I. Legal Bases

A. R.A. 10533: Enhanced Basic Education Act of 2013


Sec. 2: Establishment of an educational system that is geared towards:
o Excellence
o Learning throughout life
o Competence to engage in work
o Coexistence with local and global communities
o The capability for critical thinking and
o The capability to transform others and ones self
Sec 4: Addition of two (2) years of senior high school education.

B. DepEd Order 30, s.2017: Guidelines for Work Immersion


Sec.1: Stipulates three reasons for work immersion:
o Familiarity with the work place
o Employment simulation
o Application of Competencies in Areas of Specialization
Sec.4: Enumerates students objectives for work immersion:
o Appreciate the importance and application of the principles
and theories learned in school;
o Enhance their technical knowledge and skills;
o Enrich their skills in communications and human relations; and
o Develop good work habits, attitudes, appreciation and respect
for work.
Sec. 10: Specifies work immersion venues; prescribes templates of
tasks/activities, and describes various models of immersion.

C. DepEd Order No. 40, s. 2012: DepEd Child Protection Policy


Sec. 1 mandates that schools be conducive to the education of children
wherein the best interest of the child shall be the paramount
consideration in all decisions and actions. It aims to ensure protection
from all forms of abuse and exploitation and reiterates zero tolerance
policy for any act of child abuse, exploitation, violence, discrimination,
bullying, and other forms of abuse.
Sec. 3-I defines child abuse as:

o Psychological or physical abuse, neglect, cruelty, sexual abuse
and emotional maltreatment;
o Any act by deeds or words which debases, degrades or
demeans the intrinsic worth and dignity of a child as a human
being;
o Unreasonable deprivation of the childs basic needs for
survival, such as food and shelter; or
o Failure to immediately give medical treatment to an injured
child resulting in serious impairment of his or her growth and
development or in the childs permanent incapacity or death.
Sec. 3-J defines discrimination against children as:
o An act of exclusion, distinction, restriction or preference which
is based on any ground such as age, ethnicity, sex, sexual
orientation and gender identity, language, religion, political or
other opinion and which has the purpose or effect of
nullifying or impairing the recognition, enjoyment, or exercises
by all persons, on an equal footing, of all rights and freedoms.
Sec. 3-K enumerates two forms of child exploitation:
o sexual exploitation which refers to the abuse of a position of
vulnerability, differential power, or trust, for sexual purposes.
o economic exploitation which refers to the use of the child in
work or other activities for the benefit of others through
production, distribution, or consumption.
Sec. 3-L cites violence against children committed in schools as:
o physical acts that inflict bodily or physical harm. It includes
assigning children to perform tasks which are hazardous to
their physical well-being;
o sexual acts that are sexual in nature such as rape, harassment,
lasciviousness, suggestive remarks, physical sexual attacks,
forced viewing of obscene publications or indecent shows,
forced indecent sexual acts and or the creation or distribution
of such filmed materials, or the use of coercion, inducements,
gifts, and other favours for sexual advances.
o psychological acts that cause mental or emotional suffering of
the child such as intimidation, harassment, stalking, damage to
property, humiliation, deduction or threat of deduction from
grades as form of punishment, and repeated verbal abuse.
Sec. 3-M defines bullyng as wilful aggressive behaviour that is directed
towards a particular victim who may be out-numbered, younger,
weak, with disability, less confident, or other vulnerable. It also
includes cyberbullying as a punishable offense.
Sec 3-O prohibits persons in authority from using corporal punishment
which refers to a kind of punishment or penalty imposed for an
alleged or actual offense, which is carried out or inflicted for the
purpose of discipline, training or control by a teacher, school
administrator, an adult, or any other child who has been given or has
assumed authority or responsibility for punishment or discipline. It
includes:

o Blows such as beating, kicking, hitting, slapping or lashing with
instruments such as a cane, a broom, stick, whip, or belt.
o Striking of childs face or head (no contact zone)
o Pulling hair, shaking, or twisting joints, cutting or piercing skin,
dragging, pushing or throwing of a child
o Forcing a child to perform physically painful or damaging acts
such as kneeling on stones, salt or pebbles
o Deprivation of physical needs
o Deliberate exposure to fire, ice, water, smoke, sunlight, rain,
pepper, alcohol, or forcing the child to swallow substances
o Tying up a child
o Confinement, imprisonment or deprivation of liberty
o Verbal abuse or assaults
o Forcing a child to wear a sign, undress or disrobe
o Permanent confiscation of personal property except when
those properties pose dangers himself or others

D. Other Applicable Laws


RA 7877, an Act Declaring Sexual Harassment Unlawful in the
Employment, Education or Training Environment, and for Other
Purposes
Articles 218 and 219 of the Family Code on the special parental
authority and responsibility of schools, administrators, and teachers
Section V of Memorandum of Agreement with Partners which
discusses the Nondisclosure Provision which treats all information as
confidential in nature and shall only be made available for the purpose
of training.
Section VI of the Memorandum of Agreement with Partners which
grants ownership of outputs to Partners.
Section VII (Other Provisions) of Memorandum of Agreement with
Partners that states that partners are not obliged to pay wage or salary
since no employer-employee relationship exists between students and
industry partners.

IV. Common Duties and Responsibilities of Immersion Partners
1. Assign a competent Immersion Coordinator from their side to liaise
with the school and supervise the students without prejudice to the
special parental authority of the school, its administrators and
teachers for the duration of the work immersion program so as to
ensure efficient implementation of all stages of the program.
2. Lend its expertise by making available its resident resource persons to
provide training to the students.
3. Allow students to be deployed to the different
sections/departments/project sites of the immersion venue.
4. Provide students with an orientation about their institution, its line of
business, and the work its employees do, and expose them to the
various stakeholders of the community in which they operate for the
students to get a holistic understanding of its business.
5. Make its workplace and facilities available to students and teachers,
and shall similarly take all necessary action to ensure the safety of
students within their areas of operation at all times.
6. Evaluate students performance in the immersion venue by
accomplishing provided evaluation tool.
7. Issue a Certificate of Completion to the student trainees upon
satisfactory compliance with all requirements of the program.
