A. Your Taxi policy

This policy document, your schedule and your certificate of motor insurance are all part of your
motor policy. Please read those carefully to avoid misunderstanding and keep them in a safe place.

This document gives you the details of what this policy does and does not cover. It also contains
information about our helplines and how to make a claim.

The information you have given us forms part of your policy and you must tell us as soon as
possible of any changes to the information you have provided.

In return for paying your premium, we will provide you the cover shown in your schedule under
the terms and conditions of this policy document, within the policy territories and during the
period of insurance. Any changes made during the period of insurance will be treated as a
continuation of this policy.

Our provision of insurance under this policy is conditional upon all persons who seek to benefit
under this policy observing and fulfilling the terms, provisions, conditions and clauses of this policy
that apply to them.

Please note: as you are not the legal owner or registered keeper of the insured vehicle, all financial
settlements relating to the insured vehicle will be made to and negotiated with the legal owner.

B. Definitions

Whenever the following words or phrases appear in bold in this document they have the meaning
shown below:
Certificate of motor insurance: a document which is legal evidence of your insurance and which
forms part of this document, and which must be read together with this policy
Driving license: a license to drive the insured vehicle including all necessary taxi and private hire
car licenses. The licenses to operate a vehicle must be issued in the UK or another Member State
of the European Union, the Isle of Man or the Channel Islands
Drover: refers to Drover Limited, 422 Kingsland Road, London, E8 4AA, who arrange and manage
this insurance. Drover is an Appointed Representative of Ambant Underwriting Services Limited and
authorised and regulated by the Financial Conduct Authority under reference number 724843.

Ambant Underwriting Services Limited is authorised and regulated by the Financial Conduct
Authority and registered under reference number 597301.

Economic sanction: any sanction, prohibition or restriction under United Nations resolutions or the
trade or economic sanctions, laws or regulations of the European Union, United Kingdom or United
States of America (economic sanctions of the United States of America only apply insofar as they
do not violate European or local legal regulations)
Endorsement: a change in the terms of your insurance policy which replaces or amends the terms
and conditions of your insurance policy and is printed on, or issued with, the schedule or a revised
schedule
Equipment: additional or supplementary parts of your vehicle that are not directly connected to its
function as a vehicle, these include audio equipment, multi-media equipment, communication
equipment and satellite navigation equipment, providing they are permanently fitted to Your
insured vehicle and have no independent power source unless it is a child safety seat. Child safety
seats are only covered under Section C2 of this policy
Excess: the amount you are required to pay towards each claim under this policy and as stated in
your schedule
Hazardous Goods: the term Hazardous Goods means those goods covered by the following
regulations:
• The Carriage of Dangerous Goods and Use of Transportable Pressure Equipment Regulations 2009
• The Carriage of Dangerous Goods and Use of Transportable Pressure Equipment Regulations
(Northern Ireland 2010)
• The ‘Approved List of Dangerous Substances’ as published by the Health and Safety Executive or
any re-enactment or replacement of such regulations and any other legislation of similar intent
(including subsequent legislation) if applicable.
Hire car: a vehicle insured under this policy that is manufactured to carry up to 8 passengers
(excluding the driver) and licenced for the carriage of passengers for hire or reward.
Malicious act: an act sufficient to be deemed wilful or malicious if you were aware that what you
were about to do risked damage of the kind that gave rise to the claim, or you did not care whether
there was such risk or not

Market value: means the trade list price of the insured vehicle (excluding equipment) at the time of
loss or damage. If the policyholder has no access to trade list prices at the time of loss or damage
then the market value will be the current retail price of the insured vehicle (including VAT if
applicable). Either values are limited by the original purchase price.

