Worry and Guilt Plague Working


Parents During Back-to-School Season

There's the morning parent orientation at your child's school, which overlaps with your weekly
meeting at work. There are the half days designed to ease students back into the academic year, but
which leave parents either scrambling for child care or asking to work from home.
And that may be just the first week of school for working parents, who must juggle job duties with
parenting responsibilities most of the year—all while wrestling with the worry that colleagues and
managers will view them as less than dedicated to their jobs.

"Back-to-school season brings an array of challenges," said Alyssa Johnson, vice president of account
management for Waltham, Mass.-based Care@Work, which provides employers with benefit
programs to help workers care for children, seniors, pets and their homes. "New caregivers, new
schedules and new after-school programs all require a period of adjustment that working parents are
balancing with their responsibilities in the office."

Can or Should Employers Fire


Employees Who Participate in Hate
 
Groups?

When one of an employer's workers participates in a hate group's activities, such as the white
supremacist rally that occurred in Charlottesville, Va., on Aug. 12, what are the employer's rights
under the law to terminate that employee? One rally participant has lost his job after pictures of him
marching in the rally were posted on social media.

The answer is surprisingly unclear, according to management attorneys, who recommend a case-by-
case inquiry depending partly on the state where the worker is employed, how risk-averse the
company is and whether workplace policies have been violated.

Termination Fine Under Federal Law

No federal law would be violated in firing the worker, noted Michael Eastman, an attorney with the
Center for Workplace Compliance (formerly the Equal Employment Advisory Council) in Washington,
D.C.

Help Prevent Data Breaches

Shortly after she was fired from her job at the City of New Haven recently, a Connecticut woman reportedly
snuck back into her former office, copied data onto her personal thumb drive and erased the private health
records of 587 people from a government database.

This happened years after an employee terminated from Omega Engineering Inc. deleted all of the company's
programs, which cost the Bridgeport, N.J., organization $10 million in contracts and sales.

In this digital age, where data breaches happen mostly online, these examples serve as reminders to HR
professionals why policies should be in place to safeguard data not just physically but also virtually.

In the newly released 2017 Cost of Data Breach Study, conducted by IBM Security and the Ponemon Institute,
malicious insiders or criminals caused 47 percent of all breaches. "The average cost per record to resolve such
an attack was $156," the report revealed. "In contrast, system glitches cost $128 per record and human error
or negligence is $126 per record."

Managers must tread carefully, be aware of ADA and FMLA accommodations  

He's remarkably productive one week, then slacks off the next. She takes frequent and unexplained breaks.
He was once the first in the office but now drags in late. Periodically, you hear slurred speech and see an
unsteady gait, but never smell alcohol.

Health problems? A rough patch at home? Losing interest in the job?


It might be prescription drug abuse. But pinpointing such abuse, and then confronting employees and
deciding how to move forward, can be tricky.
"Drug addicts come in all shapes and sizes these days," said Tammy Strickling, executive director of Spring
Hill, Fla.-based Suncoast Rehabilitation Center. "There are those who honestly got into something they can't
now control, and they want help."
The mostly commonly abused prescription drugs fall into two classes: benzodiazepines, such as Xanax and
Valium; and opioids, such as oxycodone and hydrocodone.

Accommodating Workers with a


History of Substance Abuse

Employers don't have to accommodate any alcohol or illicit drug use in the workplace, but they must be careful
not to discriminate against workers with a history of substance abuse who are no longer using.

The Americans with Disabilities Act (ADA) protects workers from discrimination based on a qualifying
disability or a perceived disability—including alcoholism and past illegal drug use, explained Todd Wulffson, an
attorney with Carothers DiSante & Freudenberger in Orange County, Calif.

Therefore, employers should try to arrange a reasonable accommodation if, for example, an employee needs to
leave early for an Alcoholics Anonymous meeting, Wulffson explained.
