Subsection (b) of Public Duty
Any person who, except in self-defense, places another person in reasonable fear of harm,
or any person who attempts to cause harm to another.
Any person who commits an assault upon another person with a deadly weapon or
instrument, not including a firearm.
(1) without consent, detains or arrests another person for an extended period of time.
(2) without consent, restricts one's freedom of movement from another person for an
extended period of time.
(3) for the purpose of holding that individual ransom of any kind.
(1) unlawfully attempts to kill another person or cause life-threatening harm to another
person with premeditated actions.
(2) through criminal accident, negligence, or in the "heat of passion", causes severe or life-
threatening bodily harm to another person.
(a) Any person who commits murder associated with the following shall be classed as first-
degree murder:
(1) Using a destructive device or explosive, a weapon of mass destruction, poison, or metal
piercing ammunition
(5) Arson
(6) Robbery
(7) Burglary
(8) Carjacking
(10) Kidnapping
(11) Mayhem
(12) Torture
(13) Rape
(14) Unlawful Acts of Sodomy
(b) Any person who commits murder willfully but without malice or premeditation shall be
classed as second-degree murder.
(c) Any person who commits murder under the following shall be classed as capital murder:
(2) The murder of a state-employed person such as a police officer, firefighter or public
official;
(3) The murder of another because of their race, color, religion, etc.;
(b) Involuntary—in the commission of an unlawful act, not amounting to a felony; or in the
commission of a lawful act which might produce death, in an unlawful manner, or without due
caution and circumspection. This subdivision shall not apply to acts committed in the driving
of a vehicle.
(1) commits an assault for the purpose of sexual arousal, gratification, or abuse.
(1) willfully causes or permits any child to suffer or allows thereon unjustifiable physical pain
or mental suffering.
(2) having the care or custody of any child causes the person or health of that child to be
injured beyond reason or placed in a situation whereby their health may be endangered.
(a) Severe abuse and negligence—Any person who, having care of custody of any child,
acts or refuses to act resulting in injuries causing permanent and severe disability or death.
Any person who causes damage recklessly by fire or explosion to property such as land,
vehicles or buildings, whether or not that person owns said property.
(a) Intentional—Any person who commits any act of arson with malice aforethought.
(b) Negligent—Any person who, without malice aforethought, commits an act of arson.
(a) Burglary—Any person who commits the act of breaking and entering with the intent to
steal goods.
459 PC and 459(a) PC are both felonies, punishable by up to six years in a state
penitentiary.
(1) toolkits;
(4) screwdrivers;
(5) crowbars;
(6) lockpicks.
(a) Petty Theft—the theft of items not exceeding the cumulative value of $2,000.
(b) Theft—the theft of items above the cumulative value of $2,000 but not exceeding
$10,000.
(c) Grand Theft—the theft of items above the cumulative value of $10,000.
A lottery is any scheme for the disposal or distribution of property by chance, among persons
who have paid or promised to pay any valuable consideration for the chance of obtaining
such property or a portion of it, or for any share or any interest in such property, upon any
agreement, understanding, or expectation that it is to be distributed or disposed of by lot or
chance, whether called a lottery, raffle, or gift enterprise, or by whatever name the same may
be known.
67 PC. Bribery
(a) Any person who gives or attempts to give money, items or service to a state or
municipally employed person in exchange for preferential treatment.
(b) Any state or municipally employed person who willingly and knowingly accepts money,
items or services in exchange for preferential treatment.
67(a) PC and 67(b) PC are felonies punishable by up to 4 years of imprisonment in a state
penitentiary.
(1) smuggles non-citizens into the state without proper visas and authorization or;
(2) restricts one's liberty through fear, intimidation or threat of danger for forced labor or sex
trafficking, or other forced activities.
This charge shall only be issued by a judge or appropriate staff member of the court.
92 PC. Corruption
Any person who commits an act of corruption:
(a) exposes their naked body or genitalia on public property or in the public area of a private
building.
(b) exposes their naked body or genitalia on private property without the permission of the
property owner.
374.4. Littering
Any person who ignores publicly posted notices of waste containers by dumping waste or
other items in a non-designated area, container, or in a public place.
(b) Any person willfully or knowingly inciting a riot or attempting to incite a riot.
404(a) PC, "participating in a riot", may be an infraction punishable by a fine not exceeding
$5,000, or a misdemeanor punishable by up to 1 year of imprisonment in county jail.
(1) uses systematic threats or actions against the public good to cause fear and intimidation
on a grand scale.
(2) commits an attack or threatens an attack on major public or private facilities, such as
office complexes, stadiums, public transportation systems, bridges, or other such structures.
This charge can only be issued at the order of a city's respective District Attorney.
Violations that may result in an automatic seven (7) day suspension of your driver's
license include:
Any person who, whilst operating a vehicle on land, sea or in the air, including the use of a
bicycle, willfully flees or otherwise attempts to elude or avoid a pursuing police officer who
communicate, through auditory means such as sirens, or through visual means such as the
lights on a police vehicle, their request to pull over or stop.
2800.2 VC. Reckless Evasion—Any person who eludes/evades a peace officer operating a
vehicle in an extremely dangerous or reckless manner.
20002(a) VC with Injury—Any person committing a Hit and Run which causes injuries to
another person.
(1) demonstrates careless or general disregard to safety whilst operating a vehicle or;
(2) meanders between lanes of traffic erratically with disregard to safety or;
(1) In residential areas and Greater Metropolitan, the speed limit shall be 30 miles per hour.
(2) In commercial and business districts, the speed limit shall be 45 miles per hour, except in
Greater Metropolitan areas.
(3) In rural districts and sparsely populated areas, and on highways and freeways, the speed
limit shall be 60 miles per hour.
22350 VC is an infraction punishable by a fine not exceeding:
(1) In a manner that obstructs a lane of traffic and prevents the appropriate flow of traffic.
(5) In a manner that obstructs more than two thirds of a sidewalk or pedestrian pathway.
(10) On railroad tracks or within range of being struck by a railroad car or train.
(13) In a clearly marked disabled parking zone without proper permits, or without reasonable
cause.
$2,000 and/or impoundment for 24 hours for the third, and subsequent, offenses.
Any federal, state or municipal agency or department that requires glazed, protective or
darkened materials for the purposes of security, public safety or law enforcement shall be
exempt only for side windows and rear windows.
$1,000 and impoundment for 24 hours for the second, and subsequent, offence.
12951(a) VC is an infraction punishable by a fine not exceeding $1,000 on the first offense
and a misdemeanor punishable by up to 6-months of imprisonment in county jail on following
offenses.
23221 VC is an infraction punishable by a fine not exceeding $2,000 on the first offense.
23152(a) VC Driving Under the Influence of Drugs—Any person who operates a motor
vehicle while under the influence of any drug that might affect motor function, perception or
coordination.
38025 VC is a infraction punishable by a fine not to exceed $500 for the first offense (1 week
impound), $750 for the second offense (two week impound), and $1,000 for the third offense
(one month impound).
21716 VC is a infraction punishable by a fine not to exceed $250 for the first offense (3 day
impound), $500 for the second offense (one week impound), and $750 for the third offense
(two week impound).
5200 VC is a infraction punishable by a fine not to exceed $250 for the first offense (3 day
impound), $500 for the second offense (one week impound), and $750 for the third offense
(two week impound).
23109 is a non stackable charge and can not be combined with other moving violation
infractions.
26100(a) PC with Injuries—Any person who commits a drive-by shooting and injures
another person.
26500(a) PC Sale of Unregistered Firearms—Any person who willfully and knowingly sells,
or attempts to sell, an unregistered firearm to another person.
