Notes
iv As described in Contract
vi This is the date, or are the dates, of execution of the Contract (or, if no separate
contract was entered into, the dates of the documents making up the offer and its
unqualified acceptance constituting the contract)
vii Under SBC/Q or AQ or XQ/Scot the due date for interim payments is as set out
under clause 4.9.1
viii See endnote 7 above. This date is important as under this form of contract, if this
certificate is issued later than 5 days after the relevant due date (as defined in
clause 4.9.1), the Contractor is entitled to give an Interim Payment Notice (or his
pre-existing Interim Application, if made, becomes an Interim Payment Notice)
and the sum stated as due in that Interim Payment Notice becomes the sum
due (subject to the Employer, or his agent acting on his behalf (Architect, QS or
Employer’s Representative), issuing a Pay Less Notice under clause 4.13)
ix This will normally be defined in Contract. It is safest to enter “As per Contract”
or quote the relevant provision within the Contract. However if date is entered
make sure it is the correct date (Contract will normally take precedence over
contract administration document). For SBC/Q or AQ or XQ/Scot the entry
should be “14 days from the due date”. As long as the Interim Certificate is issued
validly and timeously that will be the case. However clause 4.12.4 provides that
where, as noted in endnote 8 above, the Contractor has given an Interim Payment
Notice, because no Interim Certificate has been issued timeously, then the final
date for payment is postponed by the same number of days as the number of days

after the expiry of the 5 day period referred to in clause 4.10.1 that the Interim
Payment Notice is given
x The Gross valuation should, amongst other things, reflect the value of the Works
and Materials properly on site not more than 7 days before the due date (see
clause 4.16 for details)
xiii Clause 4.10.1 states that the certificate must state the sum due and the basis
upon which that sum has been calculated. This Certificate has been drafted for
use with interim payments calculated in accordance with clause 4.9.2 of the
Contract Conditions, if stage payments are to be used then another form of
interim payment certificate should be used.
