NHAI/CO/03/2016 (NHAL/13083/CO/ 2015-16 dated 06.02.2016) (iii) Fee Rules'2008 as amended vide GSR 77(E) dated 16.12.2013, GSR O2(E) dated 29.12.2014, GSR 220(E) dated 23.03.2015, NHAI vide circular under reference (i) issued instructions to comply with the amendment to fee rules dated 16.12.2013 [GSR 778 (E}] interatia to charge 10 times applicable fee from the overloaded vehicles and to remove the excess load before the vehicle is allawed to cross the fee plaza. Vide subsequent amendment to the rules under MV Act the tolerance upto 5% in the gross vehicle weight and Safe axle weight was allowed. However several reference are being received at NHAI-HQ regarding non- implementation of the rules in its entirety. The matter was deliberated in the 312°" meeting of Executive Committee held on 31.07.2017 and followings have been decided: - (i) The penalty amount being received from the overloaded vehicles by the concessionaire may be regulated as per specific provisions of the respective Concession Agreement dated i.e. if the concession agreement provides for collecting next higher category rates for an overloaded vehicles, the difference amount (10 times applicable fee rate of next higher categories) shall be remitted /recovered to NHAl under applicable Change in Law and in case where the amended Fee Rules dated 16.12.2013 is part of the concession agreement, such amount may be retained by the Concessionaires. (i) In the meanwhile, all POS/ROs may be advised to strictly implement the provisions of the amended Fee Rule and the Contracter/Concessionaire should determine the overloaded vehiele through WIM/SWE installed at the Fee Plaza duly considering tolerance up to 5% as per amendment to MV Rules dated 07.01.2016. ‘Action should be initiated to install WIM/SWB at all Fee Plazas. 2. ALL PDs/ROs are therefore, requested to quickly act upon the above decisions. It ts also requested to expedite the installation of WIM/SWB at all the fee plazas under their jurisdiction. The guidelines regarding installation of WIM/SWB has already been issued vide NHAI policy circulars: Admn/Fin. (0144/2014) dated 11.09.2014 & (159/2015) dated 26.03.2015. Upgradation of all existing lanes at all toll plazas to Hybrid ETC lanes. 4.2 Deployment of Medium Speed Weigh-in-Motion (MSWIM) systems in all Hybrid ETC lanes and Static Weigh Bridges (SWB) as per the IHMCL directives in standalone operation (IHMCL approved specification in Clause-5.3.1(h) and Clause-5.3.4 is enclosed), 1.3 ETC Lane: Needs to be verified and ensured that all ETC lanes are equipped with MMSWIM with Model approved by W&M department upto 50 kmphr 1.4 For the existing PPP projects not having the provision of weight enfrocement systems in their Concession agreement is to apply for change of scope (COS) on priority basis within 10 days as per Policy Circular (Admn/Fin-144/2014). 4.5 For the PPP Projects for which CoS order already issued need to comply the specification approved by M/s.lHMCL strictly and need to take prior approval of source from RO to award the work. Concessionaires who have already installed WiMs / SWBs at their plaza will submit the specifications of their weight enforcement systems duly certified by IE / PD to this office within one month. 2. The NHAI has taken the matter of curbing of overloading on a priority basis and hence the implementation of the weight enforcement systems be complied with proactive initiative by all concessionaires and where required the pending Change of scope proposals by the respective operators towards weight enforcement may be submitted along with relevant approvals and documents. Specification: PQC Grade: M30 Baucheme Grade: Super Drying Agent 5.3.4 Providing Services of Static-Weigh-Bridge (SWB): In each direction of traffic, after the toll plaza, in a separate area having facility of parking of overloaded vehicles, a Static-Weigy-Bridge is required to be installed, for ensuring that an overloaded vehicle do not move further on the National Highway. As soon as a vehicle passes through the Weigh-ia-Motion system in the toll lane and is detected to be averloaded, the vehicle is directed (0 move towards the dasignated area after charging appropriate fee for entry of overloaded vehicle on the NH. The vehicle is weighed again on the SWB for confirmation of the Overload weight. ‘the overloaded vehicle is allowed to park in the designated area and unload some of the material to bring the load to the permitted level.
