Thanks for the info on gates. As for date of the Final EIS, the first internal review “Draft Final EIS”
(we call it a Preliminary Final EIS) was scheduled to be submitted January 14. However, there is at
least a 2-week delay to this date, and we will know more tomorrow after conference call with
(b) (6) Major issues developing as far as NEPA schedule goes are the discussions with Hidalgo
County on the retaining wall issue, cat holes, and the fact that the biological assessment/biological
opinion from USFWS is not complete. We cannot go forward with a Draft Final EIS until this stuff
gets resolved because, otherwise, we are spinning our wheels for nothing as this info is highly
subject to change.

When is the final EIS draft going to be submitted?

Up to now our main concern has been the design, construction and footprint of the proposed fence.

Right know we have 83 proposed gates – broken down by fence projects with GPS cords (the current
Draft EIS gate numbers are off ). Keep in mind that this number could increase or decrease as per
directives by D.C. If these numbers were to increase or decrease, how would this impact the EIS?

With regards to gates and gate designs - this is the response RGV obtained from (b) (6)
(Baker Engineer) yesterday.
Baker is tasked to design gates however the design will be completed as part
of the final engineering and final bid package. The only agreements I know
off on gates in RGV is the size so far. BP will get a chance to review the
gate design during the design phase and before final construction contract
award.
Until we see the design(s) will we be able to approach landowners to discuss issues pertaining to
access to the south side of the proposed projects.

Most gate locations were selected for operational needs by BP. During initial outreach efforts
landowner concerns were taken into consideration for access to the south side where applicable.
Based on these contacts we advised the landowners that we would propose gates at their requested
location(s), with the understanding that these gates requests might not go through.

We are currently preparing responses to comments on the Draft EIS and working toward the Final
EIS. We need to develop a general response to comments that question or ask about the use of
access gates along the proposed alignment. Can you tell me what the status of that effort is? Is
there any information yet about specific locations? Is the Sector actually speaking to land owners
about gate placement? Is there a target date by which you might have specific gate information?
Do you know how gate operation/responsibility would work? Would certain land owners who
need access receive keys? Thanks for any info you can provide.