Period of insurance: the period of time covered by this insurance (as shown in the schedule or
until cancelled) and any further period we accept your premium for and which aligns with the
duration of your rental agreement between you and Drover

Policy: means the following documents:


• This policy wording
• The schedule
• The certificate of motor insurance
Policy territories: the UK, the Isle of Man and the Channel Islands
Road: any place which is defined as a road for the purpose of the Road Traffic Acts

Road Traffic Acts: any acts, laws or regulations, which govern the driving or use of any motor vehicle
in the UK, the Channel Islands and the Isle of Man

Schedule: the document showing the vehicle(s) we are insuring and the cover which applies

Terrorism: an activity including but not limited to the use of force or violence and /or life-threatening
act by an individual or a group of persons or an organisation whether acting alone or on behalf of or
in connection with any organisation, with the intention of coercing, intimidating or influencing either
an individual person, the civilian population or the government of any country or an act deemed by
any law enforcement body to be an act of Terrorism. We allege that by reason of this definition any
loss or damage is covered only up to a specified limit, the burden of proving to the contrary shall be
upon you. In the event that any part of the limitation in respect of Terrorism is found to be invalid
or unenforceable, the remainder shall remain in full force and effect.
Theft: taking or attempted taking of your vehicle or of equipment from your vehicle without
your consent.
Third party: any individual other than you

Vehicle(s): any car(s), estate car(s) or utility car(s) or other vehicles specified in the schedule of your
policy or listed in the current certificate of motor insurance which is a passenger carrying motor
vehicle with no more than 8 seats (excluding the driver) with a gross vehicle weight of 3.5 tonnes or
less that is covered under this policy. The insured vehicle does not include any vehicle registered
and taxed elsewhere than in the UK, the Isle of Man or the Channel Islands.
We/ us / our: means the insurer underwriting this policy; Great Lakes SE. Great Lakes Insurance SE
is a German insurance company with its headquarters at Königinstraße 107, 80802 Munich.
Registered with the commercial register of the local court of Munich under number: HRB 230378

UK Branch office: Plantation Place, 30 Fenchurch Street, London, EC3M 3AJ

Great Lakes Insurance SE UK Branch is authorized by the Bundesanstalt für

We may also refer to Broker Direct when they handle claims on our behalf as well as Drover who
arrange and manage this insurance policy on our behalf

United Kingdom: means England, Scotland, Wales, and Northern Ireland

You: the person named as ‘the policyholder’ in the schedule, any certificate of motor
insurance or renewal notice applying to this insurance and any person listed as insured to
drive in the schedule attached to this policy

C. Your Cover
Section C1 Liability to third parties

Driving or using your vehicle


We will cover you for all the amounts you may be legally liable to pay a third party for or as
a result of an accident during the period of insurance arising from the maintenance,
operation or use of an insured vehicle or while you are loading and unloading your vehicle
and which causes:

1. death or injury to another person (including a passenger); or


2. physical damage to another person’s property for each claim or series of claims arising from
one accident or occurrence which is caused during the period of insurance.
We will also indemnify:

• Passengers - any passenger whilst travelling in, getting into or out of the insured
vehicle whether for payment or otherwise

• Principals - any principal of yours provided that you would have been entitled to
indemnity if the claim had been made against you and you have arranged for the
conduct and control of all claims to be vested in us

• Any person listed in your certificate of motor insurance as insured person to drive as
though separate policies had been issued in individual names provided they hold the
required driving licenses

Limits of indemnity to property damage


The maximum liability for claims arising from one accident or occurrence including cost and
expenses is £2,000,000 for any one claim or claims arising out of one accident.

Legal personal representatives


After the death of anyone who is covered by this insurance, we will deal with any claim made
against that person’s estate, as long as the claim is covered by this insurance.

Legal fees, costs and expenses


If they arise from a claim under this policy section against you:
• solicitor’s costs if anyone we insure is represented at a coroner’s inquest, fatal
accident inquiry or court of summary jurisdiction;
• reasonable costs for legal services to defend anyone we insure against any
prosecution arising from any death; and
• all other legal costs and expenses we agree to

Duty of care – driving at work, legal costs
Subject to our prior written approval we will pay:
1. your legal fees and expenses incurred with our written consent for defending proceedings
including appeals;
2. costs of prosecution awarded against you arising from any health and safety inquiry
or criminal proceedings for any breach of the:

• Health and Safety at Work Act 1974;

• Health and Safety at Work (Northern Ireland) order 1978;

