TERMS AND CONDITIONS

The following terms and conditions shall govern the PARTICIPANT’s use and occupancy of their booth for the
duration of the Blue Christmas Bazaar (the “Bazaar”):
1. DEFINITIONS – All references to the ORGANIZER shall pertain to Ateneo Graduate School of Business Student
Council. All references to the PARTICIPANT shall refer to the operator of the booth, his/her/its employees and/or
representatives. All references to the SITE shall refer to The Ateneo Professional School.

2. OPERATING HOURS—The PARTICIPANT shall keep their booths open during the designated bazaar operating
hours. The bazaar will be operating from 4:00pm on November 25, 2008 (Wednesday) to 7:00pm on December
5, 2008 (Saturday). The PARTICIPANT may commence booth operations only at the bazaar’s official opening
time. The ORGANIZER may, in its sole discretion, extend the bazaar operating hours to accommodate shoppers.
3. DELIVERIES—All deliveries of merchandise or goods to the SITE shall be made only at the areas designated by
the ORGANIZER. The PARTICIPANT shall be responsible for the delivery vehicles, their operators and delivery
personnel who, at all times shall abide by the rules and regulations promulgated by the ORGANIZER. The
PARTICIPANT shall furnish the ORGANIZER with the names of personnel making deliveries of goods or
merchandise at the SITE.
4. MERCHANDISE—The PARTICIPANT may only sell merchandise that has been pre-approved in writing by the
ORGANIZER. The PARTICIPANT hereby warrants that it shall not sell CDs/DVDs, pirated goods or
products/services considered illegal under Philippine Law.
(a) The ORGANIZER reserves the right to pull-out any merchandise that is not pre-approved by the
ORGANIZER, or those found by the ORGANIZER, in its sole discretion, to be offensive, inappropriate, or not in
keeping with the theme of the Bazaar. In the event of pullout of such merchandise, the ORGANIZER shall be
free from any liability to the PARTICIPANT for any damages of whatever nature.
5. ID /GATE PASS /WORK ACCESS PERMIT—The PARTICIPANT shall secure from the ORGANIZER the necessary
gate passes and work access permits for its personnel who shall construct or man the booths for the duration
of the Bazaar. The PARTICIPANT’s personnel shall be required to wear their identification/gate pass/work access
permits at all times during the Bazaar. Each booth shall have a maximum number of three (3) persons to serve
as manpower for the booth. Names of these persons shall be submitted to the ORGANIZER in advance or at
least five (5) days prior to event as requirement for the issuance of ID’s/gate passes/work access permits which
are to be claimed on-site during ingress.
6. BOOTH LAYOUT/ DISPLAYS – Each booth shall have an area of 2.5 feet x 5 feet. There will be about thirty-five
(35) booths that will be available for the said event.
(a) If the PARTICIPANT wishes to obtain a larger booth space, the PARTICIPANT may obtain an additional
booth to increase retail space. Corresponding fees for additional booth spaces shall apply. Each PARTICIPANT
may choose a booth space only among the choices given by the ORGANIZER.
(b) All booths shall be equipped with boundaries set on the floor. It is understood that the PARTICIPANT’s
display or merchandise shall not go beyond the boundaries of the allocated space. The PARTICIPANT may, at its
expense, install or use partitions for its booths, as well as construct and assemble its merchandise display
within its space allocation using any creative means necessary. No display shall exceed the height limit of eight
(8) feet.
7. SECURITY/ LIABILITY FOR LOSS OR DAMAGES – The SITE has its own roving security guards at the bazaar
area for the duration of the event. PARTICIPANT’s products may be left at the PARTICIPANT’s booth for overnight
storage. However, PARTICIPANT shall be solely responsible for the security of his/her/its booth and the
ORGANIZER shall not be held liable for any loss or damage to the booth or any goods or merchandise found
therein.
(a) The PARTICIPANT shall be liable to the ORGANIZER for any loss or damage to the SITE by reason of
fault or negligence by the PARTICIPANT. Any damage caused by the PARTICIPANT to any property within the
SITE is not under the liability of the ORGANIZER but of the PARTICIPANT. Such property includes floor, wall,
decorations, glass fixtures, window fixtures, decorative fixtures, light fixtures, tables, chairs, etc.
(b) Storage, sale or display of highly flammable or explosive goods/substances, installation of any
apparatus, machinery or equipment that may endanger the area of fire, are strictly prohibited within the
premises of the SITE.

8. CARE OF THE BOOTH—The PARTICIPANT shall keep his/her/its booth clean and free from any obnoxious odor.
Disposal of any trash or refuse shall be deposited only at the designated receptacles available. Smoking and
eating at the SITE is strictly prohibited.

9. INGRESS/ EGRESS- Ingress will be on November 25, 2009, Wednesday, at 10:00 am until 12:00 pm only.
Egress will be on December 5, 2008, at 7:00 pm until 9:00pm only. The PARTICIPANT shall be allowed to pull out
its goods, merchandise, and other effects from the SITE only after the close of the operating hours of the
Bazaar. The PARTICIPANT shall remove any and all merchandise, goods and effects, including display fixtures
from the SITE without damaging the SITE or any of its appurtenances. PARTICIPANTS who have not settled full
payment shall not be allowed to set up booths.
10. COMPLIANCE WITH RULES AND REGULATIONS—The PARTICIPANT shall, at all times comply with the rules
and regulations promulgated by the ORGANIZER, as well as the rules and regulations issued and implemented
by the SITE. The ORGANIZER reserves the right to dismiss any individual to leave the event premises, whether
guest or PARTICIPANT, who compromises the event with disruptive behavior, words and actions, which may
lead to disreputable conduct.
11. ASSIGNMENT / SUB-LEASE—The PARTICIPANT shall not, without the written consent of the ORGANIZER,
assign or sub-lease its rights to participate in the Bazaar. The sub-lessee shall also be required to undergo
product screening and shall follow the terms and conditions of this event. The ORGANIZER reserves the right to
refuse the entry of such sub-lessee or assignee of the PARTICIPANT.
12. REFUNDS—there shall be NO refund for payments settled between the PARTICIPANT and the ORGANIZER. In
case the SITE becomes unavailable for use due to any fortuitous event, including, but not only limited to cases
such as storms, earthquake, etc., where no fault may be attributable to the ORGANIZER, there shall be no
diminution of the agreed rental. In such case, the ORGANIZER shall declare a new schedule for the event.
13. OTHERS—All photos taken by the ORGANIZER during the event shall remain the property of AGSB Student
Council indefinitely. Such photos may be used for future marketing and promotional activities. The ORGANIZER
shall have full rights to use the brands/ names of the products and exhibitors of the bazaar in promotional
activities for the said event.

I hereby acknowledge that I have read and understood the above terms and conditions and I agree to be bound
by the same. I agree that any disobedience of any of the provisions stated above shall correspond to certain
sanctions deemed just by AGSB Student Council. I also acknowledge that my accomplishment of this
application and conformity to the terms and conditions does not automatically ensure my participation in the
Blue Christmas Bazaar

1. Cash Payments must be received on the ORIENTATION DAY which is scheduled on November 23, 2009
(Monday)

fax it to 02.5639479 local 16.
3. You will then receive a confirmation receipt through email, which you will be asked to bring upon ingress.
