INDIA is taking a giant leap towards the computer technology and e-commerce

through the means of public schemes like Adhar, Digital India and private
platforms as such Facebook, Whatsaap, Flipkart etc. This technological
dependence has made the human lives easier and swifter but also treacherous and
vulnerable. Because of absence of a proper legislative framework for the protection
of personal information, country is overburdened with tremendous quantity of
cases on Cyber-crimes, Data Stealing etc. This submission focuses on the
requirement of a strong legislative charter in order to appeal the overseas
investments in Indian markets which would boost the Indian Economy. While
dealing with the necessity of statutory law, the author will also attempt to throw
some light on other laws which are at present dealing with the Data Protection but
are ineffective and ambiguous. This submission shall also stress on the prerequisite
to safeguard the lives of citizen by recognizing the personal data protectibilty as
right to privacy under Article 21 of the INDIAN CONSTITUTION. This
submission shall also discuss the purpose, circumstances and extend where the
personal information can be disclosed. In the end this paper shall try to bring
forward the benefits of a comprehensive law on data protection for citizen,
society and commerce.
