Abstract
The nations across the world are governed by different sets of laws. Sooner or later, there felt
a need to separate the power among the different institutions of the government. In order to
maintain the equilibrium of power among the different institutions of the government, the
powers are separated and divided so as to ensure that these powers fall in the realm of their
corresponded concerned institutions.
The pattern of separation of powers is dynamic in nature when observed in the wider aspect.
Thus the objective of this article is to comprehend the origin of the concept of separation of
power and to reconcile the diverse nature of separation of power in the different democratic
setups governed by the common law, civil law, religious law and mixed law.
