CP-17-AD- 5 — 2017 £ : ADMINISTRATIVE ORDER NOW, this __AS” iy day of July, 2017, the Court having previously provided the Clerk Of Court, Brian K. Spencer, with numerous notifications as to deficiencies and unacceptable backlog in the filing, docketing, scanning and processing of Orders and documents within the Clerk of Courts Office; the Court having provided the Clerk of Court with the opportunity to provide a plan for addressing the problems which were occurring in that office and the Clerk of Court having failed and refused to do so; it is the ORDER of this Court that all Orders and filings with the Cierk of Court Office shall be completed within the time periods set forth in this Administrative Order. Failure to comply with the provisions of this Administrative Order shall result in Contempt Proceedings and Hearings before the Court. In order to assure and demonstrate compliance with this Administrative Order by the Clerk of Court Office, a copy of all Orders or documents delivered to the Clerk of Court Office for filing shall be immediately date and time stamped in order to evidence the date and time of receipt. Outstanding Incomplete Filing, Scanning, Docketing and Distribution — All outstanding filing, scanning, docketing and distribution of any Orders, dispositions and documents which have not been completed prior to the date of this ‘Administrative Order shall be filed, docketed, scanned and fully processed and distributed within 10 work days from the date of this Administrative Order. Bench Warrant Orders — All Orders directing the issuance of a Bench Warrant and the issuance of the Bench Warrant itself, shall be filed, docketed, scanned and fully processed and distributed within 24 hours from the time of receipt by the Clerk of Court Office, Excluded from said 24 hour caleulation shall be all weekends and holidays. ARD Orders and Dispositions — All ARD Orders or other dispositions of ARD cases shall be filed, docketed, scanned and fully processed and distributed within 10 calendar days of the date of the issuance of the Order or disposition. DUI Orders and Dispositions - Ali DUI Orders or other dispositions of Driving Under the Influence cases shall be filed, docketed, scanned and fully processed and distributed within 10 calendar days of the date of the issuance of the Order or. disposition. State Sentencing Orders — All Orders or dispositions that result in an individual being sentenced to a period of State incarceration shall be filed immediately upon- presentation to the Cletk of Court Office with three certified copies being immediately provided to the Court Administration representative, Within 48 hours from the time of delivery to the Clerk of Court Office of the Order or other disposition, said document shall be docketed, scanned and fully processed and- distributed including but not limited to the entry of all information necessary for the printing of a complete DC-300B such that the individual State packets necessary for transport might be completed. Sentencing Orders and Dispositions - All Sentencing Orders and dispositions, other than State Sentencing Orders noted above, shall be filed, docketed, scanned and fully processed and distributed within 5 work days from the time of receipt by” “the Clerk of Court Office Juvenile Orders and Dispositions - All Juvenile Orders and dispositions shall be filed, docketed, scanned and fully processed and distributed within 5 work days from the time of receipt by the Clerk of Court Office. Dependency Orders and Dispositions - All Dependency Orders and dispositions shall be filed, docketed, scanned and fully processed and distributed within 5 work days from the time of receipt by the Clerk of Court Office. Motions Court Orders and Indirect Criminal Contempt Orders - All Motions Court Orders and dispositions shall be filed, docketed, scanned and fully processed and distributed within 5 work days from the time of receipt by the Clerk of Court Office. Summary Appeal Orders and Dispositions — All Notices of Appeal from Summary Conviction shall be filed, docketed, scanned and fully processed and distributed immediately upon receipt by the Clerk of Court Office, All Summary Api | Orders and dispositions shall be filed, docketed, scanned and fully processed and distributed within 5 work days from the time of receipt by the Clerk of Court Office. Bail Orders — Bail Orders shall be filed, docketed, scanned and fully processed and distributed immediately upon receipt by the Clerk of Court Office. Notices of Appeal and Appeal Related Documents ~ All Notices of Appeal and any Appeal Related Documents shall be filed, docketed, scanned and fully processed and distributed immediately and completed that day upon receipt by the Clerk of Court Office. The Clerk of Court Office shall provide to the appropriate Judge a copy of all communications and Orders received by the Clerk of Court Office from any Appellate Court. Probation and Parole Orders and Other Probation Office Documents - All Probation and Parole Orders and other Probation Office Documents shall be filed, docketed, scanned and fully processed and distributed within 5 work days from the time of receipt by the Clerk of Court Office. Clearfield County Jail Orders and Miscellaneous Documents - All Clearfield County Jail Orders and miscellaneous documents shall be filed, docketed, scanned and fully processed and distributed within 5 work days from the time of receipt by the Clerk of Court Office. AQPC Statistics Docket Corrections - All AOPC Statistics Docket Corrections shall be fully processed and completed within 10 work days from the time of receipt by the Clerk of Court Office, iscellaneous Documents ~ Any other documents to be filed with the Clerk of Court Office that are not specifically covered by this Administrative Order shall be filed, docketed, scanned and fully processed and distributed within 10 work days from the time of receipt by the Clerk of Court Office.