• Corporate Manslaughter and Corporate Homicide Act 2007

• Any other equivalent legislation applicable in any other policy territories

Limits of indemnity to duty of care


We will not pay:
1. Unless the proceedings relate to an actual or alleged act, omission or accident you
committed during the period of insurance within the policy territories
2. Unless the proceedings relate to an actual or alleged act, omission or accident arising
from the ownership, possession or use by or on behalf of you of any vehicle in
circumstances where compulsory insurance or security is required by the Road Traffic
Acts;
3. In respect of proceedings which result from any deliberate act or omission by you;

The most we will pay in respect of such legal fees, expenses and costs is:
1. Health and Safety at Work Act 1974; Health and Safety at Work (Northern Ireland) order
1978: £1,000,000.
2. Corporate Manslaughter and Corporate Homicide Act 2007: £1,000,000
3. Any other relevant legislation applicable in the policy territories: £1,000,000.

Providing that:

• We can negotiate any claim on your behalf


• Any legal representative will be appointed by us and will represent you according to our
standard terms of appointment. The appointed legal representative must co-operate fully with
us at all times
• We will have direct contact with the appointed legal representative
• You must co-operate fully with us and with the appointed representative and must keep us up
to date with the progress of the claim
• You must give the appointed legal representative any instructions that we ask for.
• You must tell the appointed legal representative to have legal costs taxed or audited if we ask
you to

• You must take every step to recover legal costs that we have to pay and must pay us any legal
costs that are recovered
• If an appointed legal representative refuses to continue acting for you with good reason, or if
you dismiss an appointed legal representative without good reason, the cover we provide for
legal fees, costs and expenses will end at once unless we agree to appoint another legal
representative and we may also terminate your policy as a whole
• If you do not give suitable instructions to an appointed legal representative, our cover will end
at once
Indemnity to principals
As far as is necessary to meet the requirements of any agreement or contract entered into
by you for the performance of work, we will insure the Principal at your request, provided
the principal complies with the terms and conditions of this policy in so far as they can
apply.

Exclusions to Section C1

This section of your policy does not cover the following:

1. The policy excess


2. Loss of, or damage to any premises belonging to or occupied by you, any other
property owned by you or in your custody or control or any property or load being
conveyed by the insured vehicle

3. Death of or bodily injury to any person arising out of and in the course of their
employment by you or by any other person claiming under this insurance unless we
must provide cover under the Road Traffic Acts or any other applicable legislation

4. Death, bodily injury to any person or damage to property caused or arising


beyond the limits of any carriageway or thoroughfare in connection with:
• the bringing of any load to any commercial vehicle for loading on to;
• the taking away of the load from any commercial vehicle after it has been unloaded; by
any person other than the driver or attendant of such vehicle
5. Death, bodily injury to any person or damage to property caused as a result of
plant covered by this policy being used as a tool of trade

6. Loss, damage or liability to a third party which arises when any person not listed as
insured to drive any of the insured vehicles under this policy has control or custody
of your vehicle for profit purposes and does not hold the necessary driving license
unless a license is not required by the Road Traffic Acts

7. Loss, damage or liability to a third party which arises due to the actions of any
passenger unless their actions are required by the Road Traffic Acts

8. Any person who is aware the driver of the insured vehicle does not hold the relevant
driving license to use it for the purpose for which it is being used

9. Any liability arising while your vehicle is being used in or on any part of an airport or
aerodrome which is used for
• aircraft take-off or landing
• aircraft parking including service roads
• ground equipment parking areas
except where we need to provide the minimum insurance required by the Road Traffic
Acts
10. Any liability, except where we need to provide the minimum insurance required by
the Road Traffic Acts, for claims for death, injury, illness, loss or damage to property
arising directly or indirectly from pollution or contamination unless caused by a
sudden identifiable unintended and unexpected event.
This exclusion only:
a. relates to contamination or pollution caused directly or indirectly by any substance,
liquid, vapour or gas leaking or being released; and
b. includes contamination or pollution of any building or other structure, water, land or the
air.

We will not pay for claims arising directly or indirectly from contamination or pollution
where it is caused by any substance, liquid, vapor or gas being deliberately released or
leaks or from your direct actions.

