination with other narrations on the topic. Due to infectious
diseases, matrimonial relations between husband and wife become unbearable in many situations. After
diagnoses of Aids, for example, life can become miserable for the other spouse. Islamic Law (Fiqh al-
Islami) allows, with certain conditions, to abrogate the contract of marriage (Nikah) if the situation
becomes too unbearable. There is a difference of opinion about the fuqahaa regarding the status of
marriage in case of disease and what is the recommended approach in such situations. In the current
paper, the views of Islamic scholars in relation to the contagious diseases and the annulment or
abrogation of Nikah have been discussed.

An annulment of marriage can be effected if the husband is effected with leprosy or any other illness
which makes living with him difficult.......from the above situation we understand that if the husband has
such a illness which makes it difficult to live with him (such as HIV/AIDS) then it will be permissible for
the wife to get her marriage annulled by a sharee council.xix

If there is any legal reason or dire necessity such as the spouse cannot live with harmony and there is no
hope to live a happy, life then it is permissible for a wife to ask al-khula or divorce. Know that one should
resort to divorce or al-Khula as a last solution after trying all the other means to bring the conjugal life to
its normal channels.xxi .
