RE: The food establishment located in Lethbridge, Alberta and municipaly described as: Burger King #2502, 1950 3 Avenue South. WHEREAS |, an Executive Officer of Alberta Health Services, have inspected the above noted premises pursuant to the provisions of the Public Health Act, RSA 2000, c. P-37, as amended; AND WHEREAS such inspection disclosed that the following conditions exist in and about the above noted premises which are or may become injurious or dangerous to the public health or which might hinder in any manner the prevention or suppression of disease, namely: ‘a. Pravious flooding in basement room from a busted pipe causing significant damage and mess has stil not been completely finished with clean up or repair. b. Evidence of sleepinglliving accommodations for foreign workers found in another room. ©. Astore room full of excess unused equipment in basement. AND WHEREAS such inspection disclosed that the following breaches of the Public Health Act and the Food Regulation, Alberta Regulation 31/2006 and the Food Retail and Foodservices Code exist in and about the above noted premises, namely: a. Previous flooding in basement room from a busted pipe causing significant damage and mess has stil not been completely finished with clean up ot repair. This is in violation of section 17(1) (a) of the Food Regulation, AR 31/2006 which states that: An ‘operator must ensure that, before operation af the commercial food estabkshment ‘commences, the commercial food establishment is of sound construction and in a good state of repar. b. Evidence of sleeping/living accommodations for foreign workers found in another room. This is. in violation of section 17(1) (4) of the Food Regulation, AR 31/2006 which states ‘that: An operator must ensure that, before operation of the commercial food ‘establishment commences, has all ts {ood handling areas separated from living quarters and from other areas where activities are carried out that are incompatible with ‘the safe and sanitary handling of food. c. Astore room full of excess. unused equipment in basement, which is in contravention of Alberta Food Regulations, Section 21(1) which states “The commercial food ‘establishment and any surrounding area, premises, or facilities supporting the ‘commercial food establishment must be kept free of pests and any condition that may lead to the harbouring or breeding of pests”. NOW THEREFORE, | hereby ORDER and DIRECT: 1. That the Owner immediately undertake and diligently pursue the completion of the following work in and about the above noted premises, namely: . Finish deanup of flooded room in the basement and finish repair. b. Remove excess equipment and tidy the store room up to allow proper inspection and discourage harboring of pests. 2. The work referred to in paragraph 1 shall be completed by a. Finish cleanup of flooded room by February 10, 2018 b. Removal of all mattresses and associated furnishing and no longer allow individuals to stay/live/sleep in the restaurant premises.by January 17, 2018. c. Removal and tidying of small storage room by February 10, 2018. ‘The above conditions were noted at the time of inspection and may not necessarily reflect all deficiencies.