Section C2 Loss of or damage to your vehicle

We will cover you for loss of or damage to your vehicle and any insured equipment
which occurs during the period of insurance and is caused by accidental or malicious
acts, fire, lightning, explosion, theft or attempted theft or taking your vehicle away
without your permission subject to the applicable excesses and exclusions.
Repairs
If damage to your vehicle or any insured equipment is covered by this insurance contact
Broker Direct immediately at the contact details above in Section A for advice and
assistance about repairs.
If your vehicle cannot be driven safely you may authorise reasonable and necessary repairs
without previously obtaining consent providing that you notify Broker Direct immediately.

Recovery and re-delivery


We will also cover you for the recovery and re-delivery of the insured vehicle.

If your vehicle is disabled by loss or damage, we will bear any reasonable costs of protecting
and removing the vehicle to the nearest competent repairer.
Once repaired we will pay any reasonable cost of redelivery to you provided you are
domiciled within the policy territories and any re-delivery to you has been authorised by
the owner of the vehicle.
Do not attempt to move the vehicle yourself if this could increase the damage. If
unnecessary damage is caused as a result of your attempts to move your vehicle we will
not pay any extra cost arising from that damage.
Windscreen damage
You may claim for damage to your vehicle’s windscreen or windows and for any bodywork
scratched by broken glass from the window or windscreen.
You will only have to pay the first £100 of each claim (or amount shown on the schedule) if
the windscreen cannot be repaired and will need to be replaced. There is a limit on the cost
of windscreen damage of £1000.
No excess will apply if the windscreen can be repaired instead of replaced.
Write-Off
If the cost of repairs to your vehicle is higher than the market value of the vehicle we will
not pay or consent to any repairs and instead we will offer you a cash settlement as
compensation based on the market value of the insured vehicle at the time of damage.
The insurance for this vehicle will end when you accept that offer in writing and we are then
entitled to possession and ownership of the insured vehicle.
If requested you must send us the vehicle registration document (V5C), Ministry of
Transport (MOT) certificate or any equivalent certifications issued within the policy
territories, vehicle purchase receipt, all keys and any other relevant documentation before
we can agree any settlement.
If there is any outstanding loan on the vehicle or if it is a leased vehicle or on contract hire
we may pay the relevant owner first. If the market value is less than the amount you owe
them you may have to pay them the balance.
New for old vehicle replacement
We will, subject to your consent and availability in the policy territories, provide you with a
new replacement vehicle of the same manufacture and model if the insured vehicle has
been owned by you since new and during the period of one year from the date of its first
registration and it is either:
• Lost by theft and not recovered within 28 days of the date on which the theft was first
reported to Broker Direct or
• Damaged to an extent greater than 50% of its market or trade list price (including any
applicable taxes) at the time of damage, provided any damage caused is covered by this
policy
We will then own the vehicle that was the subject of the claim.
If any insured vehicle has been the subject of a hire purchase or any type of leasing
agreement we may require the consent of the relevant owner as well.

Loss / Theft cover
If an insured vehicle or any insured equipment has been lost or stolen while you have
rented it, you need to contact Broker Direct immediately as well as the relevant authorities.
We will settle these claims directly with the legal owner of the insured vehicle but may
contact you to assist with the claims handling.
Medical expenses
We will pay up to £500 for medical expenses of you or anyone who is injured while they
are in your vehicle as a result of an accident involving your vehicle.
You will not have to pay an excess for any claim related to medical expenses under this
section.
Exclusions to Section D2

This section of your policy does not cover the following:

1. The policy excess

2. Death of or injury to the driver or any person in charge of any insured vehicle unless
we are required to provide cover under the Road Traffic Acts

3. An amount as compensation for you not being able to use your vehicle (including the
cost of hiring another vehicle)

4. Wear, tear and depreciation


5. Failures, breakdowns or breakages of mechanical, electrical, electronic or computer
equipment
6. The vehicle ’s value reducing, including loss of value as a result of damage, whether repaired
or not
7. Repairs or replacements which improve the condition of the vehicle
8. Damage to tyres, unless caused by an accident to your vehicle
9. Damage due to liquid freezing in the cooling system, unless you have taken reasonable
precautions as laid down by the vehicle manufacturer’s instructions

