Waiver of Rights To Property
MEMORANDUM OF AGREEMENT
This Memorandum of Agreement executed this ____ day of January 2018 in Batangas City,
Province of Batangas, by and among:
MRS. JOSEFA D. BUSTAMANTE of legal age, with postal address at San Isidro West, Batangas
City, O, herein referred to as the FIRST PARTY; and
JoJo Dela Cruz, Adel Dela Cruz, Myrna Rafael, all of legal age, married, with postal address at
Ibaba West (Pob.) Calapan City,Oriental Mindoro, herein referred to as the SECOND PARTIES;
WITNESSETH: THAT
WHEREAS, the FIRST PARTY is the daughter of Mr. Jospeh Bustamante (deceased), the
registered claimant/occupant of a parcel of land situated in the City of Batangas, Province of
Batangas, bounded and described as follows:
"IT IS HEREBY CERTIFIED that certain land situated in the City of Batangas
Prov.of Batangas, Phillippines…..bounded and described as follows:
Beginning at a point marked “1” on plan, being S.86 deg. 47’W., 445.59 m. from
B.B.M. No. 2, Cad-104,
WHEREAS the SECOND PARTIES are the in-laws, niece and nephews of the FIRST PARTY
and they acknowledge the latter’s legal ownership of the above mentioned property by virtue of
inheritance from FIRST PARTY’s parent who was the registered claimant/ occupant of above
mentioned property;
WHEREAS, the above mentioned property was previously occupied and used by the parents and
the FIRST PARTY when they are still living;
WHEREAS, as an act of pure generosity and gratitude on the part of both parties’ parents, the
above mentioned property is given to their daughter Josefa Bustamante, and in keeping her
promise to her deceased parents, she is willing to have the title directly transferred in the name
of her son, Randy Bustamante, of legal age, married and with postal address at Brgy. Pallocan
Batangas City.
WHEREAS, the FIRST PARTY paid the gross amount of the land costs Sixty Nine Thousand
Two Hundred Pesos (P39, 200) as evidenced by OR No. dated November 26, 2007 and by a
Certification from City Treasury Department .
Whereas, the FIRST PARTY likewise paid the Tax Declaration of said property as evidenced by
OR. No. ____, dated January 21, 2017.
NOW, THEREFORE, in consideration of the foregoing premises, the parties hereby agreed as
follows:
That the SECOND PARTY hereby relinquishes all its rights in the above mentioned property in
favor of the FIRST PARTY.
That the SECOND PARTY hereby irrevocably, freely and voluntarily release and forever
discharge the FIRST PARTY his heirs and assigns, from any and all manner of action, sum of
money, damages, liability, responsibility, obligation, claims and demands whatsoever in law or
equity, which they had, now have, or may have against each other, including, but not limited to,
actual, moral, exemplary and all other damages or causes of action provided for under the law,
all of which claims or causes of action by these presents the parties hereby abandon and waive.
That this agreement shall not in any way be construed as an admission on the part of the FIRST
PARTY of any fault, negligence or liability, of whatever kind and nature, in connection with this
MEMORANDUM OF AGREEMENT and WAIVER OF RIGHTS TO PROPERTY.
IN WITNESS WHEREOF, the parties have hereunto set their hand this ____ day of January
2018 in Batangas City.

instrument, consisting of three (3)pages, including this page; and that they executed the foregoing
instrument as their own free and voluntary act and deed, for themselves and/or in behalf of their
respective principals.
