Its long since we last heard anyone talking about the rights of victim. Our law is absolutely jam-
packed via dealing with the issues of accused, their sufferings and their right towards justice. At
1985, the very first time when a beam of rays were directed towards the rights of victim and the
theory of victimology has been evolved. The general assembly of United Nations made a
declaration on basic principles of justice for victims of crimes also known as Magna Carta.
Series of recommendations were made by Justice Malimath Committee, but Indian Law fails to
enact victim oriented legislation for victims rights, however recently in 2008 made some
amendments in Crpc like Sec 2(wa), Sec 24(8), S. 156(3), Sec 157(1), Sec 357 A (clause 3 & 4).
In the view of this, author critically analyses the laws regarding rights of victims in post trial
process. How corrupt the system is and how the voice of victim is lost in this web. Further author
also discusses some plausible measures, suggestion to take a step further and let the victim
exercise their post-trial rights.
