COMPROMISE AGREEMENT

This Agreement executed this 23RD day of August, 2017 at Legazpi

City, by and between:

PSINSP ARKHEMEDES CRUZ GARCIA, Filipino, of legal age with

address at Lot 20, Block 3, Holiday Homes, Brgy Lag-on, Daet,
Camarines Norte, herein referred to as “1st Party”.

-and-

PO1 Joel Llamasares Tonga, Filipino, of legal age with address at

No. 103-13 Mabatag St., Brgy Sagpon, Daraga, Albay herein referred to
as “2nd Party”.

WITNESSETH: That -

WHEREAS, the 1st Party PSINSP GARCIA and 2nd Party PO1 Tonga
have been involved in an Administrative case wherein the 1st Party was
the respondent and the 2nd party was the complaining witness.

WHEREAS, the parties after having resolved the instant case before
PCSUPT ANTONIO NILAYAN GARDIOLA, Regional Director PRO5
entered into an agreement to continue the needed medication of the 2nd
party.

NOW THEREFORE, in consideration of the foregoing and the further

covenants hereinafter set forth, the parties agree as follows:

1. That as soon as the decision of the instant case is released

capacitating the 1st party to apply for a salary loan he will again
accompany the 2nd party to a ortho-surgeon and seek advice if surgery is
needed, and if needed will shoulder the cost of the same.

2. That in case the 1st party refuse or fail to perform this

promise the 2nd party will again have the prerogative to file appropriate
action after the necessary demand was made and declined.

3. The foregoing covenants are not contrary to law, morals, or

public policy and the parties bind themselves to comply strictly with their
undertakings.
 IN WITNESS WHEREOF, parties herein affixed their signatures on
the date and place above written.
