RULES AND INSTRUCTIONS FOR ATP&JV CLASSES 2C & 2D


[SY 2017-2018]

1. These Rules shall be effective on Thursday, 10 AUGUST 2017.

2. Recitation and lecture on subject proper start also on 10 AUGUST 2017.


(a) The Course Outline (with Case Lists) will be used during the entire semester.
(b) When a case or item in the Course Outline is preceded with an x it means that it will not
be covered during the recitation.
(c) Only cases with a check mark and in bold letters will be taken up for recitation.
(d) Assignment for the 17 & 24 AUGUST 2017 Classes: Section I (Nature
and Object of Agency) 1 to 4 of the Outline.
3. Bases for Computing Final Grades in the Course: MID-TERM GRADE 30 %
RECITATION 40 %
FINAL EXAM GRADE 30 % 100%
Rationale for Weight:
(a) 30% weight for Midterm Exams because the coverage of the exam would be Agency & Trusts,
which is one-half of the coverage of the course.
(b) 40% weight for Recitation since it is expected that students study and participate every class
session for the lessons assigned.
(c) 30% weight for the Final Exams grade since the coverage will Partnerships & Joint Ventures,
which is the other half of the coverage of the course.
Before students take the Final Examinations, they will be shown their Mid-Term Exam grades and
Recitation grades, so they can individually determine exactly what they need to obtain in the Final Exams
to earn a desired final grade for the course.

4. Rules on Recitation
(a) Class cards are shuffled at the beginning of each class and sometimes during the session.
(b) If you are called and you are absent, you will receive a 60% for that supposed recitation.
(c) The only accepted excuse to remove a 60% recitation grade is illness to be evidenced by
a valid medical certificate, and a maximum of two (2) instances during the entire semester.
For other valid instances, the same should be covered by written explanations which must
be submitted immediately at the next meeting after the absence; and shall be considered
on their individual merits.
(d) You are encouraged to ask questions in class; you may also write down queries and place
them on the desk at the start of the session. There is no such thing as a stupid question in

5. Treatment of the Course


The course is intended not only to teach the basic principles and case-law on the Philippine
Laws on Agency, Trusts, Partnerships & Joint Ventures, but more importantly will be pursued as
a Methodology Class. The aim of the assignments, the recitations, and the exams is to
inculcate an intellectual discipline in the minds of the students for analysis, reflection, and
evaluation.
As a general rule, proper names, dates and places are not important in reciting the facts and
law of cases assigned, but more importantly the rationale and the principles behind the law and
ruling bear more weight. Present a simple story in class before tackling the legal issues. Facts
and law relating to other discipline of law, such as remedial law, except when necessary to
understand Sales principles, should not even be discussed during recitations.
It is the hope that at the end of the course, a student would have imbibed a mental discipline
in looking at facts, events, and provisions and principles, with a lawyer's or jurist's
circumspection of what is essential or practical which would be his or her main tool in the
profession.
