CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This Contract of Lease, made and entered into by and between:

Vilma G. Santos, of legal age, Filipino, and with postal address at B-12 L-29 Dela Costa Homes 4
San Jose Del Monte City, Bulacan, hereinafter referred to as the LESSOR:

-AND-

___________________________of legal age, Filipino, and with postal address at ____________

______________________________, hereinafter referred to as LESSEE;

-WITNESSETH-

Whereas, the LESSOR, is the owner of the property (house and land) located at Block 6 Lot 28
Ciudad Nuevo Phase 2 Brgy Timalan, Naic, Cavite, hereinafter referred to as the LEASED PREMISES.

Whereas, THE LESSEE desires to lease the LEASED PREMISES and the LESSOR is willing to lease
the same unto the LESSEE, subject to the terms and conditions contained herein.

NOW, THEREFORE, the LESSOR has let and by these presents does hereby let and lease unto the
LESSEE the LEASED PREMISES and the LESSEE hereby accepts the same by way of lease subject to the
following terms and conditions.

1. PERIOD OF LEASE – the period of lease shall be up to ___________ and shall be


automatically renewed for one (1) year in the absence of a notice of termination.

2. RENTAL – the parties to this Lease Agreement do hereby agree that rental of the LEASED
PREMISES shall be TWO THOUSAND (Php2000.00) PESOS, Philippine Currency, per month,
net of withholding tax, value added tax or any other tax, fee, stamp or obligation required to
be paid on the property.

3. MANNER OF PAYMENT – the LESSEE shall pay the LESSOR as follows:


a. GUARANTEE DEPOSIT of SIX THOUSAND (Php6000.00) PESOS as follows:
1. Php 4000 – to serve as a guaranty deposit for the faithful performance of its
obligations under this Contract of Lease and to answer for unpaid bills (water,
electric) and / or damages and the LEASED PREMISES. The balance shall
refunded to the LESSEE no later than Sixty (60) days after return of the LEASED
PREMISES to the LESSOR, subject to accounting of unpaid bills or damage to the
property as the case may be.
2. Php2000 – as Advance Payment upon delivery of the unit, in which case the
LESSEE has agreed to pay the LESSOR twelve monthly payments of two
thousand pesos (Php 2000) every 28th day of the month.

4. WATER, ELECTRIC, CABLE, PHONE AND ASSOCIATION DUES ETC. – All utility expenses are to
the account of the LESSEE. The LESSEE shall present to the LESSOR, the official receipts as
evidence of payments of utility bills on the last month of the LESSEE’s occupancy.

5. The PREMISES shall be used and devoted solely for residential purposes. Flammable and
combustible materials are not allowed to be stored in any part of the premises. The LESSEE
hereby warrants that the premises shall be used only for residential purposes.
In the same manner, The LESSEE shall not use or utilize the PREMISES for any unlawful
or immoral purpose. The LESSEE shall see to it that no nuisance in whatever form and manner
shall be caused by it and / or those acting under it. Should there be any, the LESSEE shall be
liable for any and/ or all consequence.

6. SANITATION AND REPAIRS


The LESSEE shall, at her expense, maintain the least premise in clean sanitary condition;
garbage disposal is the LESSEE’s responsibility. Without the written consent of the LESSOR;
The LESSEE shall never attempt to make any alteration, additions and improvements on the
leased premise. Beautification of rented premises such as repainting of wall shall be done on
account of LESSEE and shall never be done without the written consent of the LESSOR.

7. RETURN OF THE PREMISES


Upon expiration of the period of lease the LESSEE shall peacefully vacate the leased premise
and return possession thereof to the LESSOR. He must see to it that the leased premise is in
its good original condition as when the LESSER turned it over the LESSEE.

8. ABANDONEMENT
In case of abandonment of the leased premise of the LESSEE before the expiration of the
leased contract, the LESSOR shall have the right to enter leased premise, without being
liable to persecution, to take hold of whatever property of the LESSEE found inside and to
sell the same, the proceeds which will be applied to any arrears in rental.

9. THIRD PARTY LIABILITY


The LESSEE during his occupancy of the least premise shall hold the LESSOR free and
harmless of any damages, liabilities or responsibilities to any person or property, arising out
of consequences of the use of leased premise by the LESSEE, his agents domestic helps and
guests.

10. RENEWAL OF CONTRACT


The LESSEE shall put in writing his intention to renew the lease contract for another year
one month before the expiry of the existing contract.

11. BREACH
In the event of breach of any of the conditions of the leased premise by any of the parties,
the aggrieved party may, in addition to the right granted to him by the law, collect
reasonable attorney’s fee including all other related expenses.
