CASE NUMBER: 49G24-1801-F6-003049 FILED: 1/26/2018

AFFIDAVIT
FOR PROBABLE CAUSE
STATE OF INDIANA, COUNTY OF MARION, SS:

Det. Sgt. William Carter swears (affirms) that:

On 01-24-2018 at approximately 11:45 p.m. Officer Rebecca Knowles of Indianapolis Animal Care and Services
was dispatched to 2207 N. Kenyon to check the welfare of a dog. IMPD Officer Adam Perkins was at the location
investigating an accidental shooting and observed a dog that appeared to be injured. Upon Officer Knowles arrival
she found a small female pit bull puppy inside of the residence. Officer Knowles observed that the dog had what
appeared to be a broken leg on the left front leg of the dog. Further examination showed there was a break in the
skin and the bone was possibly pushed through the skin of the dog's leg. Officer Knowles then transported the dog
to Noah's Animal Hospital for treatment. The original investigation at the location was the accidental self-inflicted
shooting of a 20 year old female under PD18008475. I met with Detective Julie Dutriex who stated that she met
with the 20-year old victim of the shooting, Brooklyn Powers at Eskenazi Hospital. Brooklyn identified her
boyfriend as the individual who had injured the dog.

At approximately 3:00 p.m. I went to Eskenazi Hosptial where I found Brooklyn Powers being treated in the
Emergency Room for the gunshot wound to her leg. I informed Brooklyn that I was investigating the injuries to the
dog that was found at her residence. Brooklyn identified the dog as 4 month old "Rain" who was a female pit bull
that belonged to her. She stated that she had been living at the location with another female and her boyfriend of 6
months, Lemontrae Bible. When I asked how the dog was injured she stated that the dog was injured by her
boyfriend who she observed, kicking, punching and then beat the dog with an X-Box game system. Brooklyn stated
that this happened sometime last week and that she had sent a text to her sister when it had happened. I was later
presented with the text message by Holly Brand, who was the mother to Brooklyn, that was dated January
19th. Brooklyn stated that Lemontrae had become angry when he was trying to make the dog sit and told her he was
making the dog mind. Brooklyn stated that a few days after this incident, Lemontrae informed her that he was going
to pull one of the dog's teeth that had been broken or damaged during the beating on January 19th. She stated that
she then went into the bathroom and shut the door because she didn't want to see him pull the tooth. After the
incident Lemontrae showed her the tooth that he had pulled out of the dog's mouth. I asked Brooklyn why she
hadn't called anyone to help the dog or take the dog for veterinary care and she stated that she was in fear of
Lemontrae.

At approximately 4:00 p.m. I went to Noah's Animal Hospital at 6136 Crawfordsville Rd to check on the condition
of the dog in this case. Upon arrival I met with the veterinary staff who took me to a recovery kennel where I
observed a small puppy. The dog was sedated and had a plaster cast on its left front leg. I was shown the X-rays for
the dog and learned that the dog had a fracture to its frontal lobe of the skull. The dog was being referred to a
neurologist for further evaluation.

At approximately 7:00 p.m. I met Brooklyn and she did sign a surrender of the dog to Animal Care and Services.

All of the above events did occur in Marion County State of Indiana.

I swear (affirm), under penalty of perjury as specified by IC 35-44-2-1, that the foregoing representations are true.

/s/ William Carter
