RESOLUTION NO. 264

WHEREAS, City Ordinance No. 018-08, also known as the Tarlac City Omnibus
Market Code of 2008, was enacted in order to support and strengthen the economy and
livelihood of the market stall occupants;

WHEREAS, Sec. 16 of Republic Act 7160, otherwise known as the Local Government
Code of 1991, provides that: Every LGU shall exercise the powers expressly granted, those
necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its
efficient and effective governance, and those which are essential to the promotion of the general
welfare. Within their respective territorial jurisdictions, LGUs shall ensure and support, among
other things, x x x enhance economic prosperity and social justice, x x x, and preserve the
comfort and convenience of their inhabitants.; (underscoring ours)

WHEREAS, Section 458(a)(2)(xii) of Republic Act No. 7160 states that: The
Sangguniang Panlungsod, as the legislative body of the city, shall enact ordinances, approve
resolutions, and appropriate funds for the general welfare of the city and its inhabitants pursuant
to Section 16 of the Code x x x and shall with the concurrence of at least two-thirds (2/3) of all
the Members of the Sangguniang Panlungsod, grant tax exemptions, incentives or reliefs to
entities engaged in community growth including industries, subject to the provisions of
Chapter 5, Title I, Book II of the same Code .; (underscoring ours)

WHEREAS, the Honorable City Mayor has favourably endorsed the amendment of
certain sections of City Ordinance No. 018-08, also known as the Tarlac City Omnibus Market
Code of 2008, in the interest of the market stall occupants and adapting the same to the present
situation in the city;

NOW, THEREFORE, on motion of Councilor Ana A. Aguas, Chairperson of the


Committee on Market and Slaughterhouse, duly seconded;

RESOLVED, that in the interest of public service and welfare, the Sangguniang
Panlungsod of Tarlac hereby promulgates and enacts:

AN ORDINANCE AMENDING CERTAIN SECTIONS OF CITY ORDINANCE


NO. 018-08, ALSO KNOWN AS THE TARLAC CITY OMNIBUS MARKET
CODE OF 2008

Be it ordained by authority of the Sangguniang Panlungsod of Tarlac that:

Section 1. Chapter 5, Section 20, Paragraph 2, Sub-paragraph Wet Goods Area of City
Ordinance No. 018-08, also known as the Tarlac City Omnibus Market Code of 2008 is
hereby amended to read as follows:

Section 3. Chapter 5, Section 20, Paragraph 4, Sub-paragraph a of the same Code shall
have a new Item which shall be identified as (v) and which shall read as follows:

v. Mezzanine Stalls shall refer to stalls above the ground floor stalls of the
Wet Goods Area and which shall be designated by the City Market
Authorities as such, having an area of a regular market stall.

Section 4. Chapter 5, Section 20, Paragraph 4, Sub-paragraph b of the same Code is


hereby amended to read as follows:

b. Food Stands refer to a permanent/temporary roofed enclosure located within


the Wet Goods Area within the City Public Market building where
cooked/prepared foods are served or sold.

Section 5. Chapter 5, Section 20, Paragraph 4, of the same Code shall have a new Sub-
paragraph which shall be identified as e and which shall read as:

e. Activity Center refers to the Main Lateral Area of the City Downtown Public
Market building where programs and activities may be held. Such programs
and activities shall be held with the permission from the City Mayor and
under the supervision of the City Market Authorities.

Section 6. Chapter 5, Section 22 of the same Code shall have a new Paragraph which shall
be identified as 3 and which shall read as:

3. Mayors Permit.
No market stallholder shall operate in the City Public Markets without securing
the necessary Mayors Permit. This permit shall be renewed every January of each
year.

The Mayors Permit and the Certificate/Letter of Award shall be conspicuously


posted within the premises of the market stall, and properly installed and placed at
such height that prevents its being removed or tampered.

Section 7. Chapter 5, Section 23 of the same Code shall have a new Paragraph which shall
be identified as 16 and which shall read as:

16. Coverage.

Regardless of the classification of the market stall, all rules and regulations that
may be adopted relative to the operation of the public market and the penalties
imposed therefore shall apply to all stallholders located within the City Public
Markets, particularly such acts which are deemed inimical to public welfare, public
order and safety, and public policy.

Section 8. Chapter 6, Section 24, Paragraph 4, of the same Code is hereby amended to read
as follows:

4. Market Stall Rental Fees.


This daily rental fee shall be charged upon and collected from any vendor,
ambulant or hawker concerned, for the continuing use or occupancy of any stall, food
stand, booth, or space in the City Public Markets, at the following rates.

Provided, That these rental rates shall increase at a simple escalation rate of two
percent (2%) every two (2) years. Provided finally, that the collection of new rental
fees for the Uptown Public Market shall be applied beginning January 2011.

Section 9. Chapter 8, Section 32 of the same Code is hereby amended to read as follows:

Section 32. Cancellation of Lease Right and Ejection.

Any market stallholder, his helper/s or his duly designated representative who fails to
pay the monthly or daily fees herein prescribed for three (3) consecutive months shall be
considered as abandonment and shall be enough grounds for the enforcement of forfeiture
proceedings on the stall he/she occupies.

Non-payment of other regulatory fees mandated by other laws or ordinances, or


violation of any provision of this Code shall be sufficient cause for the revocation of
his/her Contract of Lease and cancellation of his/her Certificate of Award, and his
ejection from the market stall so occupied. The revocation or cancellation of such lease
right maybe effected by the City Mayor upon recommendation of the CMA after
observance of due process.

Section 10. Authority of the Chief Executive.

The Honorable City Mayor is hereby given the authority to adopt such rules and
procedures as may be necessary to implement the provisions of this ordinance and to ensure
the attainment of the purpose and intent for which it is enacted, including but not limited to
the granting of amnesty on fees, charges, penalties, surcharges and interests, if any, on
delinquencies incurred prior to the approval of this ordinance;

Section 11. Applicability Clause All other matters not specifically provided in this
Ordinance shall be governed by the provisions of City Ordinance No. 018-08, Tarlac City
Omnibus Market Code of 2008, and other existing and applicable laws or ordinances.

Section 12. Effectivity Clause This Code shall take effect upon its approval and after
its publication on any local newspaper of general circulation in this city.

RESOLVED, FINALLY, that copies of this resolution be forwarded to the Hon. Gelacio
R. Manalang, City Mayor, and to the Honorable Members of the Sangguniang Panlalawigan of
Tarlac thru the Hon. Pearl Angeli E. Pacada, Vice Governor and Presiding Officer, for their
information and appropriate action.
