COUNTER-AFFIDAVIT
I, Roy Co, single, 27 yrs. old, Call center agent, Filipino citizen, with residence at No. 3,
Governor Pack Road, Baguio City, after having been duly sworn in accordance with the
law, hereby depose and state:

1. That I am the respondent in the Alleged Violation of R.A. 9262,otherwise known as

Anti-Violence Against Women and their Children and Violation of R.A. 9995,also
known as Anti-Photo and Video Voyeurism Act of 2009.

2. That we started dating since December 2014 and admit that on the 14th day of
February 2015 marked our first sexual congress which was regularly done, usually
at our residence.

3. That I admit the taking of pictures and video while having our sexual encounter
but with her consent and without any intention of publishing, reproducing and
broadcasting the same to the public.

4. That I vehemently deny the allegation of the complainant that I forced her to
watch pornographic movies of different genre and to imitate the same, the truth
is that:

4.1 She had the discretion to stop, resist and avoid what we are doing and I have
no control over her choices if she really hated it.

4.2 That it was not specifically stated in the Psychological Evaluation of Jema
conducted by Dr. Ivantot Mejias which was marked as Annex “A” that I caused
the damage, hence it should be inadmissible as evidence.

5. That I admit my refusal of deleting the photos and videos of our sexual congress
for the same reason that I have no intention of publishing, reproducing and
broadcasting the same.

6. That I deny intentionally showing Karen our private photos and videos. Karen
accidentally discovered the photos of my phone when she borrowed it to text a
friend.

6.1 I deny the charges of violation of Section 4 of the Prohibited Acts of Anti-photo
and Video Voyeurism Act because of lack of probable cause.

7. I am executing this Counter-Affidavit to deny all the allegations imputed against

me and to attest the truthfulness of the foregoing, and for all legal intents and
purposes it may serve.

IN WITNESS THERETO, I have hereunto set my hand this 13th day of February 2018 at
Justice Hall, Baguio City.