10. Loss resulting from repossessing the vehicle and returning it to its rightful owner
11. Loss or damage caused by any government, public or local authority confiscating or
destroying any insured vehicle
12. Loss of or damage to your vehicle or its insured equipment by theft or attempted theft or
an unauthorised person taking and driving your vehicle if:
a. it has been left unlocked;
b. it has been left with the ignition key and/or other removable ignition device in or on the
insured vehicle
c. it has been left with the windows, roof panel or the roof of a convertible vehicle open; or
reasonable precautions have not been taken to protect it
13. Any loss of fuel

14. The costs for replacement locks, keys or electronic systems as a result of damage to or loss
or theft of the insureds vehicle’s keys.
15. Windscreen damage, if the damage was caused to sun roofs, roof panels, lights or reflectors
whether glass or plastic
D. Your Excess
You will be liable to pay the excess amount shown below or as indicated on the schedule
for your vehicle sustaining loss or damage arising from any claim covered by this policy
unless stated otherwise in this policy or your schedule.
For vehicles valued less than £40,000 at the time of loss if you are aged:
1. 21 to 24 years or if you have held a driving license for less than 12 months irrespective of
your age at the time of loss £1,000
2. 25 years or over £ 500

For vehicles valued £40,000 or more at the time of loss if you are aged:

1. 21 to 24 years or if you have held a driving license for less than 12 months irrespective of your
age at the time of loss £2,5000
2. 25 years or over £ 2,000

Excess irrespective of the vehicle’s value:

For claims resulting from fire or theft: £500


For any windscreen damage that cannot be repaired: £100

For Medical expenses (Section C2): £0

E. General Exclusions
These general exclusions apply to the whole insurance policy.
Your insurance does not cover:

1. Any liability, loss or damage arising while any vehicle covered by this insurance is being:
a. Used for a purpose which the vehicle is not hired and insured for in accordance with the
rental agreement between you and Drover and this policy;
b. Driven by or is in the charge of anyone who is not mentioned in the certificate of
motor insurance as a person entitled to drive or who is excluded by an
endorsement unless your vehicle was stolen or taken without your permission;
c. Driven by anyone (including you) who you know is disqualified from driving, has
never held a driving licence to drive the vehicle, or is prevented by law from having
a driving licence (unless they do not need a licence by law);
d. Driven by anyone who is contravening local authority licencing regulations in
respect of public hire or private hire vehicle s
e. Using your vehicle on any race track or circuit
f. Used to carry any persons or load which is more than it was constructed to
carry and more than the specified maximum capacity
2. Any loss or damage arising from any wilful or malicious act by you or any member of your
family or by a person lawfully using the vehicle
3. Any liability, loss or damage that is also covered by any other insurance.
4. Any liability you have accepted under an agreement or contract unless you would have had
that liability anyway
5. Liquidated damages or any indemnity under any penalty clause
6. Any result of war, invasion, act of foreign enemy, hostilities (whether war is
declared or not), civil war, rebellion, revolution, or military or usurped power
(except where we need to provide cover to meet the minimum insurance
required by the applicable law).
7. Direct or indirect loss, damage or liability caused by, contributed to or arising from:
a. earthquake;
b. riot or civil war
Unless we are legally required to provide cover ionizing radiation or contamination
from any radioactive nuclear fuel, or from any nuclear waste from burning nuclear
fuel;
c. The radioactive, toxic, explosive, or other dangerous property of any explosive
nuclear plant or any part of it;
d. pressure waves caused by aircraft and other flying objects
e. any liability in respect of claims arising directly or indirectly out of or caused by or in
connection with the transportation, storage, loading or unloading of hazardous goods
(including but not limited to chemicals, explosives, gases and flammable liquids)
8. Any use of this vehicle outside the policy territories

9. Death, injury, loss or damage directly or indirectly arising as a result of a deliberate act
caused by you except so far as is necessary to comply with the laws relating to
compulsory insurance of motor vehicles in any policy territory to which your policy
applies.
10. Any proceedings brought against you or judgment passed in any court outside the
policy territories
11. Any damages arising out of the use of a trailer attached to or towed by your vehicle

