KAUFM._4 COUNTY PROBABLE CAUSE AFhsAVIT (ARREST WITHOUT WARRANT) On the afternoon of Sunday, October 29, 2017 personally appeared Deputy Sheriff Micah Wiser (3546) of the Kaufman County Sheriff's Office, A Peace Officer, who states under oath; On the afternoon of Sunday, October 29, 2017 I, Deputy Sheriff Micah Wiser (3546) of the Kaufman County Sheriff's Office, Arrested Freddie T. Gilbert Race/Sex: black/male DOB: January 31, 1984 In Kaufman County, Texas for the offense of Prohibited Substances in Correctional Facilities, a []misdemeanor DXjfelony based on the following facts: Affiant, Deputy Sheriff Micah Wiser (3546) of the Kaufman County Sheriff's Office, is employed by the Kaufman County Sheriff's Office as a deputy sheriff and assigned to the Patrol Division. Affiant has over 11 years of experience as a law enforcement officer with the Kaufman County Sheriff's Office, including positions in the Detention, Patrol, and Criminal Investigations Divisions. Furthermore, Affiant is licensed as both a jailer and as a peace officer by the Texas Commission on Law Enforcement, and has over 2,050 continuing education training hours accredited to him by that agency. Affiant holds an Associate of Arts Degree as a cum laude honors graduate from Collin College in McKinney, Collin County, Texas, as well as a high school diploma from Naaman Forest High School in Garland, Dallas County, Texas. During his law enforcement career, ‘Affiant has handled and been exposed to numerous controlled substances and medications, including marijuana. On the date of Sunday, October 29, 2017, Affiant, as ordered by his direct supervisor, Sergeant Keith Wheeler (3172) of the Kaufman County Sheriff's Office, transported a black male named Freddie T. Gilbert to the Kaufman County Law Enforcement Center afier he had been arrested by Deputy Sheriff Ashley Richeson (4196) of the Kaufman County Sherifi’s Office for the felony criminal offense of Evading Arrest or Detention, During the process of that arrest, Deputy Sheriff Richeson noted that Freddie was in possession of handguns and ammunition, and the circumstances surrounding that arrest indicated him in the death of a woman. Because of the circumstances detailed in the paragraph above, Affiant had detention personnel perform an unclothed search of Freddie's person to ensure that he was not in possession of any more handguns or ammunition cartridges. The unclothed search was performed inside of the male dressout room off of the booking area inside of the secured section of the facility. During the unelothed search of Freddie's person, Affiant observed two items fall out of Freddie's anal cavity. The first of the two items was a bag containing a green-colored, leafy substance that Affiant recognized as marijuana based upon its distinctive texture, coloring, and odor. Along with that item was a bag containing a white-colored susbtance that Affiant believed to be crack cocaine. Affiant, as an employee of the Kaufman County Sheriff's Office for over 11 years, had prior knowledge that the area where the unclothed search was performed was a part of the secured area of a county jail as defined by Section 1.07(a)(14)(A) of the Texas Penal Code. bbe 350. Affiant has over 11 years of experience as a law enforcement officer with the Kaufman County Sheriff's Office, including positions in the Detention, Patrol, and Criminal Investigations Divisions. On the morning of Sunday, October 29, 2017, Affiant was on duty when the Kaufman County Sherifi’s Office's Regional Dispatch Center dispatched a Deadly Conduct call for service in which it was reported that a person inside of a passenger car had discharged a firearm at person(s) inside of another motor vehicle. Deputy Sheriff Ashley Richeson (4196) of the Kaufman County Sheriff's Office was also on duty at that time and, via transmissions made over the radio system, reported that she had responded to the call for service. After the call for service was broadcasted, Affiant overheard Deputy Sheriff Richeson broadcast that she was searching for the suspect passenger car on Interstate Highway 20. ‘After a short while, it became apparent to Affiant from her radio transmissions that Deputy Sheriff Richeson had located the suspect passenger car after a person familiar with the incident had tuned on his or her emergency flashers to signal to her that he or she was traveling behind it on Interstate Highway 20. ‘Affiant overheard Deputy Sheriff Richeson broadcast that, after she had gotten the driver of the suspect passenger car to yield to her for a brief moment, the driver fled from her on the eastbound side of Interstate Highway 20. Via her radio transmissions, Deputy Sheriff Richeson reported that she pursued the suspect passenger car at speeds as high as. approximately 105 miles per hour before the driver crashed and came to a stop. At about 12:00 hours, Affiant responded to the scene of the crash and met with Deputy Sheriff Richeson. At that location, Deputy Sheriff Richeson turned over a black male named Freddie T. Gilbert to him and asked that he take him into custody for the criminal offense of Evading Am or Detention, as she had identified him _ the driver of the fleeing suspect passenger car. At that time, Affiant observed that Deputy Sheriff Richeson was in control of a marked Kaufman County Sheriff's Office Chevrolet Tahoe sport utility vehicle that featured the Kaufman County Sheriff's Office logo on each of its two front doors, as well as the word "SHERIFF" on each of its two front fenders.
