Sub.: Implementation of daily order dtd. 12.09.2017 passed by APTEl in the appeals filed by
various Mobile Tower Companies against MYT tariff order dtd. 03.11.2016 (Case No. 48 of
2016).

This office has conveyed clear instructions vide letter reference no. 4 for implementation of
daily order dated 12.09.2017 passed by the Hon'ble APTEl. The instructions issued vide this office
reminder letter under reference :s is hereby modified as under.

It is instructed that if the mobile tower consumers having IT/ITES certificates or not, deposit
monthly bills as per Industrial tariff, then no coercive action such as disconnection, etc shall be
initiated. Further, before taking any coercive steps such as disconnection (in case of zero payments),
issue proper notice as per rules to the consumers.

In spite of the instruction and subsequent communications through e-mail, sms etc. several
instances have been reported to H.O where the field offices have acted in contravention of interim
order dated 12.09.2017 passed by the Hon'ble APTEL.

Further, it is again directed that the instructions shall be passed to field office upto Sub -
division level. Due to inaction on your part to follow the instructions, unwarranted contempt or
miscellaneous proceeding may be faced by the MSEDCL, where after the competent authority will be
constrained to fix personal responsibility.

Therefore you are, through this reminder instructed to follow the daily order (ref. no. 2) in true
letter and spirit.