11. Any damage that is covered another policy


12. Any claim for the contents of your vehicle including your personal belongings apart from the
equipment insured under this policy
13. Any claims if you were under the influence of drink, drugs or any other substance with would
be considered an offence under the relevant law applicable to driving the vehicles unless we
are required to do so by the Road Traffic Acts
14. Any liability arising directly or indirectly from acts of terrorism, except where we need to
provide the minimum insurance required by the Road Traffic Acts
15. Us providing cover or any other benefit under this policy if we are prevented from
doing so by any economic sanction
16. The usage of any vehicle for haulage purposes

17. Any loss or damage from loading or unloading your vehicle

F. General Conditions
These conditions apply to all sections of this policy. If you do not comply with these
conditions, we may:
• Cancel this policy

• Refuse to pay any claims under this policy in parts or in whole or reduce any payment
under this policy
• Vary the premium and terms of your contract
• Recover from you any sums that we have already paid in respect of the claim that were
not due under the terms and conditions of this policy
Please note if we cancel this policy due to non-compliance with the terms and
conditions of this policy you will
• Have no cover under the policy from the date of the termination and
• Not be entitled to any refund of premium
1. Your obligations

We will only provide the cover described in this policy if:


a. Anyone claiming protection has met all the conditions in this policy and the schedule
attaching to it and;
b. The information you or someone you authorised to act on your behalf has
provided to us is correct and complete to the best of your knowledge;
c. You have taken all reasonable steps to prevent any loss of or damage to your
vehicle;
d. You must let us examine your vehicle at any reasonable time;

e. You maintain your vehicle in roadworthy condition and comply with all statutory
regulations and vehicle licensing authority regulations regarding its use, road
worthiness and condition for the duration of this policy;
f. The information you have provided when making any claim under this policy is
correct to the best of your knowledge
2. Fair presentation and notification of changes

You must make a fair presentation of the risk to us at inception, renewal and variation
of the policy. We may avoid the policy and refuse to pay any claims where any failure
to make a fair presentation is deliberate or reckless; or of such other nature that, if
you had made a fair presentation, we would not have issued the policy.
If we void the policy on these grounds, we will return the premium paid by you
unless the failure to make a fair presentation is deliberate or reckless in which case
no premium will be refunded.

If we would have issued the policy on different terms had you made a fair
presentation, we will not avoid the policy (except where the failure is deliberate or
reckless) but we may instead:
• continue to provide cover under the appropriate section on the same terms
• restrict the cover provided by the relevant section

• impose additional terms
• alter the premium
• cancel the section

You need to notify us if there is any change in circumstances or to the material facts
previously disclosed by you to us whenever changes are made at your request and
at each renewal.

If you fail to notify us of any such change, we may at our absolute discretion:

• treat the appropriate section and the policy as if it had come to an end as at
the date of the alteration of the risk returning a proportionate amount of the
premium for the unexpired period of insurance if we would have cancelled the
section and the policy had we known of the increase in risk
• treat the section and the policy as if it had contained such terms other than
relating to premium or other restrictions from the date of change in risk as we
would have applied had we known of the increase in risk
• reduce proportionately the amount paid or payable on any claim the proportion
for which we are liable being calculated by comparing the premium actually
charged as a percentage of the premium which we would have charged had we
known of the increase in risk
Below are some examples of the changes you should tell us about, please be aware
that this list is not exhaustive:
• A change of vehicle
• All changes you or anyone else make to the vehicle if these change
the vehicle from the manufacturer’s standard specification (whether
the changes are mechanical or cosmetic)
• A change of your address if you are the policyholder or a change of
address where the vehicle is kept
• Details of any motoring conviction resulting in a driving
disqualification or any penalty points on your driving licence
• Details of illnesses if you suffer from a notifiable condition not notified to DVLA
or any condition for which DVLA have restricted the licence
If you are unsure if a change in your circumstances should be reported to us or not
please contact the relevant phone number given under Section A for support.
3. Claims notification and claims settlement
1. After any loss, damage or accident you must report the claim to Broker Direct
within 24 hours or as soon as possible regardless of fault. You must also give
them any information and help that they may ask for.
2. Any theft, attempted theft, malicious damage to your vehicle or any insured
equipment or unauthorised use of your vehicle must be reported to the
police. Please state your crime reference number to Broker Direct when you
notify them of your claim.
3. You must send every communication about a claim, including any writ or

