ABSTRACT:
There are different views about the fiqh status of Imam Tirmz. Some ulema claimed to associate
him with Imm Shafi, and believed that he was one of his follower, while others related him to
Imm Ahmad and Ishq while considering him to be a mujtahid muntasib to them. To some scholars,
he was a mujtahid mutlaq, whereas others believe that he was affirmed with ahl-ul-hads and
convinced about their methodology, and statements. By analyzing the Jame of Imm Tirmidh, we
see his personality emerging as a mujtahid mutlaq. It is evident that in his Jame, he has collected
Ahdes-al-Ahkm keeping in focus the fiqh principles and priorities. Some of these fiqh principles
include utilizing the nuss al Qurn and Sunnah of the messenger of Allah , consideration towards
health or strength of asnd, kasrat al wujh, ta'amul al-fuqah al-ummat, ta'amul and opinion of
aqrab ilal hads, taamal and the opinions of companions of the prophet . He has also used a
combination of these principles in his jurisprudential interpretation and analysis. The description of
these fiqh principles along with their examples from Abwbul tahrah to Abwbul janiz from the
Jame are explored in this article.