summons to Broker Direct without delay and unanswered. You must also tell
them if you know about any potential or future prosecution, coroner’s inquest
or fatal accident inquiry involving anyone covered by this insurance.
4. You must not admit to, negotiate on or refuse any claim to any third party
unless you have written permission from Broker Direct.
5. You must let us examine your vehicle at any reasonable time.
6. You must supply the details we need of any vehicles covered by this insurance
for the purposes of the Motor Insurance Database (MID).
7. You must co-operate with us on any matter which affects this policy.
8. If there are a number of claims for property damage arising out of any one
cause, we may, at any time, pay you up to the maximum amount payable
under the liability to third parties section. We will deduct from this amount
any amounts we have already paid as compensation. On paying this amount,
we will not pay for any further claims for the duration of this policy.
9. We will pay any legal costs and expenses incurred with our consent, up to this
point in time.
4. Subrogation

We can take over, conduct, defend or settle any claim; and take proceedings, at our own
expense and for our own benefit, to recover any payment we have made under this policy.
We can instruct solicitors of our choice to act for you in any civil or criminal claim and we
will have full control over any legal proceedings brought against a third party.
We will take this action in your name or in the name of anyone else covered by this
insurance.

5. Fraud

If you or anyone acting on your behalf under this policy makes any false statement when
taking out this policy or any false or fraudulent claim by

• making an exaggerated claim


• supporting a claim by false or fraudulent documents, devices or statements
whether or not the claim is itself genuine
• making a claim for loss or damage which you or anyone acting on your
behalf deliberately caused
We may refuse to settle the claim, in parts or in whole and recover any sums
we already paid in respect of that claim.
We may also notify you that we will be treating this policy as having
terminated with effect from the date of any fraudulent acts set out above.
If we terminate your policy, you will have no cover under the policy from the
date of the termination and not be entitled to any refund of premium.
If any fraud or fraudulent act has been committed by or on behalf of an
insured driver under this policy and not by or on behalf of you any
consequences for fraud or fraudulent acts will only extend to that driver alone
and not the policy as a whole.

6. Our right to recovery

The cover we provide in this policy fulfils all relevant requirements of the Road Traffic Acts
and to the extent more limited cover is provided by any provisions under this policy the
minimum cover under the Road Traffic Acts will apply.

If under any law of any of the policy territories we must settle a claim for which we would
otherwise not provide cover, we may recover any payment from you or from the person
who the claim was made against.

7. Other insurance

If at the time of a claim under this policy there is another insurance policy in force which
covers you for the same loss, we will only settle our share of the claim or we may seek a
recovery of some or all of our costs form the other insurer.

You must give us any help we may reasonably need to assist us with our recovery. In the
event of a claim you may be asked to provide details of any other insurance contract that
might apply to this claim.

If you have separate insurance cover for losses which are not insured under this policy, you
must inform us about any settlements you receive which are connected to any claim under
this policy. You must also tell us about any claim your other insurers bring for recover of
sums paid by them.

If an insured driver is covered by other insurance for claims by third parties, no settlement
for those claims will be made under this policy.

8. Duration of policy and payment of premium

The policy premium is payable in advance as part of the rental fees agreed with Drover
and in the amount of and for the duration of the rental period.

Your premium is based on the information you supplied at the start of the insurance
and when it is renewed. If you have failed to provide us with complete and accurate
information, this could lead to your claim being denied or the insurance not being
valid.

Unless cancelled we will provide cover under this policy for the duration of the rental
period.

9. Termination of your policy

Other than where we terminate this policy in accordance with general conditions no.
2 and / or no. 5 apply, this policy can only be terminated by you if the rental agreement
between you and Drover is terminated and you have returned the vehicle insured
under this policy to Drover or according to Drover’s instructions.

If the rental agreement is terminated the cover provided by this policy is likewise terminated. If you
have paid the premium for the full duration of the rental period, we will refund any premium on a
pro rata basis provided no claim has been made. If there has been a claim under this policy, no
refund will be given.

G. Legal Information
Data Protection

Your privacy is very important to us. Any information you disclose to us will be safeguarded
and treated with utmost care and in compliance with the Data Protection Act 1998. By
accepting your insurance policy, you consent to us and our agents processing the
information we may hold about you is for the purposes of providing insurance and handling
claims, and to process sensitive personal data about you where this is necessary. We may
also use it for statistical analyses to improve our product services to you. To arrange and
manage your insurance may mean we have to give some details to third parties involved in
providing insurance cover. These may include insurance companies, third party claims
adjusters, fraud detection and prevention services, credit reference agencies, reinsurance
companies and insurance regulatory authorities. Where sensitive personal information
such as medical history or criminal convictions or other as defined by the Data Protection
Act 1998, relates to anyone other than you, you must obtain the explicit consent of the
person to whom the information relates to in order to disclose such information to us and
its use by us as set out above. You have the right to apply for a copy of your information
(for which we may charge a small fee) and have any inaccuracies corrected.

Apart from managing your policy we will use your personal information to:

Prevent and detect fraud:

Fraudulent claims are a serious problem for insurers and honest policyholders. When you
apply for insurance and when you make a claim we will perform checks to detect fraud and
money laundering.

If false or inaccurate information is provided and fraud is identified, details will be passed
to fraud prevention agencies. Law enforcement agencies may access and use this
information. We and other organisations may also access and use this information to
prevent fraud and money laundering, for example, when:
1. Checking details on proposals and claims
2. Checking details on applications for credit facilities
3. We and other organisations may access and use from other countries the
information recorded by fraud prevention agencies

We may also share information about your with the third parties listed above to prevent
fraudulent claims and in particular with the Claims and Underwriting Exchange Register, run
by Insurance Database Services Ltd (IDS Ltd) and the Motor Insurance Anti-Fraud and Theft
Register, run by the Association of British Insurers (ABI). The aim is to help us to check
information provided and also to prevent fraudulent claims. We may search these registers
when we deal with your request for insurance. Under the conditions of your policy, you
must tell us about any incident (such as an accident or theft) which may or may not give
rise to a claim. When you tell us about an incident we will pass information relating to it to
the registers.

about you (Subject Access Request)or if you want to receive details of the relevant fraud
prevention agencies.

Update the Motor Insurance Database (MID)


Your Policy details will be added to the Motor Insurance Database (MID) which is run by the
Motor Insurers’ Bureau (MIB). The MID and the data stored in it may be used by the Driver
and Vehicle Licensing Agency (DVLA), Driver and Vehicle Licensing Agency (DVANI), the
Insurance Fraud Bureau and other bodies authorised by law for the purposes of, but not
limited to, Electronic Vehicle Licensing, continuous insurance enforcement, law
enforcement for the purposes of prevention, detection, apprehension and/or prosecution
of offenders and by government services and other services aimed at reducing the level and
incidence of uninsured driving.

If you are involved in a road traffic accident (in the UK, EEA or certain other territories),
other insurers and/or the Motor Insurers’ Bureau may search the MID to obtain relevant
policy information. Persons pursuing a claim (including his or her appointed
representatives) in respect of a road traffic accident (including citizens of other countries)
may also obtain relevant information which is held on the MID. It is vital that the MID holds
your current registration number. If it is incorrectly shown on the MID you are at risk of
having your vehicle seized by the police. You can check that your correct registration
number details are shown on the MID at www.askmid.com.

You should provide this information to anyone named insured to drive the vehicle covered
under the policy.

We may also record telephone calls for our mutual protection training and monitoring
purposes.

Financial Services Compensation Scheme

We are covered by the Financial Services Compensation Scheme (FSCS). You may be
entitled to compensation from the scheme in the unlikely event that we cannot meet our

Law and Jurisdiction applicable to this policy

This policy is governed by the laws of England and Wales and subject to the exclusive
jurisdiction of the courts of England unless prevented by international law.

Contracts (Rights of Third Parties) Act 1999 Clarification Clause

A person who is not a party to this policy will not have any rights to enforce any term of this
policy under the Contracts (Rights of Third Parties) but this does not affect any right or
remedy of a third party which exists or is available apart from that Act.

our final response in this matter.
